1011, PREEMPTING THE REGULATION OF VACATION RENTALS TO THE
STATE.

A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
HALLANDALE BEACH, FLORIDA, OPPOSING SENATE BILL 1302, IN
RELATION TO SOVEREIGN IMMUNITY; PROVIDING AN EFFECTIVE DATE.

3 CITY OF HALLANDALE BEACH, FLORIDA, OPPOSING SENATE BILL
4 1174, RELATING TO LOCAL COMMUNICATIONS SERVICES TAX
5 RATES; PROVIDING AN EFFECTIVE DATE.

7 WHEREAS, on December 9, 2019, Florida Senator Travis Hutson filed Senate Bill
8 1174, reducing local communication sales tax to 5% or less by January 1, 2021 and 4%
9 or less by January 1, 2022, and repealing the local option sales surtax conversion that is
10 levied on communication services; and
11
12 WHEREAS, the communication services tax is a vital source of revenue for cities
13 including funding police, fire and other important municipal services; and
14
15 WHEREAS, is passed Senate Bill 117 4 would reduce local revenues by $190
16 million statewide and result in a 25-35% reduction for the City of Hallandale Beach; and
17
18 WHEREAS, Senate Bill 1174, if passed, would significantly reduce such revenues
19 that municipalities rely upon, placing a greater burden on other revenue sources,
20 including, ad valorem property taxes; and
21
22 WHEREAS, the City Commission opposes Senate Bill 1174; and
23
24 WHEREAS, the Mayor and City Commission believe it is in the best interest of the
25 City to approve this Resolution; and
26
27 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY
28 COMMISSION OF THE CITY OF HALLANDALE BEACH, FLORIDA:

30 SECTION 1. The foregoing recitals contained in the preamble to this Resolution

SECTION 2. The Mayor and City Commission opposes Senate Bill 1174.
SECTION 3. The City Clerk is directed to distribute this Resolution to the Florida

4 1128/HOUSE BILL 1011, PREEMPTING THE REGULATION OF
5 VACATION RENTALS TO THE STATE.

7 WHEREAS, on December 4, 2019, Florida Senator Manny Diaz, Jr. filed Senate
8 Bill 1128, seeking to preempt local regulation of vacation rentals; and
9
10 WHEREAS, on December 19, 2019, Florid Representative Jason Fischer, filed
11 companion bill, House Bill 1011, with identical preemptions to Senate Bill 1128; and
12
13 WHEREAS, under the Florida Constitution and Section 166.021, Florida Statues,
14 municipalities are given broad home rule powers; and
15
16 WHEREAS, as part of their home rule powers, municipalities should have the
17 ability to regulate vacation rentals in their jurisdiction; and
18
19 WHEREAS, municipalities should continue to have the power to decide what is
20 consistent with the needs of their own communities; and
21
22 WHEREAS, if Senate Bill 1128/House Bill 1011 passed, it would violate the home
23 rule powers of municipalities; and
24
25 WHEREAS, the City Commission opposes Senate Bill 1128 and House Bill 1011;
26 and
27
28 W HEREAS, the Mayor and City Commission believe it is in the best interest of the
29 City to approve this Resolution; and

31 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY

5 1302, IN RELATION TO SOVEREIGN IMMUNITY; PROVIDING AN
6 EFFECTIVE DATE.

8 WHEREAS, on December 19, 2019, Florida Senator Anitere Flores filed Senate
RESOLUTION NO. 2020-021
9 Bill 1302, increasing the per occurrence limits on the collectability of judgments against
10 government entities from $300,000 to $500,000 and eliminating the $200,000 per claimant
11 limit; and
12
13 WH EREAS, the new limits would apply to lawsuits that have not been adjudicate
14 before the effective date of Senate Bill 1302, therefore, making the new higher monetary
15 limits retroactive; and
16
17 WHEREAS, of passed Senate Bill 1302 would force local governments to increase
18 property taxes to pay for the higher liability amounts, the likely increase in the number of
19 lawsuits filed against government entities and higher insurance premiums; and
20
21 WHEREAS, the City opposes Senate Bill 1302; and
22
23 WH EREA S, the Mayor and City Commission believe it is in the best interest of the
24 City to approve this Resolution; and
25
26 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY
27 COMMISSION OF THE CITY OF HALLANDALE BEACH, FLORIDA:
