HomeMy WebLinkAboutResolution 2026-34268RESOLUTION NO. 2026-34268 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ADDING ENHANCING CRIMINAL PENALTIES FOR HABITUAL FELONY OFFENDERS AND AMENDING THE HABITUAL MISDEMEANOR OFFENDER REQUIREMENTS TO THE CITY'S LIST OF 2027 STATE LEGISLATIVE AGENDA PRIORITIES. WHEREAS, each year, the Mayor and City Commission of the City of Miami Beach adopt a list of legislative priorities for the annual session of the State Legislature to address issues critical to the City and its residents; and WHEREAS, the City is committed to ensuring the safety and well-being of its residents and visitors; and WHEREAS, habitual criminal offenders impose significant burdens on the State of Florida, costing more than $330 million annually and requiring increased utilization of law enforcement and public safety resources; and WHEREAS, pursuant to Section 775.084, Florida Statutes, a habitual felony offender is defined as an individual previously convicted of at least two qualifying felony offenses, and although courts may impose extended terms of imprisonment on such offenders, the statute does not require the imposition of any mandatory minimum sentence; and WHEREAS, pursuant to Section 775.0837, Florida Statutes, a habitual misdemeanor offender is defined as a defendant with at least four specified misdemeanor convictions within a one-year period; and WHEREAS, the City seeks legislative action to strengthen state laws governing habitual felony and misdemeanor offenders in order to enhance public safety and reduce repeat criminal activity; and WHEREAS, the Mayor and City Commission direct the City Administration to add to the City's 2027 State Legislative Agenda the following priorities: • Establishing mandatory -minimum sentences for qualifying habitual felony offenders; • Reducing the number of required convictions for designation as a habitual misdemeanor offender to three convictions; and • Expanding the period for counting qualifying misdemeanor convictions from one year to two years. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby add enhancing criminal penalties for habitual felony offenders and amending the habitual misdemeanor offender requirements to the City's list of 2027 State Legislative Agenda priorities.
