SUBJECT: Ambient Entertainment Permit
The purpose of this Letter to Commission is to inform the Mayor and City Commission of the
launch of the Ambient Entertainment Permit Program. On October 16, 2019, the City Commission
adopted Ordinance 2019-4309, amending Chapter 12 of the Code of the City of Miami Beach and
creating Section 12-6 to establish an Ambient Entertainment Permit Program.
On Wednesday, February 19, 2020, the Ambient Entertainment Permit Program will launch online
in response to the interest of both residents and area businesses and their shared excitement to
activate their community. The Ambient Entertainment Permit Program will allow local, qualifying
restaurants to provide indoor ambient entertainment that does not interfere with the quiet
enjoyment of the community and cannot be heard outside the venue, while abiding with all existing
City of Miami Beach noise ordinances.
Local restaurants with a venue occupancy of less than 299 people will now have an opportunity
to provide ambient entertainment, at volume levels which do not interfere with normal
conversation, from 10:00 am to 12:00 midnight, 7 days a week. Initially, the Ambient
Entertainment Permits will be limited in numbers, and will be in specific neighborhoods where
entertainment is permitted (see attached maps). The City of Miami Beach Tourism and Culture
Department will issue these permits and Code Compliance will oversee enforcement.
To qualify for this program, restaurants must have an active Business Tax Receipt ("BTR) that is
in good standing, with no outstanding City Code violations, and must abide by the City Code with
respect to Arts, Culture and Entertainment, Land Use, Building and Fire regulations.
Interested restaurants must also meet all of the following criteria:
• The restaurant must be located north of 40" Street or within the Collins Park neighborhood,
as well as within a zoning district where entertainment is currently permitted;
• Have an active BTR in good standing, as well as an occupancy load, as stated on the BTR,
of less than 299 people;
• Hours of activation are 10 am to 12 midnight, 7 days a week;
• Be in good standing with the City of Miami Beach regarding Code violations and outstanding
payments;
• Pro vide approved signature surv ey sign-off fro m adjacent businesses and/or hom eow ner
associations;
• Pro vide pro of of general liability insurance.
An nu al appl ication and permi t fees are $258 each an d will be issued annually from October 1°to
September 30" and valid for that fiscal year. To download the permit application, applicants can
visit, www.miamibeachfl.gov and submit application to events@miamibeachfl.gov
On Wednesday, February 19, 2020, the Administration will host two (2) community meetings to
assist applicants with the application and answer any questions or concerns. The meetings will
be held at the following times and locations:
• 10:00 AM - North Shore Park Youth Center of Miami Beach, located at 501 727° Street
• 6:00 PM - City of Miami Beach Commission Chamber, located at 1700 Convention Center
