HomeMy WebLinkAboutResolution 2026-34280RESOLUTION NO, 2026-34280 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, DIRECTING THE CITY MANAGER TO ESTABLISH AND MAINTAIN A DEDICATED PARKING ENFORCEMENT DETAIL OPERATING ON A CONTINUOUS, TWENTY -FOUR -HOUR -A -DAY, SEVEN -DAY -A -WEEK BASIS WITHIN THE GEOGRAPHIC AREAS BOUNDED BY 1ST STREET TO THE SOUTH, 23RD STREET TO THE NORTH, THE ATLANTIC OCEAN TO THE EAST, AND BISCAYNE BAY TO THE WEST, AND 63RD STREET TO THE SOUTH, 87TH TERRACE TO THE NORTH, THE ATLANTIC OCEAN TO THE EAST, AND BISCAYNE BAY TO THE WEST, AS A TWELVE-MONTH PILOT PROGRAM COMMENCING NO LATER THAN JULY 1, 2026; REQUIRING MINIMUM STAFFING LEVELS DEDICATED TO LIFE SAFETY AND QUALITY -OF -LIFE PARKING VIOLATIONS IN EACH ZONE; DIRECTING THE CONFIGURATION OF AUTOMOTUS CAMERA TECHNOLOGY TO NOTIFY THE PARKING DEPARTMENT OF FREIGHT LOADING ZONE VIOLATIONS AND, UPON ISSUANCE OF A CITATION, TO NOTIFY THE TOWING COMPANIES; AND DIRECTING THE CITY MANAGER TO PROVIDE WEEKLY REPORTS TO THE CITY COMMISSION VIA LETTER TO COMMISSION (LTC). WHEREAS, the City of Miami Beach (the "City") is committed to protecting the public health, safety, and quality of life of its residents, visitors, and businesses; and WHEREAS, the geographic areas bounded by 1st Street to the south, 23rd Street to the north, the Atlantic Ocean to the east, and Biscayne Bay to the west ("Enforcement Zone 1 "), and 63rd Street to the south, 87th Terrace to the north, the Atlantic Ocean to the east, and Biscayne Bay to the west ("Enforcement Zone 2") (collectively, the "Enforcement Zones"), present significant and ongoing parking compliance challenges that affect residents, visitors, and the general quality of life in the City; and WHEREAS, among the most critical parking violations within the Enforcement Zones are those involving residential parking zones, freight loading zones, and commercial loading zones, each of which implicates life safety concerns and the quality of life of City residents; and WHEREAS, residential parking zones exist to ensure that residents, who pay for the privilege of parking, have adequate and reliable access to such parking; and illegal occupancy of such zones by non -permitted vehicles deprives residents of that access thereby adversely affecting their quality of life, and undermining the integrity of the residential parking program; and WHEREAS, illegal occupancy of freight and commercial loading zones by non- commercial and non -authorized vehicles creates significant disruptions to commerce, impedes the lawful use of such zones by commercial vehicles, and contributes to secondary traffic and safety hazards, including disrupting the flow of traffic, unsafe stopping, reducing mobility, and generating traffic congestion; and WHEREAS, because freight and commercial loading zone space in the City is limited, enforcement is critical to ensure that such zones are used as intended; and WHEREAS, in addition to residential parking zone violations, freight loading zone violations, and commercial loading zone violations, there exists within the Enforcement Zones a broad range of life safety and quality of life parking violations - including violations involving fire hydrants, fire lanes, handicapped parking, blocked access aisles, blocked crosswalks, blocked sidewalks, bus stops, bike lanes, valet ramps, obstructed driveways, obstructed dumpsters, obstructed traffic, scofflaw vehicles, safety zones, school loading zones, and abandoned vehicles - each of which poses a direct threat to public safety, impedes the free flow of traffic, or otherwise diminishes the quality of life of residents, visitors, and businesses within the Enforcement Zones; and WHEREAS, the City is preparing to deploy Automotus camera technology ("Automotus") at certain freight loading zones to detect unauthorized occupancy and alert the City of same in real time; and WHEREAS, the City Commission finds that Automotus should be configured to notify the Parking Department of freight loading zone violations and, upon issuance of a citation, to notify the towing companies to enable a coordinated and immediate enforcement response to reduce double parking, improve traffic flow, and alleviate traffic congestion; and WHEREAS, the City Commission finds that this technology should be configured so that the Parking Department is promptly notified upon detection of a freight loading zone violation, and that towing companies should be notified only after a citation has been issued, thereby enabling orderly and coordinated enforcement; and WHEREAS, the City Commission finds that implementing the dedicated parking enforcement detail as a twelve (12) month pilot program to commence operations no later than July 1, 2026, will allow the City to assess the effectiveness of the enhanced enforcement model, evaluate staffing and operational needs, and make informed decisions regarding the potential expansion of the program to other areas of the City; and WHEREAS, the City Commission finds that regular reporting on the status of the parking enforcement detail's activity will enable it to fulfill its oversight responsibilities and make informed policy decisions. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a dedicated, 2 continuous, twenty -four -hour -a -day, seven -day -a -week parking enforcement detail is hereby established within the geographic areas bounded by 1 st Street and 23rd Street, and 63rd Street and 87th Terrace, as a twelve-month pilot program commencing no later than July 1, 2026; that each shift shall include no fewer than two enforcement personnel dedicated to life -safety and quality -of -life parking violations within each zone; that Automotus camera technology shall notify the Parking Department upon detecting freight loading zone violations, and shall notify towing companies only after a citation is issued; and that the City Manager shall provide weekly status reports to the Mayor and City Commission via Letter to Commission.
