A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA APPROVING AND AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE A SOVEREIGNTY SUBMERGED LANDS FEE
WAIVED LEASE, BY AND BETWEEN THE CITY (LESSEE) AND THE BOARD
OF TRUSTEES OF THE INTERNAL IMPROVEMENT TRUST FUND OF THE
STATE OF FLORIDA (LESSOR), FOR A TERM OF FIVE (5) YEARS,
COMMENCING RETROACTIVELY ON SEPTEMBER 30, 2025 AND EXPIRING
ON SEPTEMBER 29, 2030, FOR THE USE OF SOVEREIGNTY SUBMERGED
LANDS CONTAINING APPROXIMATELY 4,647,175 SQUARE FEET, LOCATED
IN BISCAYNE BAY, IN MIAMI-DADE COUNTY, FLORIDA WITHIN SECTION 33,

DESCRIBED IN THE ATTACHMENT TO THE CITY COMMISSION
MEMORANDUM ACCOMPANYING THIS RESOLUTION, FOR THE MOORING
FIELD PROJECT.
WHEREAS, the City of Miami Beach has become a popular destination for local
anchorage and, as a result, Sunset Harbour, adjacent to Maurice Gibb Memorial Park, has
become a popular unregulated anchorage area, generally extending from Sunset Harbour south;
and
WHEREAS, the City recognizes that the increase in density of unregulated anchoring of
vessels in this area over time is unsustainable, and therefore, the City has elected to take a
proactive approach to managing this issue by taking the steps necessary to establish a managed
mooring field; and
WHEREAS, the mooring field project (the "Project") consists of a 130-slip mooring field
within 107.7 acres of Biscayne Bay between 5th Street and 18th Street; and
WHEREAS, the outside edge of the 100-foot-wide navigational access channel is 185 feet
from the shoreline; and
WHEREAS, the mooring field regulatory buoys are located on the inside edge of the 100-
foot-wide access channel and define the area for the Sovereignty Submerged Lands Fee Waived
Lease (the "Land Lease"); and
WHEREAS, on March 18, 2026, the Mayor and City Commission adopted Resolution No.
2026-34155, directing the indefinite suspension of the Project and for the City Administration to
finalize the permitting process and keep the mooring field permits active; and
WHEREAS, the Land Lease is a requirement to obtain the FDEP and DERM permits; and
WHEREAS, the Project is located on sovereignty lands owned by the State of Florida; and
WHEREAS, as a part of the Florida Department of Environmental Protection (FDEP) per-
mitting process, the FDEP is requesting the approval and execution of the Land Lease between
the City, as lessee, and the Board of Trustees of the Internal Improvement Trust Fund of the State
of Florida, as lessor, for a period of five (5) years; and
WHEREAS, the approved and executed Lands Lease is also part of the permitting process
for the County's Department of Environmental Resources Management (DERM); and
WHEREAS, pursuant to the Land Lease attached to the City Commission Memorandum
accompanying this Resolution, the City may lease and use sovereignty submerged lands contain-
ing approximately 4,647,175 square feet, more or less, located in a portion of the submerged
lands north of the MacArthur Causeway, located in Biscayne Bay, in Miami-Dade County, Florida
within Section 33, Township 53 South, Range 42 East, and Section 04, Township 54 South,
Range 42 East, between 5th Street (MacArthur Causeway) and 181h Street; and
WHEREAS, the City Manager recommends that the Mayor and City Commission approve
and authorize the Mayor and City Clerk to execute the Lands Lease, in the form attached to the
City Commission Memorandum accompanying this Resolution, for a period of five (5) years,
commencing retroactively as of September 30, 2025 and expiring on September 29, 2030.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission
hereby approve and authorize the Mayor and City Clerk to execute a Sovereignty Submerged
Lands Fee Waived Lease, by and between the City (lessee) and the Board of Trustees of the
Internal Improvement Trust Fund of the State of Florida (lessor), for a term of five (5) years,
commencing retroactively on September 30, 2025 and expiring on September 29, 2030, for the
use of sovereignty submerged lands containing approximately 4,647,175 square feet, located in
Biscayne Bay, in Miami-Dade County, Florida within Section 33, Township 53 South, Range 42
East, and Section 04, Township 54 South, Range 42, Between 5'h Street (Macarthur Causeway)
And 18th Street Miami Beach mainland, as more particularly described in the attachment to the
City Commission Memorandum accompanying this Resolution, for the mooring field project.

RECOMMENDATION
The Administration recommends that the Mayor and City Commission (City Commission) adopt
the Resolution.
BACKGROUND/HISTORY
The City of Miami Beach has become a popular destination for local anchorage. As a result,
Sunset Harbour, adjacent to Maurice Gibb Memorial Park has become a popular unregulated
anchorage area. The area generally extends from Sunset Harbour south. The City recognizes
that the increase in density of unregulated anchoring of vessels in this area over time is
unsustainable. The City has elected to take a proactive approach to managing this issue by taking
the steps necessary to establish a managed mooring field.
The Mooring Field project consists of a 130-slip mooring field within 107.7 acres of Biscayne Bay
between 5th Street and 18th Street. The outside edge of the 100-foot-wide navigational access

The Florida Department of Environmental Protection (FDEP) has granted the City to lease and
use a sovereignty submerged lands containing approximately 4,647,175 square feet, more or
less, located in a portion of the submerged lands North of the MacArthur Causeway, located in
Biscayne Bay, in Miami-Dade County, Florida, within Section 33, Township 53 South, Range 42
East, and Section 04, Township 54 South, Range 42 East, between 5 street (MacArthur
Causeway) and 18 street Miami Mainland, in accordance with the attached "Sovereignty
Submerged Lands Fee Waived Lease", attached hereto.

ANALYSIS
The Mooring Field project is located on submerged lands owned by the State of Florida. As a pa�t
of Florida Department of Environmental Protection`s (FDEP) permitting process, the FDEP is
requiring the approval and execution of a "Sovereignty Submerged Lands Fee Waived Lease,"
between the City (Lessee) and the Board of Trustees of the Internal Improvement Trust Fund of
the State of Florida (Lessor), for a period of five (5) years, commencing retroactively as of
September 30, 2025, and expiring on September 29, 2030.
The Leased Submerged Lands shall be used solely for the construction, operation and
maintenance of a public mooring field in accordance with the terms and conditions of the
"Sovereignty Submerged Lands Fee Waived Lease" Agreement.
The approved/signed Sovereignty Submerged Lands Lease Agreement is also part of the
permitting process for Department of Environmental Resources Management (DERM) in Miami-
Dade County.
On March 18, 2026 the Mayor and City Commission (City Commission) adopted Resolution
No. 2026-34155, directing the indefinite suspension of the City's Mooring Field Project and for
the City Administration to finalize the permitting process and keep the mooring field permits active.
The Submerged Land Lease is a requirement to obtain the FDEP and DERM permits.

3. MOORItiG FIELDS- SUBMlTT1NG ANNUAL CER�IlF1ED FWANCIAL RECORDS: Within 3(1 days after each
anniversary of the effective date of this lease,the Lessee shall submit annual certified financial records of income derived from
the mooring field and expenses incurred b} Lessee and the Harbonnaster for operation and maintenance of the mooring field to
the State of Florida Department of Environmental Protection, Division of State Lands, E3ureau of Public Land Adrninistration,
;90(? Commonwealth Eilvd, MS 130, Tallahassee. Ft. 3'_399. "Income" is detined in subsection 1 K-21.003(31), Florida
ldministrative Code. The submitted financial records shall be certitied b� a certitied public accountant.
4. EXAM1tiA"1'ION OF'LESSEE'S RECORDS: The I.essor is hereby specifically authorized and empowered to examine,
for the term of this lease including any rene�t�als, plus three (3) additional years, at all reasonable hours, the books, records,
contracts,and other documents confirming and pertaining to the computation of annual lease pa`ments as specified in paragraph
t���o('1 above.
>. MAlNi'ENANCE OF L,ESSEE'S RECORDS: The Lessee shall maintain separate accounting records for. (i) gross
re��enue derived directly from the use of the leased premises,(ii)the gross revenue derived indirectly from the use of the leased
premises,and(iii)all other gross revenue derived from the Lessee's operations on the riparian up�and property. The Lessee shall
secure,maintain and keep all records for the term of this lease and am renewals plus three(3)additional years. This period shall
be extendcd for an additional two (2j }ears upon reyuest for cxaminatiun of all records and accounts for lease veritication
�urposes b}°the Lessor.
h_ PROPERTY RIGH"rS: 'Che Lessee shall make nu claim of title or interest to said lands hereinbefore described by
rta><�n c�f the occupanc} or use thereof,and all titic and interest to said land hereinbefore described is vested in the Lessor. The
Lessee is prahibited from including,or making an� claim that purports to includc,said lands described or the Lessee's leasehofd
interest in said lands into an�� form of private ow�nership, including but not limited to any ti�rm of condominium or cooperative
ownership. The Lessee is further prohibited from making am claim, including any advertisement, that said land, or the use
there��f, may be purchased,sold,or re-sold.
. ASSIG'vMENT OF LE.ASE: This lease shall not be assigned or otherwise transferred without prior written consent of
the L�c�sor or its duly authorized agent. Such assigmnent or other transfer shatl be subject to the terms,conditions and provisions
uf management standards and applicable laws, rules and r�gulations in effect at that time. Anv assignment or other transfer
��ithout prior written consent of the Lessor shall be null and void and w�ithout legal effect.

e�pense. Each party is responsible for all personal injur} and property damage attributable to the negligent acts or omissions of

1?. MAINTENANCE OF FACILITY!RIGHT TO lNSPECT• The Lessee shall rnaintain tl�e leased prenaises in good
�ondition,keeping the structures and equipn�ent located thereon ir� a good state of repair in the interests of put�lic health, safeC��
��nd w•elfare. No doek or pier shall be constructed it�an} manner that��ould cause harn� to wildiife. The leased premises shall
hc ;ubject to inspection b� the Lessor or its designated agent at any reasonable time.
13. NON-nfSCR(MINATION: The Lessee shall not discriminate against any individuai because of�that individual's race,
cul��r. reiigian,sex, national ori�in,age,handicap,or marital status���ith respect to an� activit} occu►rin����ithin the area subject
t<,thi� lease or upon lands adjacent to and used as an adjunct of the leased area.
I�. ENFORCEti1ENT OF PROVISIONS: No failur�, or successi��e failures, on the part of the Lessor to enforce any
pro�ision,nor any waiver or successive waivers on its part of any provision herein,shall operate as a discharge thereof or render
tl�e same inoperative or impair the right of the Lessor to enforce the same upon an} renewal thercof or in the event of subsequent
brrach or breaches.
1�. PERMlSSION GRANTEU: lipon e�piration or cancellation of this lease all permission �ranted hereunder shall cease
and tenninate.
I6. RENEW.AL PROV(SlON5: Renewal ofthis lease shaii be at the soie option ofthe Lessor. Such renewal shail be subject
tci the terms, conditions and provisions of nlanagement standards and applicable lau s, rules and regulations in effect at that time.
!n the event that the Lessee is in full compliance���ith the terms ofthis lease,the Lessor wil) begin the renewal pr�ess. The term

equipment occupying and erected upon the leased premises after expiration or cancellation of this lease, such structures and
equipment ��il( bc deemed forfeited to the Lessor, and the I.essor mati authorize removal and may sell such forfeited structures
and equipment after ten(10)days written notice by certified mail addressed to the Lessee at the address specitied in Paragraph
y or at such address on record as provided to the Lessor by the Lessee. However, such remedy shall be in addition to all other
remedies available to the Lessor under applicable laws, rules and regulations incfuding the rieht to compel removal of all
structures and the right to impose administrative fines.
1�. REMOVAL COSTS: Subject to the noticing provisions of Paragraph 17 of this lease,any costs incurred by the Lessor
in rema�al of any structures and equipment constructed or maintained on state lands shali be paid by Lessee.
I�>. RIPARIAti RIGHTS;FINAL ADJUDICATION: In the event that an� part of any structure authorized hereunder is
determined by a f nal a�judication issued by a court of competent jurisdiction to encroach on or interfere with adjacent riparian
rights, Lessee agrees to either obtain written consent for the offending structure from the affected riparian owner or to remove
the interference or encroachment within 60 days from the date of the adjudication. Failure to comply with this paragraph shall
constitute a material breach of this lease agreement and shall be grounds for immediate terniination of this lease agreement at
thc��ption of the Lessor.
