A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AMENDING THE CITY'S STATE
LEGISLATIVE PRIORITIES TO REQUEST THAT THE FLORIDA
LEGISLATURE AMEND APPLICABLE PROVISIONS OF THE
COMMUNITY PLANNING ACT, SET FORTH IN CHAPTER 163,
FLORIDA STATUTES, TO GRANT LOCAL GOVERNMENTS GREATER
AUTHORITY TO REVIEW DEVELOPMENT APPLICATIONS FOR
IMPACTS ON TRAFFIC AND TRANSPORTATION INFRASTRUCTURE
AND IMPOSE REASONABLE CONDITIONS AND MITIGATION
REQUIREMENTS.
WHEREAS, the City of Miami Beach ("City"), which is comprised of densely populated
barrier islands, is uniquely vulnerable to traffic impacts generated by new development and
redevelopment, such as congestion and extended emergency evacuation times; and
WHEREAS, the City has a substantial interest in ensuring that new development does not
overburden the City's transportation infrastructure, or degrade emergency response times or
capacity on evacuation routes; and
WHEREAS, ensuring pedestrian, bicycle, and vehicle safety is among the City's highest
priorities; and
WHEREAS, the Community Planning Act, set forth in Chapter 163, Florida Statutes (the
"Act"), prohibits local governments in Florida that implement a transportation concurrency system
from denying a development application on the basis that a roadway will operate below the
adopted level of service; and
WHEREAS, the Act also prohibits local governments that implement an alternative
transportation system from denying, timing, or phasing a development approval in order to
mitigate adverse traffic impacts if the developer agrees to pay for "the development's identified
transportation impacts via the funding mechanism implemented by the local government" (e.g.,
by paying the adopted mobility fee); and
WHEREAS, the City shares many of the policy goals underpinning the Act, including the
promotion of multimodal transportation and transit -oriented development; and
WHEREAS, the City desires the ability to require both physical and operational
improvements to better mitigate the impacts of development on traffic; and
WHEREAS, the Mayor and City Commission hereby request that the Florida Legislature
adopt targeted amendments to the Act to allow local governments greater authority to impose
reasonable conditions and mitigation requirements on development approvals, such as requiring
physical infrastructure improvements that are consistent with the adopted Transportation Master
Plan; requiring such improvements to be physically constructed, and not just funded; requiring
transportation demand management solutions (e.g., requiring developments to provide "last -mile"
connectivity to transit); and measuring impacts based on the total vehicle miles travelled a project
would cause, rather than based strictly on levels of service.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby amend
the City's State legislative priorities to request that the Florida Legislature amend applicable
provisions of the Community Planning Act, set forth in Chapter 163, Florida Statutes, to grant local
governments greater authority to review development applications for impacts on traffic and
transportation infrastructure and impose reasonable conditions and mitigation requirements.
