A RESOLUTION OF THE EXECUTIVE COMMITTEE OF THE
LINCOLN ROAD BUSINESS IMPROVEMENT DISTRICT, INC.,
EXPRESSING SUPPORT FOR THE ADOPTION OF LEGISLATION BY
THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI
BEACH TO ELIMINATE THE SQUARE FOOTAGE THRESHOLD
FROM THE DEFINITION OF "CONVENIENCE STORE" AND
REGULATE SUCH ESTABLISHMENTS WITHOUT REGARD TO SIZE
WIIEREA,S,on April 15, 2015, the-Mayor and City_Commissionof the-City of Miami_
Beach ("City Commission") adopted Resolution No. 2015-28992, creating a special assessment
district to be known as the Lincoln Road Business Improvement District,Inc,, ("LRBID"), for a
term of ten(10)years,to stabilize and improve the Lincoln Road retail business district; and
WHEREAS, the LRBH) is comprised of the owners of seventy-six (76) properties
abutting and surrounding Lincoln Road;and
WHEREAS,the LRBID wishes to encourage the development of a vibrant Lincoln Road
mixed-use neighborhood, thereby providing a dynamic setting for businesses and area residents
alike;and

WHEREAS, on March 1, 2017, the City Commission adopted Ordinance No, 2017-
4078, providing that certain establishments, including"convenience stores," shall be prohibited
on properties with a lot line on Lincoln Road between Alton Road and Collins Avenue;and
WHEREAS, pursuant to Ordinance No, 2017-4078, the term "convenience store" is
defined as"a retail store with direct access from the street or sidewalk containing less than 6,000
square feet of floor area that is designed and stocked to sell primarily food (packaged and/or
prepared), beverages, newspapers, magazines, and other household supplies to customers who
generally purchase a relatively few number of items (in contrast to a "grocery store" or"super
market"). It is designed to attract and depends upon a large turnover of customers";and
WHEREAS, the legislative history of 2017-4078 confirms that the legislation was
intended to prohibit all convenience stores,regardless of size,from Lincoln Road;and
WHEREAS,on March 13,2019, the City Commission considered a proposed ordinance
that, if implemented, would clarify that all convenience stores, regardless of size, are prohibited
on Lincoln Road;and
WHEREAS, the prohibition of such establishments, regardless of their size, on
properties with a lot line on Lincoln Road is necessary to protect the unique, iconic, and historic
nature of the area.
NOW, THEREFORE, BE IT RESOLVED BY THE EXECUTIVE COMMITTEE
OF THE LINCOLN ROAD BUSINESS IMPROVEMENT DISTRICT, INC.:
ctioit I. The Executive Committee ot'the LRBID hereby expresses its support for the
adoption of legislation to eliminate the size threshold from the definition of"convenience store,"
thereby regulating such establishments without regard to their size.
Section 2. The Executive Committee of the LRBID hereby expresses its opposition to
any language, policy, or efforts to include"applicability" language that would allow the opening
of any new convenience store, regardless of size,on Lincoln Road

of the LRBID to transmit a copy of this resolution to the City Commission and the City Manager
of the City of Miami Beach,
