SUBJECT: Imposition of Immediate Measures Dring High Impact Period/Event
The purpose of this Letter to Commission is to provide formal notification to the
Mayor and City Commission of the actions taken by the City Manager to invoke
certain provisions of the City's Ordinance regarding High Impact Periods within
High Impact Zones, as set forth in Section 82-443 of the City Code, for Super
Bowl LIV.
Due to the anticipated attendance for those events surrounding Super Bowl LIV
(based upon information provided by the NFL and the Super Bowl LIV Host
Committee), I am imposing immediate measures (pursuant to Section 82-443) in
order to protect the health, safety and welfare of the general public, to include the
protection of public and private property from damage, degradation, and/or
unauthorized uses.
The duration of the following immediate measures shall be from Friday, January
24, 2020 at 7:00 a.m. through Monday, January 27, 2020 at 7:00 a.m.; and from
Friday, January 31, 2020 at 7:00 a.m. through Monday, February 3, 2020 at 7:00
a.m.
Those measures to be imposed throughout the duration of those High Impact
Periods, as identified above, shall include:
• The prohibition of coolers and any inflatable devices on public beach property;
and
• The prohibition of tents, tables, and similar structures; and
• The limitation of live or amplified music unless otherwise authorized by Special
Event permit; and
• The prohibition of any direct or indirect consumption of alcohol on pubic beach
property; and

• The implementation of a license plate reader police detail; and
• The suspension of all business tax receipt(s) issued to promoters for any dance
or entertainment event( s) to be held at an alcoholic beverage establishment
located in the MXE mixed use entertainment district (excluding that portion of the
MXE located between 73" and 75 Streets), and in that portion of the CD-2
commercial, medium intensity district between Pennsylvania Avenue and Collins
Court, from 5 Street to 16 Street; and
• Ocean Drive will be closed to vehicular traffic from Friday, January 31, 2020 at
7:00 a.m. through Monday, February 3, 2020 at 7:00 a.m.; and
• Española Way, from Collins Avenue to Washington Avenue, will be closed to
vehicular traffic from Friday, January 31, 2020 at 7:00 a.m. through Monday,
February 3, 2020 at 7:00 a.m.
While the City Manager may suspend or close all or part of sidewalk café
operations (including, without limitation, the removal of any or all sidewalk café
furniture) pursuant to 82-443(b)(9) of the City Code, at this juncture, no such
suspension or closure has been imposed.
These measures shall become part of the Incident Action Plan for Super Bowl LIV
2020, to be published by the Department of Emergency Management.
Moreover, the City's Police, Fire, Parking and Code Compliance Departments, as
well as the Sanitation and Beach Maintenance Divisions, are authorized to
implement additional operational measures, as necessary.
Any violation of the imposed measures shall be punished as provided in City Code
Section 1-14, and this notice shall be filed with the City Clerk, transmitted to various
media outlets and posted on the City's website, in compliance with Section 82-
443(c) of the City Code.
