SUBJECT: Short-Term Rental Fines to the ami-Dade County Homeless Trust
As you know, on October 7, 2019, the Miami-Dade Circuit Court struck down the city's
short-term rental fines structure. This impacts the city's allocation of a portion of these
fines approved in the FY 2020 budget.
At its March 13, 2019 meeting, the Mayor and Commission referred to the Finance and
Citywide Projects Committee (FCWPC) a discussion on a variety of items associated with
homeless and domestic violence services including:
The need to monitor the state legislative session for possible preemption issues;
▪ Looking for other funding sources to support homeless and domestic violence
efforts such as the one-time short-term rental fines collected by the City;
• Approving a resolution urging the state to include additional funds in the state
budget to address homelessness.
At its April 19, 2019 meeting, the FCWPC further discussed the contribution of monies to
the Miami-Dade County Homeless Trust to support domestic violence and recommended
that the city identify and commit recurring funds to bolster our City's support of domestic
violence services. Short-term rental fines, which had been originally mentioned as a
possible funding source at the March 13, 2019 City Commission meeting, were identified
as the funding source for this initiative.
At its May 9, 2019 meeting, the City Commission approved $250,000 to the Miami-Dade
County Homeless Trust dedicated to domestic violence (with a goal to initially fund from
short term rental fines for two years)with additional funds to be allocated for both domestic
violence and homeless services starting in FY 2022 from other funding sources. This was
adopted I the FY2020 budget.
Considering the court decision and the uncertainty as to the future of these fine collections,
the funds will not be released to the Homeless Trust as we revisit the court's action and
its impact to the city.
