Resolution 2024-33436RESOLUTION NO. 2024.33436 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, DIRECTING THE ADMINISTRATION TO ISSUE A BI-WEEKLY LETTER TO COMMISSION (LTC) COMMENCING ON DECEMBER 20, 2024, PROVIDING REGULAR UPDATES ON CODE ENFORCEMENT, PROPERTY MANAGEMENT ACTIVITIES, AND THE STATUS OF SPECIAL MAGISTRATE CASES INVOLVING PROPERTIES AND/OR BUSINESSES LOCATED IN NORTH BEACH; AND FURTHER, DIRECTING THE ADMINISTRATION TO CAUSE A REPRESENTATIVE OF THE CODE ENFORCEMENT DEPARTMENT TO APPEAR BEFORE THE LAND USE AND SUSTAINABILITY COMMITTEE EVERY OTHER MONTH COMMENCING IN FEBRUARY 2025 TO ADDRESS ANY ONGOING CONCERNS AND NEW DEVELOPMENTS IN NORTH BEACH; AND FURTHER, RESCINDING RESOLUTION NO. 2023-32356 WHICH DIRECTED THE ADMINISTRATION TO PROVIDE REGULAR STAFFING UPDATES FROM THE BUILDING DEPARTMENT, INCLUDING A MONTHLY REPORT ISSUED BY LETTER TO COMMISSION. WHEREAS, the City of Miami Beach is committed to maintaining the highest standards of property maintenance, code enforcement, and the proper management of public spaces within the City; and WHEREAS, North Beach, as one of the City's distinct and evolving neighborhoods, requires targeted efforts to address code enforcement issues, property management needs, and other concems affecting the quality of life for residents and businesses; and WHEREAS, regular updates on the activities and progress of code enforcement and property management, as well as information on the resolution of Special Magistrate cases, are essential to provide transparency and keep residents and stakeholders informed about the ongoing work being done in North Beach; and WHEREAS, the Mayor and City Commission desire to ensure the administration of these critical functions is communicated in a timely and effective manner to enhance public awareness and engagement and promote accountability within City operations; and WHEREAS, to achieve the foregoing goals, the Commission desires to require the issuance of a bi-weekly Letter to Commission (LTC) to provide regular updated on the following: 1. Code Enforcement: A summary of all violations issued in North Beach, including information about the nature of the violations, enforcement actions taken, and any trends or areas of concern requiring further attention. 2. Property Management Activities: Updates regarding property maintenance activities conducted at City -owned properties, as well as any activities related to the upkeep of public rights of way, including cleaning, landscaping, and infrastructure improvements. 3. Special Magistrate Cases: The status of cases before the Special Magistrate involving properties and/or businesses located in North Beach, including the disposition of cases, penalties or fines levied, and compliance or enforcement actions taken; and WHEREAS, this bi-weekly report shall serve as a proactive tool to track and resolve ongoing code enforcement and property management challenges in North Beach and to ensure that issues affecting public safety and neighborhood quality are addressed in a timely and efficient manner; and WHEREAS, to ensure transparency and accountability, a representative of the Code Enforcement Department shall be required to appear every other month before the Land Use and Sustainability Committee every other month to address ongoing concerns and new developments in North Beach; and WHEREAS, as the Building Department has made substantial progress in filling vacant positions, the regular reporting required pursuant to Resolution No. 2023-32656, is no longer needed. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby direct the Administration to issue a bi-weekly Letter to Commission (LTC) on a recurring basis, commencing on December 20, 2024, to provide regular updates on code enforcement, property management activities, and the status of special magistrate cases involving properties and/or businesses located in North Beach; and further, direct the Administration to cause a representative of the Code Enforcement Department to appear before the Land Use and Sustainability Committee every other month commencing in February 2025 to address any ongoing concerns and new developments in North Beach; and further, rescinding Resolution No. 2023-32356 which directed the Administration to provide regular staffing updates from the Building Department, including a monthly report issued by Letter to Commission.
