Morales, City Manager Opr,- DATE: September 27, 2019 SUBJECT: Tree Preservation Denial Letter The purpose of this Letter to Commission is to update the Mayor and City Commission on Miami- Dade County's Department of Regulatory and Economic Resources denial of a tree variance request to preserve a large Ficus microcarpa located at 6626 Roxbury Lane, Miami Beach, FL 33141. Since tree protection is so important in Miami Beach, and we do have our own ordinance, I wanted to make sure the Mayor and Commission are aware. As a part of a Design Review Board application process, the city's urban forester was requested to meet with the landscape architect with Biscayne Environmental, Inc. representing the property mentioned above to review their proposal of removing a large Ficus microcarpa from the property as part of the proposed redevelopment. During the July 17th, 2019 meeting, the landscape architect stated they wanted to have the tree removed due to the species being labeled a prohibited invasive species under Miami Dade County Code Sec. 24-49.9. The city's urban forester advised the landscape architect that the tree should be preserved as per requirements in Miami Beach Code Sec.46 Division 2. Furthermore, the landscape architect was advised that a part of the tree removal permit would include a draft of a variance letter to the county to secure preservation of the tree as is required by city and county code. On September 24, 2019, the city was presented the denial letter from the county dated August 27, 2019 (Attachment A). Biscayne Environmental, Inc. prematurely requested a variance from Miami Dade County, as the property had not applied for a tree removal permit with the city to date. As such, the city was unable to review the letter and verify if the necessary information was provided to the county for a proper review and determination. At this time, staff has the following observations related to the letter provided to the city: 1. The county's determination for denial based on the trees proximity to the coastal dune system and potential voluntary introduction of this invasive species to this natural habitat system is not a valid argument. The city's costal dune system is managed through a dune management plan which removes invasive species such as these from the dunes. 2. The county's determination for denial based on no compensatory action presented to offset environmental impact also holds no merit, as this would have been addressed if the letter was submitted in accordance to a tree permit removal. This would have been presented to the county via a comprehensive mitigation plan and or tree trust fund contribution. 3. Finally, the variance denial currently holds no merit as per County Code sec. 24-49.9 states that the tree shall be removed as part of development or redevelopment. This property is currently not at this stage and is currently still in an application status with the design review board. The Environment and Sustainability Department is submitting a repeal request. City staff will be meeting with the county on Thursday, October 3rd, 2019, to discuss the variance letter as well as other code amendments to Sec. 46 Division 2 of the city code. The amendments to the City Code Sec. 46 Division 2 will be presented to the commission for second reading in the October 16, 2019 commission meeting. Salmanson TRS property located at 6626 Roxbury Lane, Miami Beach, Florida, 33141 (Folio #02-3210-016-0090) Dear Mr. Ettman: The Division of Environmental Resources Management (DERM) of the Department of Regulatory and Economic Resources (RER) has reviewed the above referenced variance request, which was received by our office on July 30, 2019. An assessment of the laurel fig tree dated June 7, 2019 by certified arborist James Legette (ISA #S000502) was also submitted. Please note that the scientific nomenclature of Ficus nitida is no longer used by the Florida Exotic Pest Plant Council (FLEPPC) 2019 list to identify laurel fig trees. Therefore, the tree under this exotic species variance request is more correctly referred to as Ficus microcarpa. The assessment confirmed the presence of one (1) laurel fig tree, which is on Miami-Dade County's prohibited plant species list. Laurel fig trees are also listed as a Category I species within the FLEPPC 2019 list of invasive plant species. Category I invasive species alter native plant communities by displacing native species, changing community structures or ecological functions, or hybridizing with natives. In order to evaluate the subject request, the relevant factors of Section 24-49 9(3)(b) of the Code of Miami- Dade County were taken into consideration including the proximity of the tree to any environmentally sensitive areas, historic designation of the tree and compensatory actions to offset any environmental impacts of granting the variance. The subject laurel fig tree is located approximately 1/2 mile west of the coastal dune ecosystem, which is considered an environmentally sensitive area. Laurel fig trees are the most common non-native ficus species found in our natural areas and are commonly seen growing as epiphytes on host species such as native sabal palms (Saba!palmetto) and live oak (Quercus virginiana) trees that can strangle and eventual kill their host plant. The subject laurel fig tree is not designated as a historic tree by the City of Miami Beach Historic Preservation Board. Furthermore, the information submitted with the exotic species variance request did not propose any compensatory actions to offset any adverse environmental impacts if the variance was granted. Pursuant to the above, DERM is unable to recommend approval of this variance request. Based upon the evaluation factors contained within Section 24-49.9 of the Code of Miami-Dade County, the variance request is hereby denied. Therefore, all vegetation prohibited by the Code of Miami-Dade County that is present on the above referenced property including but not limited to the laurel fig tree, shall be eradicated prior to additional development or redevelopment of this property.
