HomeMy WebLinkAboutResolution 2026-34276RESOLUTION NO. 2026-34276 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, REINTRODUCING A MORATORIUM ON THE ADOPTION OF ANY ORDINANCE TO INCREASE WATER, SEWER, AND STORMWATER RATES; SAID MORATORIUM TO REMAIN IN EFFECT UNTIL THE EARLIEST TO OCCUR OF THE FOLLOWING: (A) RESCISSION OF THIS RESOLUTION BY A FIVE - SEVENTHS (5/7THS) VOTE OF THE CITY COMMISSION, (B) THE OCCURRENCE OF A PUBLIC SAFETY EMERGENCY DUE TO THE FAILURE OF WATER, SEWER, OR STORMWATER INFRASTRUCTURE, OR (C) THE ISSUANCE OF AN ORDER BY AN AUTHORITY HAVING JURISDICTION REQUIRING THE CITY TO MAKE UNBUDGETED REPAIRS TO ITS WATER, SEWER, OR STORMWATER INFRASTRUCTURE. WHEREAS, the City Commission recognizes the importance of addressing the potential financial hardship caused by rate increases and is committed to exploring alternatives that could provide relief to residents; and WHEREAS, at its March 19, 2025 meeting, the Mayor and City Commission previously considered a moratorium on the adoption of ordinances to increase water, sewer and stormwater rates sponsored by this Resolution's sponsor; and WHEREAS, the City remains committed to maintaining safe, reliable, and resilient water, sewer, and stormwater systems while balancing affordability considerations for residents and ratepayers; and WHEREAS, the Mayor and City Commission find it in the best interest of the City to impose such a moratorium on the adoption of such ordinances to provide temporary rate stability and allow for further policy evaluation; and WHEREAS, it is the intent of the Mayor and City Commission to maintain the moratorium unless emergency conditions, regulatory obligations, or critical operational needs make such rate actions necessary; and WHEREAS, the moratorium should remain in effect unless and until rescinded by a 5/7th vote, to ensure consistency and predictability for residents and ratepayers. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby impose a moratorium on the adoption of any ordinance to increase water, sewer, or stormwater rates; said moratorium to remain in effect until the earliest to occur of the following: (a) rescission of this resolution by a five -sevenths (5/7ths) vote of the Mayor and City Commission; (b) the occurrence of a public safety emergency resulting from the failure of water, sewer, or stormwater infrastructure; or (c) the issuance of an order by an authority having jurisdiction requiring the City to undertake unbudgeted repairs to its water, sewer, or stormwater infrastructure.
