Amendment No.1 with Wannemacher Jensen Architects, Inc. 2c22� 3L3jd AMENDMENT NO. 1 TO THE PROFESSIONAL ARCHITECTURAL AND ENGINEERING (A/E) SERVICES AGREEMENT BETWEEN THE CITY OF MIAMI BEACH, FLORIDA AND WANNEMACHER JENSEN ARCHITECTS, INC. DATED OCTOBER 24, 2019 FORTHE PROVISION OF ADDITIONAL PROFESSIONAL ARCHITECTURAL AND ENGINEERING SERVICES FORTHE FIRE STATION NO.1 PROJECT IN THE AMOUNT OF $571,037. THIS Amendment No. 1 to the Agreement is made and entered this ?C day of OGo,cr , 2022, by and between the CITY OF MIAMI BEACH, a municipal corporation existing under the laws of the State of Florida (the "City"), having its principal offices. at 1700 Convention Center Drive, Miami Beach, Florida 33139, and WANNEMACHER JENSEN ARCHITECTS, INC., a Florida Corporation having its principal office at 132 Mirror Lake Drive N, Unit 301, Saint Petersburg, Florida 33701 (the"Consultant"). RECITALS WHEREAS,on October 24,2019,a Professional Services Agreement was executed with VVannemacher Jensen Architects, Inc. (WJA), pursuant to the Request for Qualifications (RFQ) No. 2019-208-ND for Architectural and Engineering Design Services, for the new Fire Station 1 facility, in the amount of$999,917.00; and WHEREAS, the Consultant developed several conceptual design plan options, to address all the programmatic need of the Fire department; and WHEREAS, the 911 Dispatch Call Center, which has been included in the project to renovate the Police Headquarters, is no longer part of the Fire Station project; and WHEREAS, the Consultant.submitted 30% construction documents for the new Fire Station at the site of the South Shore Community Center 833 6th Street, which provides access to frontages on the three sides on 6th Street Jefferson Avenue and Meridian Avenue, which is also the location of public surface parking lot, P-11, and provides access to the alley, Meridian - Court; and WHEREAS,the proposed 29,369 square feet facility will provide four drive-thru elevated apparatus bays with 34 parking spaces below the building, living spaces, offices, a kitchen, a gym, support facilities on upper floors, access ramps from Meridian Avenue and Jefferson Avenue to the elevated apparatus bays, and requires the demolition of the two story, Morris Lapidus designed, South Shore Community Center, and improvements to the sidewalks, and right of way adjacent to the site; and WHEREAS, at the March 8,2022 the Historic Preservation Board (HPB), the design for Fire Station No. 1 was approved, with portions of the existing South Shore Community Center incorporated into the design,and conditions from the board included vacation of the existing right- of-way which currently runs beneath the existing building, preparation of a Unity of Title for the parcels of land, re-platting the property, and detailed documentation of the existing building; and WHEREAS, the development of the 60% Construction Documents has determined that Florida Power and Light(FPL)and AT&T have utilities that run under the existing building to serve the rest of the block to the north that need to be relocated; and that gas, water and fiber optic service lines,which currently traverse the northeast corner of the site without the required utility easement, and will have to be removed and replaced as appropriate, and with the required easements provided; and WHEREAS, the final scope of work, resulting from complying with all Fire Department requirements, complying with conditions imposed by the HPB and alterations required to existing utilities on site, will require additional design and engineering services; and WHEREAS, Amendment No. 1 to the professional services consultant's agreement, includes the additional surveying services and subsurface utility engineering required for work in the right of way on Meridian Avenue, Jefferson Avenue and 6th Street and additional surveying services for the re-platting of the site as required for the vacation of the right-of-way, and preparation and recording of the Unity of Title; and WHEREAS, additional architectural and landscaping scope is required to obtain HPB approval, including incorporating elements of the existing building into the proposed design and preparation of detailed measured drawings and photographic documentation of the existing building as requested by the HPB, preparation of renderings and a flyover video of the project site, and coordination and redesign of the surrounding landscape to include off site tree locations; and WHEREAS, additional architectural, mechanical, electrical, plumbing and structural engineering services through construction are necessary for the under building parking, the access ramps, the detailed documentation of the South Shore Community Center prior to demolition, additional harmonization to maintain access to Meridian Court and the P-11 parking lot, and the coordination for the design of the FPL transformer vault and utilities relocation; and WHEREAS, Wannemacher Jensen Architects has submitted a negotiated not to exceed proposal in the amount of$571,037; and WHEREAS, the negotiated proposal submitted by the Consultant was reviewed and analyzed by City staff and was found to be fair and reasonable; and WHEREAS, this Amendment No. 1, in the amount of$571,037 will revise the total contract to a not to exceed total of$1,570,954. NOW, THEREFORE, the parties hereto, and inconsideration of the mutual promises, covenants, agreements, terms, and conditions herein contained, and other good and valuable consideration,the respect and adequacy are hereby acknowledged, do agree as follows: 1. ABOVE RECITALS The above recitals are true and correct and are incorporated as a part of this Amendment No. 1. 2. MODIFICATIONS (a) The Agreement is amended, as provided herein and in Schedule "A"attached hereto. (b) In consideration for the services to be performed under this Amendment No. 1, City shall pay Consultant the not-to-exceed amount of$571,037, as provided in schedule"B", attached hereto. 3. OTHER PROVISIONS. All other provisions of the Agreement, as amended, are unchanged and shall remain in full force and effect. 4. RATIFICATION. The City and Consultant ratify.the terms of the Agreement, as amended by this Amendment No. 1.
