CommissionerRosenGonzalez'sresignationwasfiled pursuanttodictatesoftheState'srecently -amendedResigntoRunlaw', whichrequireslocal electedofficialsseekingtoqualifyforfederalofficewhosetermsoverlaptosubmitirrevocable resignationspriortoqualifyingforsuchfederaloffice. Lastspring, CommissionerRosen GonzalezannouncedherintentiontorunasacandidatefortheCongressionalseatrepresenting Florida's27th District2, thetermofwhichseatrunsconcurrentlywithhertermasMiamiBeach CityCommissioner. 3 ThisLTChasbeenpreparedtoexplaintheimplicationsofCommissionerRosen Gonzalez'sresignationwithregardtoitscreationofavacancyontheCityCommission, andto assesstherelatedprocessforfillingsaidvacancyinaccordancewithCityCharterSection2.07. I. ResigntoRunLaw. TheResign -to -Runlaw, asamended, prohibitsanelectedorappointedstateorlocal officer (suchasaCityCommissioner) fromqualifyingtorunforanotherstate, district, county, municipalor (now) federal4officeifthetermsoranypartthereofoverlap, unlesstheofficer irrevocablyresignsfromtheofficethatheorshecurrentlyholds, atleast10daysbeforethe beginningofthequalifyingperiodfortheofficesought. Theresignationneednotbeeffective untiltheearlierofthedatetheresigningofficerwouldtakeoffice (ifelected) orthedatethe resigningofficer'ssuccessorisrequiredtotakeoffice. 1FloridaStatuteSection99.012. 2ThePrimaryelectionforthisCongressionalseatisAugust28, 2018andtheGeneralelectionis November6, 2018. 3Ifelected, CommissionerRosenGonzalezwouldassumeofficeonJanuary3, 2019. 4See, FloridaStatuteSection99.012(4), notingsuchparticularitieswithregardtoanincumbent's qualifyingforfederaloffice. LettertoCommission — VacancyonCityCommission Page2 Anyresignationofanelectedofficerresultsintheofficeheldbecoming "vacant" uponthe effectivedateoftheresignation.5Accordingly, andconsistentwiththeeffectivedatespecifiedin CommissionerRosenGonzalez'sresignation, CityCommissionGroup4seatwillbecomevacant onJanuary3, 2019, saidvacancytobefilledinaccordancewiththeCity'sCharter.6 II. CityCharterSection2.07 "VacanciesinCityCommission". PursuanttothebelowMiamiBeachCityCharterSection2.07, theCityCommission mustfillthevacancybyeitherappointmentorelection: AnyvacancyoccurringintheCityCommissionshallbefilledbythevoteofthe majorityoftheremainingmembersofsaidCityCommission' withtheappointee servingtheremainderoftheunexpired term8 untilthenextsucceedinggeneralCity electionandwithanyfurtherremainderofsaidunexpiredtermtobefilledbya Commissionerelectedatsaidgeneralelection; iftheremainingmembersoftheCity Commissionshallfailorrefusetofillsuchvacancywithin30daysafteritoccursandif nogeneralCityelectionwillbeheldwithin90daysaftertheexpirationofsaid30days, thenaspecialelectionshallbecalledandheldtoelectaCommissionertofillsuch vacancyfortheremainderoftheunexpiredterm. Accordingly, iftheCommissionchoosestoappointanindividualtofilltheGroup4vacancy, it mustdosobetweenJanuary3, 2019andFebruary2, 2019, withtheappointeeservingthe10+/ - monthremainderoftheGroup4term°, expiringinNovember2019. IftheCommissionhasnotappointedbyFebruary2, 2019, theCharterthenrequirestheCity CommissiontoscheduleaspecialelectiontobeheldbyMay3, 2019 (within90daysfrom expirationofthesubjectFebruary2ndappointmentdeadline)10, forpurposesofelectinga 5FloridaStatuteSection99.012(3). 6 "... Withregardtoanelectivechartercountyofficeorelectivemunicipaloffice, thevacancycreatedby theofficer'sresignationmaybefilledforthatportionoftheofficer'sunexpiredterminamanner providedbytherespectivecharter. ..." Id. at (4)(g). PerCharterSection2.07, appointmentshallbebythe "remainingmembers" ofCityCommission, meaningthatCommissionerRosenGonzalezmaynotparticipateorvoteontheissueofappointment. See, CharterSection2.02: "...termsnotincludingtimeservedasamemberoftheCityofMiamiBeach CommissionasaresultofhavingfilledavacancyintheCommissionpursuanttoSection2.07ofthe CityofMiamiBeachChartersolongassuchtimeservedinfillingavacancydoesnotexceed50 percentofthatsubjectterm. ..." 10AlthoughpreviousCityCommissionshaveonoccasioninterpretedCharterSection2.07aspermitting deviationfromtheaboveliteralinterpretationofCharterSection2.07 (byschedulingearlierelectionsto fillCommissionvacancies, occurringatthecountywideelectionimmediatelyfollowingaresignation's filingdate), itismyrecommendationthatastrictconstructionoftheCharterbeadheredtowithregardto thefillingofvacancies. Wearecommittedtoprovidingexcellentpublicserviceandsafetytoallwholive, work, andplayinourvibrant, tropical, historiccommunity. LettertoCommission — VacancyonCityCommission Page3 candidatetofilltheGroup4seatforthesubjecttermremainder. Inthisregard, itisworthnoting thattheCountyElectionsDepartmenthasinformedtheCityClerkthat (excludingadvertising costs) thecostofaCitystand-alonespecialelectionwithearlyvotingwouldbe $ 316,597.64 withanadditional $ 303,797.64foraRun-offElectionwithearlyvoting (ifRun -Offis necessary). III. Conclusion. InlightoftheimminentvacancyontheCityCommissionduetoCommissionerRosen Gonzalez'sresignationfromherGroup4Commissionseat, theCommissionisrequiredtofill thatvacancybyeitherappointmentor, ifnoappointment, thenbyelection. Shouldthe Commissionoptnottoappoint, underCharterSection2.07, theCommissionmustschedulea SpecialElection, tobeheldbyMay3, 2019, forthepurposeoffillingtheGroup4seatforthe remainderofthatterm.
