RE: Incomplete Campaign Report- Late Fine
Dear Mr. Garcia:
Pursuant to §106.0703(2)(b)1, on December 17, 2012, a certified letterwas sent notifying you to
file an addendum to the incomplete report received in the City Clerk's Office, covering the
reporting period of 07/01/12 through 09/30/2012. The certified mail receipt was returned to the
Office of the City Clerk on December 21, 2012 (See Exhibit A.) You had 7 days after receipt of
the notice to file the addendum to the report providing the information necessary. To date, the
addendum to the report has not been received.
Pursuant to Florida Statutes §106.0703(7)(b): "Upon determining that a report is late, the filing
officer shall immediately notify the electioneering communications organization as to the failure
to file a report by the designated due date and that a fine is being assessed for each late day.
The fine shall be$50 per day for the first 3 days late and, thereafter, $500 per day for each late
day, not to exceed 25 percent of the total receipts or expenditures,whichever is greater, for the
period covered by the late report."
According to this formula,the subject penalty to date is$150(representing$50 per day for the
first 3 days late). Thereafter,the per day fine shall be$500. Upon receipt of the addendum to the
incomplete report, the amount of the fine shall be calculated. Payment of this fine shall be paid
to the filing officer and made payable to the City of Miami Beach within 20 days after receipt of
the notice of payment due, unless appeal is made to the Florida Elections Commission pursuant
to §106.0703(7)(c).
