A RESOLUTION OF THE MAYOR AND CITY COMMISSION REQUESTING THE
GOVERNOR AND LEGISLATURE TO PROTECT THE LIVES OF POLICE
OFFICERS BY CHANGING THE LAW TO INCREASE THE TRANSPARENCY OF
DRIVER SIDE WINDOWS AND MAKE IT MANDATORY FOR DRIVERS AT
TRAFFIC STOPS TO FULLY LOWER THEIR WINDOWS.

RESOLUTION NO. 030-19-15302
A Resolution of the Mayor and City Commission requesting the Governor
and Legislature to protect the lives of police officers by changing the law to
increase the transparency of driver side windows and make it mandatory for
drivers at traffic stops to fully lower their windows.
WHEREAS,traffic stops are a dangerous part of a police officer's duties; and
WHEREAS,visible light transmission(VLT) is the measurable amount of solar visible
light(daylight)that travels through a window; and
WHEREAS,a low VLT percentage means that less light can pass through a window and
a higher VLT percentage means that more light can pass through making it more transparent; and
WHEREAS,Florida, at 28 VLT%, allow for some of darkest tinting of driver side
windows in the nation and on a par with only 11 other states that allow the darkest tinting in the
United States; and
WHEREAS, California and ten other states, at 70 VLT%,have the most transparent
driver side window tinting laws which lessens the danger to police officer who are forced to
make a traffic stop; and
WHEREAS, California also requires that the reflectivity of the windows be not be more
reflective than a standard window.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSIONERS OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. The Mayor and City Commission hereby requests that all municipal and
county governments join in asking their elected State officials to change the law to increase the
transparency of driver side window tinting and reflectivity, require that drivers' windows be fully
lowered at traffic stops and educate drivers by including"DRIVER WINDOW DOWN FOR
POLICE TRAFFIC STOPS"with the existing informational signs such as"CHILD
RESTRAINT REQUIRED BY LAW"and"MOVE OVER FOR EMERGENCY VEHICLES"
that the State prominently displays on roadways.
Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for
any reason held invalid or unconstitutional by a court of competent jurisdiction,the holding shall
not affect the validity of the remaining portions of this resolution.
Section 3. Effective Date. This resolution shall become effective immediately upon
adoption.
