2017-30062 Resolution RESOLUTION NO. 2017-30062 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER PERTAINING TO THE AWARD OF BIDS, PURSUANT TO INVITATION TO BID (ITB) NO. 2017-254-ZD FOR FLAMINGO PARK EXISTING HAND BALL COURTS RENOVATIONS; AUTHORIZING THE ADMINISTRATION TO ENTER INTO NEGOTIATIONS WITH HG CONSTRUCTION DEVELOPMENT & INVESTMENT, INC., THE LOWEST RESPONSIVE BIDDER; FURTHER, SHOULD THE ADMINISTRATION NOT BE SUCCESSFUL IN NEGOTIATING AN AGREEMENT WITH HG CONSTRUCTION DEVELOPMENT & INVESTMENT, INC., AUTHORIZING THE ADMINISTRATION TO ENTER INTO NEGOTIATIONS WITH OAC ACTION CONSTRUCTION, CORP., AS THE SECOND LOWEST RESPONSIVE BIDDER; FURTHER, SHOULD THE ADMINISTRATION NOT BE SUCCESSFUL IN NEGOTIATING AN AGREEMENT WITH OAC ACTION CONSTRUCTION, CORP., AUTHORIZING THE ADMINISTRATION TO ENTER INTO NEGOTIATIONS WITH WEST CONSTRUCTION, INC., THE THIRD LOWEST RESPONSIVE BIDDER; AND FURTHER AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT UPON CONCLUSION OF SUCCESSFUL NEGOTIATIONS BY THE ADMINISTRATION. WHEREAS, ITB No. 2017-254-ZD was issued on July 6, 2017, with a bid opening date of August 23, 2017, for Flamingo Park Existing Hand Ball Courts Renovations (the "Project"); and WHEREAS, the City received proposals from three (3) firms, HG Construction Development & Investment, Inc.; OAC Action Construction, Corp.; and West Construction, Inc.; and WHEREAS, as part of its due diligence, the Procurement Department verified that the three (3) proposal responses met the requirements of the ITB; and WHEREAS, as all bid prices received from the three (3) proposers were higher than the City's cost estimates for the Project, the Administration recommends that the City enter into negotiations in an effort to bring pricing in line with the City's estimated costs; and WHEREAS, after exercising his due diligence, the City Manager recommends that the Administration be authorized to enter into negotiations with HG Construction Development & Investment, Inc., the lowest responsive, responsible bidder; further, should the Administration not be successful in negotiating an agreement with HG Construction Development & Investment, Inc., the Administration recommends that it be authorized to enter into negotiations with OAC Action Construction, Corp., as the second lowest responsive, responsible bidder; further, should the Administration not be successful in negotiating an agreement with OAC Action Construction, Corp.; the Administration recommends that it be authorized to enter into negotiations with West Construction, Inc., the third lowest responsive, responsible bidder; and further recommends that the City Commission authorize the Mayor and City Clerk to execute an agreement upon conclusion of successful negotiations by the Administration. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept the recommendation of the City Manager pertaining to the award of bids, pursuant to Invitation to Bid (ITB) 2017-254-ZD for Flamingo Park Existing Hand Ball Courts Renovations; authorize the Administration to enter into negotiations with HG Construction Development & Investment, Inc., the lowest responsive bidder; further, should the Administration not be successful in negotiating an agreement with HG Construction Development & Investment, Inc., authorize the Administration to enter into negotiations with OAC Action Construction, Corp., as the second lowest responsive bidder; further, should the Administration not be successful in negotiating an agreement with OAC Action Construction, Corp., authorize the Administration to enter into negotiations with West Construction, Inc., the third lowest responsive bidder; and further authorize the Mayor and City Clerk to execute an agreement upon conclusion of successful negotiations by the Administration. RECOMMENDATION Adopt the Resolution. ANALYSIS Flamingo Park is a 36.53 acre park located within the boundaries of the Historic Flamingo Park neighborhood in South Beach.A Master Plan for Flamingo Park was prepared by Wolfberg Alvarez and Partners, Inc.As part of the City of Miami Beach Flamingo Park Master Plan, this project will address the renovations to the Joe Rubin and Robert C. Hass handball courts. The Joe Rubin and Robert C. Hass handball courts are comprised of six, four-walled courts, and four single-walled courts. The scope of work for this project will include various electrical upgrades including the addition of sports lighting, new general lighting, stucco repairs, court resurfacing, new frameless windows and doors, new fencing and painting.The courts will also include seating areas and water drinking fountains for players and visitors. ITB PROCESS Page 1177 of 1633 ITB No. 2017-254-ZD, was issued on July 6, 2017, with a bid opening date of August 23, 2017. Four(4)addenda were issued.The Procurement Department issued bid notices to 394 companies utilizing www.publicpurchase.com website. Sixty-eight (68) prospective bidders accessed the advertised solicitation. The notices resulted in the receipt of three (3) responses from: HG Construction Development & Investment, Inc., OAC Action Construction, Corp., and West Construction, Inc. The ITB stated that the lowest responsive, responsible bidder meeting all terms,conditions,and specifications of the ITB will be recommended for award. In its due diligence, the Procurement Department verified that the bids submitted by all three bidders met the requirements of the ITB, including: 1. Bid Guaranty: Bidder shall submit, with its bid, either an original bid bond executed by a surety company meeting the qualifications for surety companies as specified in Section 0500, General Conditions, or by certified check,cashier's check. 2. Licensing Requirements: Bidder shall be State of Florida licensed General Contractor to be considered for award and submit evidence of licensing with their bid. 3. Previous Experience: Bidders shall submit at least one (1) individual project reference exemplifying their experience for projects of facilities renovations of similar size (Approx. 15,000 Sq. ft. or $1 million contract minimum)and scope (as defined in Section 200). References must include projects completed within the last three (3)years. All three (3)bidders have been deemed responsive and responsible. However, all of the bid prices exceed the City's cost expectations (refer to Attachment A) of $886,000. Therefore, the Administration recommends negotiating with bidders in order of lowest cost submitted in an effort to bring the bid price in line with the City's estimated costs. A summary of each responsive responsible bidder follows: HG Construction Development & Investment. Inc. According to the information provided by the firm, HG Construction has been in business since 2006, and currently serves both Miami-Dade and Broward County. The firm's employees have extensive experience in traffic signals and signs. Currently, HG Construction is working alongside Miami-Dade County Parks and Recreation and Open Spaces Departments on several projects that entail similar scope and requirements as confirmed through reference checks. Additionally, some of the prior projects detailed in HG Construction's submittal included, the park construction of Danny Meehan Park and Miami Zoo (PCL Construction), which exemplify their experience with projects of similar size and scope. Additionally, HG Construction has worked with the City of Miami Beach's Transportation and CIP Departments to provide labor and equipment for an emergency repair of an electronic traffic control device at Alton Road/4th Street, traffic signals improvements pursuant to Miami-Dade County's Traffic Control Equipment Standards and Specifications for Section 654, and audible pedestrian countdown signals of Lincoln Road and West Avenue. OAC Action Construction. Corp. According to the information provided by the firm, OAC Action Construction has been in business since 2000. As a General Contractor, they have risen from humble beginnings to become an established prime contractor. The majority of their experience has been in performing design-build, new construction/renovations, alterations/additions, building system upgrades and repair/maintenance services in the Federal Government sector. The prior experience provided through their submittal, listed the following projects as similar in size and scope: UPH Sustainment Renovations and the Repairs and Egress Improvements to the hangars at the Clearwater Coast Guard Air Station. OAC has a healthy bonding capacity and proven workforce to meet the demands of complex projects. Looking to the future, OAC will continue to leverage their experience in the government sector and strengthen their presence in the private market. West Construction. Inc. According to the information provided by the firm, West Construction, Inc. was founded in 1969 on Page 1178 of 1633 the principal of delivering well-crafted, highly functional and cost effective projects. Through their years of successful project delivery, it has evolved into an international corporation. West's main office is in South Florida with projects in Liberia (West Africa), and throughout the Caribbean, which gives them the ability to design, construct and manage projects throughout Florida, the United States and the World. West Construction currently employs over 130 employees, experts in their respective fields, which possess a diverse range of experience in designing and building special places to live, work, shop and play. Included in their submittal, West Construction provided prior projects, which demonstrated their experience in similar projects; some of those projects include the following: Reconstruction and Upgrading at Samson Oceanfront Park, Improvements to the Lantana Sports Complex, and the Construction at Pine Trails Park Phase IV. CONCLUSION After reviewing proposals and staffs recommendations,which include the concerns over the bid costs as compared to the project budget, I recommend that the Mayor and City Commission approve the Resolution authorizing the Administration to negotiate with HG Construction Development & Investment, Inc., the lowest responsive, responsible bidder; and, should the Administration not be successful in negotiating an agreement with HG Construction Development & Investment, Inc., authorizing negotiations with OAC Action Construction, Corp., the second lowest responsive, responsible bidder; and, should the Administration not be successful in negotiating an agreement with OAC Action Construction, Corp. authorizing negotiations with West Construction, Inc., the third lowest responsive, responsible bidder and should the Administration not be successful in negotiating, authorize the City Manager to issue a new ITB; and further authorizing the Mayor and City Clerk to execute an agreement upon conclusion of successful negotiations by the Administration. KEY INTENDED OUTCOMES SUPPORTED Build And Maintain Priority Infrastructure With Full Accountability FINANCIAL INFORMATION The final cost of the related services for the construction and 10% owner's contingency, shall be determined upon successful negotiations and is subject to funds availability approved through the City's budgeting process. Grant funding will not be utilized for this project.
