A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, APPROVING, IN SUBSTANTIAL FORM,
AMENDMENT NO. 4 TO THE CONSTRUCTION MANAGER -AT -RISK
AGREEMENT, DATED APRIL 30, 2020, BY AND BETWEEN THE CITY AND
KAUFMAN LYNN CONSTRUCTION, INC. FOR THE NEW FIRE STATION NO.
1 FACILITY (THE "FIRE STATION"); SAID AMENDMENT FOR A GRAND
TOTAL NOT -TO -EXCEED AMOUNT OF $3,100,273.62, UTILIZING
PREVIOUSLY APPROPRIATED FUNDS, INCLUDING (1) ADDITIONAL
PRECONSTRUCTION SERVICES FOR THE FIRE STATION AND THE
TEMPORARY FACILITIES FOR THE RAINBOW INTERGENERATIONAL
LEARNING CENTER (THE "DAYCARE FACILITY") AT FLAMINGO PARK, IN
THE AMOUNT OF $160,000, (11) AN ADDITIONAL GUARANTEED MAXIMUM
PRICE (GMP) IN THE AMOUNT OF $2,975,254, INCLUDING THE
CONSTRUCTION OF THE DAYCARE FACILITY IN THE AMOUNT OF
$2,830,394, AND AN ALLOWANCE FOR ADDING A FOOD PREPARATION
AREA AT THE FLAMINGO PARK LODGE, TO ACCOMMODATE THE SENIOR
CONGREGATE MEAL SITE, IN THE AMOUNT OF $144,860, (III) A CITY
CONTINGENCY IN THE AMOUNT OF $141,520, WHICH IS FIVE PERCENT
(5%) OF THE CONSTRUCTION COST OF THE DAYCARE FACILITY, AND (IV)
A CREDIT OF $176,500.38 FOR UNUSED FUNDS; AUTHORIZING THE CITY
MANAGER TO FINALIZE AMENDMENT NO. 4; AND FURTHER,
AUTHORIZING THE CITY MANAGER AND CITY CLERK TO EXECUTE THE
FINAL AMENDMENT NO. 4.
WHEREAS, on January 15, 2020, pursuant to Request for Qualifications (RFQ) No. 2019-
370-ND, the Mayor and City Commission adopted Resolution No. 2020-31112, approving and
authorizing the Mayor and City Clerk to execute the Agreement with Kaufman Lynn Constructions,
Inc. (the "Construction Manager"), as Construction Manager -at -Risk, for the construction of the
new Fire Station No. 1 facility (the "Fire Station"), to be located at the South Shore Community
Center ("SSCC"), 833 61" Street, in the Flamingo Park Neighborhood; and
WHEREAS, the Agreement initially authorized payment in the amount of $80,000.00 for
Pre -Construction Phase services only, with a future amendment to establish the final negotiated
Guaranteed Maximum Price ("GMP") for the Construction Phase of the project, subject to prior
approval by the Mayor and City Commission; and
WHEREAS, the proposed 29,369 square feet facility for the Fire Station includes four
drive-thru apparatus bays, living spaces, offices, a kitchen, a gym, support facilities, and 34
parking spaces; and
WHEREAS, on March 27, 2023, the City Commission adopted Resolution No. 2023-
32519, approving Amendment No. 1 to the Agreement to include the manufacture and installation
of a temporary modular structure, to be located in Flamingo Park, for use by the Rainbow
Intergenerational Learning Center (the "Daycare"), relocation of the Daycare to the temporary
modular structure, and the structural and electrical infrastructure to support the Apollo Mural's
installation on the facade of the Fire Station, in the total amount of $395,000.00; and
WHEREAS, on July 31, 2023, Notice to Proceed ("NTP") No. 1 A was issued to
Construction Manager for the preparation and submittal of engineered shop drawings for the
prefabricated modular buildings necessary for the temporary relocation of the Daycare to 1245
Michigan Avenue in Flamingo Park; and
WHEREAS, on September 13, 2023, the City Commission adopted Resolution No. 2023-
32775, approving Amendment No. 2 to the Agreement to memorialize the GMP for the
construction of the Fire Station, the temporary Daycare facility, and the infrastructure for the future
installation of the Apollo Mural, in the amount of $24,991,845.00; and
WHEREAS, on January 19, 2024, NTP No. 1 B was issued to authorize the release of
fabrication for modular buildings for the Daycare, the release of subcontractor engineering and
shop drawings for the Fire Station and the Daycare, and the early procurement of long -lead
construction materials for both the Daycare and the Fire Station; and
WHEREAS, subsequently, the Construction Manager provided the required
Performance and Payment Bonds, General Liability insurance and Builder's Risk insurance as
required by the Agreement, and initiated the released scope of work; and
WHEREAS, the engineered shop drawings for the prefabricated modular buildings
were submitted to the State of Florida for review and authorization to manufacture, including
the railings, stairs, and roof canopy required at the entrances, and were approved; and
WHEREAS, while NTP No. 1 B did not authorize the Construction Manager to perform
any on -site construction activities, the Construction Manager initiated the early purchase of long
lead materials, including the playground for the Daycare and electrical service items for the Fire
Station, and coordinated with FPL and ATT for the relocation of utilities at the SSCC and at
Flamingo Park, as required for the Daycare; and
WHEREAS, on January 31, 2024, the Mayor and City Commission adopted Resolution
No. 2024-32903, directing the Administration to pursue two parallel paths for the Fire Station due
to ongoing evaluation of potential project sites: (1) continue to execute the project at the SSCC
site, and (2) continue to explore alternative sites for the project; and
WHEREAS, on February 21, 2024, the Mayor and City Commission adopted Resolution
No. 2024-32927, item C7 W, directing the Administration to study the possible relocation of the
new Fire Station project to a City -owned site located at the western boundary of Flamingo Park
at Alton Road between 11th and 12th Streets (the "Flamingo Park Site"); and
WHEREAS, on March 13, 2024, the Mayor and City Commission heard item C7 T, which
proposed suspension of all project expenditures until the City Commission's receipt and
evaluation of recommendations on the options and viability of other suitable locations for the Fire
Station; and
WHEREAS, in March 2024, the City notified the Construction Manager of the
suspension of all expenditures pending direction from the City Commission regarding the
location of the Fire Station; and
WHEREAS, at that time, a subcontract was in place for the design/engineering and
manufacture of the modular buildings for the Daycare, the state permit for its manufacture had
been approved, and the final shop drawings were being coordinated with the Miami Beach
Building Department; and
WHEREAS, the Construction Manager assisted the City with the analysis to relocate
the Fire Station to the Flamingo Park Site, including development of project scope, estimates
of construction cost and constructability, and feasibility analysis; and
WHEREAS, on May 21, 2024, the Miami -Dade County Board of County Commissioners
adopted Resolution No. R-457-24, approving the inclusion of a County -wide referendum on the
Primary Election ballot regarding construction of the Fire Station at the Flamingo Park Site; and
WHEREAS, on June 26, 2024, the Mayor and City Commission adopted Resolution No.
2024-33157, directing the Administration to proceed with the relocation of the project from the
SSCC to the Flamingo Park Site, following (i) approval of the County -wide referendum by a
majority of Miami -Dade County voters, and (ii) approval of construction of the Fire Station at
the Flamingo Park Site by a majority of the City of Miami Beach voters participating in the
referendum; and
WHEREAS, the county -wide referendum was held on August 20, 2024, and an
overwhelming majority of Miami -Dade County voters voted in favor of the measure, with 75.71 %
voting in favor of, and 24.29% opposed to, placing the Fire Station at the Flamingo Park Site;
and
WHEREAS, additionally, the results for Miami Beach precincts indicated strong support
from City residents, with every Miami Beach precinct voting in favor of the new location; and
WHEREAS, pursuant to Amendment No. 2, before the project was relocated to the
Flamingo Park Site, the City paid the Construction Manager the amount of $164,103.00 for
preconstruction services and $1,038,360.76 from the GMP towards construction of the Fire
Station and the Daycare; and
WHEREAS, on December 11, 2024, the Mayor and City Commission adopted
Resolution No. 2024-33412, approving Amendment No. 3 to the Agreement to provide
additional preconstruction services required to relocate the Fire Station to the Flamingo Park
Site, to rescind the unused remaining balance of the previously approved GMP, resulting in a
credit in the amount of $24,069,880.86, a remaining contract amount of $194,500.38, and a
total contract amount of $1,396,964.14; and
WHEREAS, on February 2, 2025, a design kickoff meeting was conducted between the
City of Miami Beach Fire Department, Wannemacher Jensen Architects, LLC ("WJA"), and City
staff to discuss programming requirements; and
WHEREAS, after several conceptual design workshops, WJA provided the final
conceptual design on May 23, 2025; and
WHEREAS, cost estimates were received by WJA on June 13, 2025, and by the
Construction Manager on June 26, 2025; and
WHEREAS, cost estimates aligned with the previously established construction budget,
but funding for the 911 Call Center would still be required; and
WHEREAS, on July 23, 2025, the Mayor and City Commission discussed three agenda
items related to the Fire Station, reflecting renewed consideration of alternative locations for
the facility: C7 AF - Save Flamingo Park, sponsored by Commissioner Suarez, C7 AG - Action
Plan to Utilize Existing Location for Fire Station 1, sponsored by Commissioner Rosen
Gonzalez and co -sponsored by Commissioner Magazine, and C7 AL - Consider Repurposing
Flamingo Park Parking Lots into Green Space, sponsored by Commissioner Bhatt; and
WHEREAS, after a discussion about the project, the Mayor and City Commission
adopted After -the -Fact Resolution No. 2025-33839, directing staff to study alternate sites; and
WHEREAS, on December 17, 2025, the Mayor and City Commission discussed several
potential locations identified for the Fire Station and adopted Resolution No. 2025-34057, from
item R7 AE sponsored by Commissioner Suarez and co -sponsored by Commissioner Magazine
and Mayor Meiner, directing the Administration to take all steps necessary to proceed with the
construction of the Fire Station at the original SSCC site; and
WHEREAS, following the City Commission direction to relocate the Fire Station to the
SSCC site, City staff has been working with the Construction Manager to re-engage the project
team and the necessary subcontractors to resume work for the Fire Station, now back at the
SSCC site, and the corresponding Daycare relocation; and
WHEREAS, the design of the Daycare places the proposed modular structure and the
associated playground to the north of the existing playground, to the west of the existing Lodge
building, and nestled at the south end of the Butterfly Garden area proposed as a part of the
Flamingo Park Master Plan; and
WHEREAS, the Construction Manager submitted a proposal in the amount of $160,000.00
for preconstruction services for both the Fire Station and the Daycare to complete review of the
approved permit drawings, bidding of both GMPs, and coordination of project schedules; and
WHEREAS, the Construction Manager submitted a negotiated GMP proposal for the
construction of the modular Daycare facility at the Flamingo Park Site in the amount of
$2,830,394.00; and
WHEREAS, the GMP proposal submitted by the Construction Manager in April 2026 for
the Daycare is the result of competitive bids from subcontractors and vendors, current market
conditions, including local inflationary trends and projected material and labor cost escalation for
the duration of the construction of the Daycare facility, and approved permit drawings
incorporating design changes required by the Miami -Dade County Department of Environmental
Resources Management and the City of Miami Beach Building Department; and
WHEREAS, the design changes include the addition of drainage swales, increased size
of the water and sanitary service lines, fire sprinkler coverage under the entry canopy, and
additional security enhancements, such as a fire truck access area and the infrastructure for
exterior security cameras for use by the City of Miami Beach Police Department; and
WHEREAS, the City retained the services of Program Controls, LLC (successor in interest
to Program Controls, Inc.) ("PCI") to provide an independent cost estimate for the construction of
the Daycare facility, and PCI provided a Class 1 estimate, which was higher than the Construction
Manager's proposed cost, demonstrating that the revised GMP proposal is fair and reasonable;
and
WHEREAS, the Administration is considering utilizing the Flamingo Park Lodge to serve
as the new Senior Congregate Meal ("Senior Meals") site due to the planned demotion of the
SSCC, the current Senior Meals site, which will require modifications to accommodate food -
service operations such as the addition of a kitchen area with new walls, stainless steel counters
and cabinets, flooring, electrical upgrades, and plumbing adaptations, including a grease
interceptor; and
WHEREAS, because the Senior Meals site is adjacent to the new Daycare facility, the
City determined it is in the City's best interest to complete both projects concurrently, and received
an estimated cost of $144,860.00 for the construction of the new Senior Meals site, to be included
as an allowance in the revised GMP; and
WHEREAS, this Amendment shall include the following, for a grand total amount not to
exceed $3,100,273.62: (i) preconstruction services for the Fire Station and the Daycare, in the
amount of $160,000.00, (ii) the GMP for construction of the Daycare facility, in the amount of
$2,830,394.00, (iii) a five percent (5%) city contingency (the "City Contingency") in the amount of
$141,520.00, to be held by the City, (iv) an addition to the GMP for an allowance for the Senior
Meals site, in the amount of $144,860.00, and (v) a credit of $176,500.38 for unused funds under
Amendment No. 3; and
WHEREAS, subsequent to a future amendment that will establish the final GMP for the
Fire Station and will include a time extension to the Agreement, and following the vacation of the
SSCC, the Construction Manager will commence construction activities for the Fire Station; and
WHEREAS, the Construction Manager has expended $1,220,463.76 to date pursuant to
this Agreement; and
WHEREAS, with the execution of this Amendment No. 4, the cumulative GMP authorized
to date under the Agreement totals $4,013,614.76, with a total contract value of $4,325,717.76;
and
WHEREAS, City staff has reviewed the negotiated proposal for the additional
preconstruction services and found it reasonable for the effort required by the CMR; and
WHEREAS, City staff has reviewed the GMP proposal and found it fair and reasonable
for the construction of the Daycare Facility and the addition of food preparation area at the
Flamingo Park Lodge.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby approve, in substantial form, Amendment No. 4 to the Construction Manager -
at -Risk Agreement, dated April 30, 2020, by and between the City and Kaufman Lynn
Construction, Inc. for the new Fire Station No. 1 facility (the "Fire Station"); said amendment for a
grand total not -to -exceed amount of $3,100,273.62, utilizing previously appropriated funds,
including (i) additional preconstruction services for the Fire Station and the temporary facilities for
the Rainbow Intergenerational Learning Center (the "Daycare Facility") at Flamingo Park, in the
amount of $160,000, (ii) an additional Guaranteed Maximum Price (GMP) in the amount of
$2,975,254, including the construction of the Daycare Facility in the amount of $2,830,394, and
an allowance for adding a food preparation area at the Flamingo Park Lodge, to accommodate
the Senior Congregate Meal site, in the amount of $144,860, (iii) a City contingency in the amount
of $141,520, which is five percent (5%) of the construction cost of the Daycare Facility, and (iv) a
credit of $176,500.38 for unused funds; authorize the City Manager to finalize Amendment No. 4;
and further, authorize the City Manager and City Clerk to execute the final Amendment No. 4.

RECOMMENDATION
The Administration recommends that the Mayor and City Commission (City Commission) adopt
the Resolution.
BACKGROUND/HISTORY
The existing Fire Station 1, located at 1051 Jefferson Avenue, was built in 1967 and serves the
areas south of 15 Street including Star Island, Hibiscus Island, Palm Island, MacArthur Causeway
up to Watson Island and Terminal Island.
A project for the design and construction of a new Fire Station 1 (Project) facility received funding
under the 2018 General Obligation Bond, which initiated the design process. The proposed facility
was to be designed as a critical facility complying with the required FEMA flood elevation, to meet
the requirements of the current National Fire Protection Association (NFPA) standards, to
withstand a Category 5 hurricane and other natural disasters, as well as security threats/risks,
while addressing current operational needs of the Fire Department.
On January 15, 2020, pursuant to Request for Qualifications (RFQ) No. 2019-370-ND, the City
Commission adopted Resolution No. 2020-31112 approving and authorizing the Mayor and City
Clerk to execute an agreement (Agreement) with Kaufman Lynn Construction, Inc. (Kaufman
Lynn) as Construction Manager at Risk (CMR), for the Project. The Agreement included pre-

construction services for the new Fire Station No. 1 facility (Fire Station), to be located at the
South Shore Community Center (SSCC), 833 6th Street, in the Flamingo Park Neighborhood
Upon successful negotiations with the Administration, the Agreement was executed in the amount
of $80,000. Notice to Proceed (NTP) No 1 was issued to Kaufman Lynn on May 26, 2020, for
preconstruction services for the Project.
The South Shore Community Center, the selected site for the Project. houses The Rainbow
Intergenerational Learning Center (Daycare Facility) and serves as a Senior Congregate Meal
Site. Both services to the community will need to be relocated.
On March 27, 2023, the City Commission adopted Resolution No. 2023-32519, authorizing the
Mayor and City Clerk to execute Amendment No. 1 to the agreement with Kaufman Lynn for
preconstruction services to include the manufacture and installation of a temporary modular
structure for use by the Daycare Facility, relocation of the Daycare Facility to the temporary
location in Flamingo Park and the structural and electrical infrastructure to support the Apollo
Mural's installation on the facade of the Fire Station in the total amount of $395.000.
On September 13. 2023, the City Commission adopted Resolution No. 2023-32775, authorizing
the Mayor and City Clerk to execute Amendment No. 2 to the Agreement with Kaufman Lynn, for
the Guaranteed Maximum Price (GMP) for the construction of the Fire Station, the temporary
Daycare Facility and the infrastructure for the future installation of the Apollo Mural in the amount
of $24,991,845. Subject to approval of the required permits, and the relocation of the Daycare
Facility from the SSCC. Construction was scheduled to commence. and Substantial Completion
was anticipated in November 2025.
On February 21, 2024 the City Commission adopted Resolution No. 2024-32927, item C7 W,
directing the City Administration to study the possible relocation of the Project to a City -owned
site located at the western boundary of Flamingo Park at Alton Road between 11th and 12th
Streets (Flamingo Park Site) and to determine the requirements for a countywide voter
referendum pursuant to Article 7 of the Miami -Dade County Charter in August 2024, should the
City Commission wish to relocate the Fire Station 1 to the Flamingo Park Site.
On March 13, 2024, the City Commission heard item C7 T which proposed suspension of any
expenditures towards the Fire Station project, until the City Commission receives and evaluates
recommendations on the options and viability of other suitable locations for the Fire Station.
During the discussions. the Commission authorized $60.000 to be spent on additional
professional and CMR services, for the evaluation of alternate sites
Kaufman Lynn assisted the City with the analysis to relocate the Fire Station to the Flamingo Park
Site, including development of project scope, estimates of construction cost and constructability,
and feasibility analysis. These services were provided at a cost of $14,103.
On June 26, 2024, the City Commission adopted Resolution No. 2024-33157, directing the
Administration to proceed with the relocation of the Project from the South Shore Community
Center to the Flamingo Park site provided that referendum is approved by a majority of Miami -
Dade County voters voting in the County -wide referendum and construction of Fire Station 1 at
the Flamingo Park site is approved by a majority of the City of Miami Beach voters in the
aggregate voting thereon in the referendum.
On October 30, 2024, a schematic layout of the Fire Station 1 at Flamingo Park was presented to
the City Commission indicating that the design used at the SSCC site would not fit in Flamingo
Park, west of the track, without impacting the track and field. A redesign of the facility would be
required to accommodate the facility at this location. Dunng the meeting, the City Commission
adopted Resolution No. 2024-33345.. directing that the construction of the Project at the Flamingo
Park site shall not result in the relocation of any portion of the running track and field. or extended

interruption of its use.
On December 11, 2024, the City Commission adopted Resolution 2024-33412 approving
Amendment No. 3 to the agreement with Kaufman Lynn to provide additional preconstruction
services required to relocate the Fire Station to the Flamingo Park Site and to rescind the unused
remaining balance of the previously approved GMP, resulting in a credit in the amount of
($24,069,881), a remaining contract amount of $194,500.38, and a total contract amount of
$1, 396, 964.14.
On December 17, 2025, the City Commission adopted Resolution No. 2025-34057, from item R7
AE sponsored by Commissioner Suarez and co -sponsored by Commissioner Magazine and
Mayor Meiner, directing the Administration to take all steps necessary to proceed with the
construction of the new Fire Station No.1 at the South Shore Community Center site, located at
833 6th St.
On March 18, 2026, City Commission adopted Resolution No. 2026-34185 approving the
Certificate of Appropriateness for the total demolition of the existing two-story building located at
833 61" St, the South Shore Community Center, a city -owned property within the Flamingo Park
Local Historic District, to allow for the construction of Fire Station No. 1 on the subject site.
ANALYSIS
Following the City Commission direction to relocate the Fire Station to the SSCC site, City staff
has been working with Kaufman Lynn to re-engage the project team and the necessary
subcontractors to resume work for the Fire Station and the corresponding relocation of the
Daycare Facility to Flamingo Park.
The design of the Daycare Facility places the proposed modular structure and the associated
playground to the north of the existing playground, to the west of the existing Lodge building, and
nestled at the south end of the Butterfly Garden area proposed as a part of the Flamingo Park
Master Plan. The design was given full approval at the June 13, 2023 Historic Preservation Board
meeting.
The Daycare Facility (Exhibit A), constructed of pre -fabricated modular structures, will comprise
approximately 3,500 square feet of classroom, office, storage and staff areas. Additionally,
approximately 1,407 square feet of a dedicated outdoor playground will have direct access from
the Daycare Facility. Parent drop-off and pick-up will be available from Michigan Avenue.
On March 26, 2026, Kaufman Lynn submitted a proposal in the amount of $160,000 for
preconstruction services for both the Fire Station and the Daycare Facility, to review the approved
permit drawings, bidding of both GMPs, and coordination of project schedules.
On April 10, 2026, City staff received a negotiated GMP proposal for the construction of the
modular Daycare Facility in Flamingo Park in the amount of $2,830,394, including the
corresponding Qualifications and Assumptions, General Conditions, Schedule, and Drawing Log.
A tabulated summary of the final GMP amount is included as an exhibit to the Amendment.
The GMP proposal submitted by Kaufman Lynn in April 2026, nearly three years after the original
GMP, reflects an increase in construction cost and is the result of bids from subcontractors and
vendors based on current market prices and approved permit drawings inclusive of required
design changes as prompted by the Miami -Dade County Department of Environmental Resources
Management (DERM) and the City of Miami Beach Building Department. The design changes
include the addition of drainage swales, increased size of the water and sanitary service lines,
fire sprinkler coverage under the entry canopy, and additional security enhancements, such as a

fire truck access area and the infrastructure for exterior security cameras for use by the City of
Miami Beach Police Department.
The GMP proposal submitted by Kaufman Lynn is the result of competitive bids from sub-
contractors and vendors. Kaufman Lynn cites local trends in inflation, projected cost escalation,
changes in the design required by DERM, and structural and site design requirements specific to
the locality, as triggers for observed increase in construction cost. The GMP proposal also
assumes the risk of escalation in material or labor costs for the duration of the construction of the
Daycare Facility.
To comply with Resolution No. 2021-31738, the City retained the services of Program Controls,
Inc (PCI) to provide an independent cost estimate for the Daycare Facility. PCI provided a Class
1 estimate, which was higher than Kaufman Lynn's proposed cost, demonstrating that the GMP
proposal is fair and reasonable.
The City Administration is preparing the Flamingo Park Lodge to serve as the Senior Congregate
Meal Site, currently housed at the SSCC. This would require modification to the existing space
for the addition of a kitchen area with new walls, stainless steel counters and cabinets, flooring,
electrical upgrades, and plumbing adaptations, including a grease interceptor.
The City Administration proposes that Kaufman Lynn performs the work for the Flamingo Park
Lodge food preparation area given that the work is necessary to accommodate the seniors
because the SSCC is planned to be demolished. Additionally, the project is adjacent to the new
Daycare Facility, so it is in the City's best interest in order to ensure both projects are completed
simultaneously to allow for construction of the new Fire Station 1. By including these necessary
scopes within the responsibilities of the CMR, Kaufman Lynn will thereby be responsible for
schedule management, coordination and completion of all program elements.
On June 5, 2026, at the request of City staff, Kaufman Lynn provided an estimated cost for the
modification of the lodge, to include the installation of the necessary food prep area, in the amount
of $144,860, to be included as an allowance in Kaufman Lynn's GMP. The City is in the process
of securing a consultant to provide permit drawings for the food prep area. Construction of the
Daycare Facility and the Flamingo Park Lodge modification are intended to proceed while the
CMR is preparing the GMP for the Fire Station and before demolition of the SSCC.
This Amendment No. 4 (Exhibit B) shall include preconstruction services for Fire Station 1 and
the Daycare Facility for a total amount of $160,000, the GMP for the construction of the Daycare
Facility in the amount of $2,830,394, plus a 5% Owner's Contingency in the amount of $141,520,
and an allowance for the food preparation area at the Flamingo Park Lodge in the amount of
$144,860. Additionally, this amendment includes a credit of $176,500.38 for unused funds under
Amendment No. 3, resulting from completing approximately 30% of the contracted
preconstruction services for the relocation of the Fire Station to the Flamingo Park site.
Accordingly, this Amendment No. 4 shall be for a grand total not -to -exceed amount of
$3,100,273.62.
Kaufman Lynn has provided, as part of the GMP proposal, a schedule for the duration of the
construction phase for the work associated with the Daycare facility, considering input from
subcontractors and vendors. Notice to Proceed for the construction phase is anticipated to be
issued in June 2026, following adoption of the GMP by the City Commission. The Daycare Facility
is expected to be completed and available for occupancy in January 2027. Subsequent to a future
GMP Amendment for the construction of Fire Station 1, which will include a time extension to the
CMR Agreement, and following the vacation of the SSCC, the contractor will commence
construction activities at the proposed Fire Station site.
Considering the independent cost estimate, the changes in scope, and the cost escalation since

2023, the Administration finds that the final GMP is fair and reasonable for the construction of the
Daycare Facility and the Flamingo Park Lodge food preparation area.
FISCAL IMPACT STATEMENT
The total amount of Amendment No. 4 includes preconstruction services in the amount of
$160,000, the Daycare Facility GMP for a total of $2,830,394, plus a 5% Owner's Contingency in
the amount of $141,520, an allowance for the addition of food preparation area the Flamingo Park
Lodge in the amount of $144,860, and a credit of $176,500.38 for unused funds, for a grand total
not -to -exceed amount of $3,100,273.62 using previously appropriated funds.

THIS Amendment No. 4 to the Agreement is made and entered this day of
, 2026, by and between the CITY OF MIAMI BEACH, a municipal corporation
existing under the laws of the State of Florida (the "City"), having its principal offices at
1700 Convention Center Drive, Miami Beach, Florida 33139, and KAUFMAN LYNN
CONSTRUCTION, INC., a Florida Corporation having its principal office at 3185 South
Congress Avenue, Delray Beach, Florida 33445 (the "Contractor').
RECITALS
WHEREAS, on January 15, 2020, pursuant to Request for Qualifications (RFQ) No. 2019-
370-ND, the Mayor and City Commission (City Commission) adopted Resolution No. 2020-31112
approving and authorizing the Mayor and City Clerk to execute an agreement with Kaufman Lynn
Construction, Inc. (Kaufman Lynn) as Construction Manager at Risk (CMR), for the construction
of the new Fire Station No. 1 Facility (Fire Station), to be located at the South Shore Community
Center (SSCC), 833 6"' Street, in the Flamingo Park Neighborhood in the amount of $80,000 for
Pre -Construction Phase services only with a future Amendment for the final negotiated
Guaranteed Maximum Price (GMP) for the construction phase of the project subject to prior
approval of the Mayor and City Commission ; and
WHEREAS, the new 29,369 square feet facility for the Fire Station will provide four drive-
thru apparatus bays, living spaces, offices, a kitchen, a gym, support facilities and 34 parking
spaces; and
WHEREAS, on March 27, 2023, the City Commission adopted Resolution No. 2023-
32519, approving Amendment No. 1 to the agreement with Kaufman Lynn for preconstruction
services to include the manufacture and installation of a temporary modular structure for use by
the Rainbow Intergenerational Learning Center (Daycare Facility), relocation of the childcare
services to the temporary location in Flamingo Park and the structural and electrical infrastructure
to support the Apollo Mural's installation on the facade of the Fire Station in the total amount of
$395,000-1 and
WHEREAS, on July 31, 2023, NTP No. 1A was issued to Kaufmann Lynn for the
preparation and submittal of engineered shop drawings for the prefabricated modular buildings
necessary for the temporary relocation of the Daycare to 1245 Michigan Avenue, in Flamingo
Park; and

WHEREAS, on September 13, 2023, the City Commission adopted Resolution No. 2023-
32775, approving Amendment No. 2 to the Agreement with Kaufman Lynn, for the Guaranteed
Maximum Price (GMP) for the construction of the Fire Station, the temporary Daycare Facility and
the infrastructure for the future installation of the Apollo Mural in the amount of $24,991,845; and
WHEREAS, on January 19, 2024, NTP No. 1 B was issued to authorize the release of
fabrication for modular buildings for the Daycare, the release of subcontractor engineering and
shop drawings for the Fire Station and the Daycare, and the early procurement of long -lead
construction materials for both the Daycare and the Fire Station, subsequently, Kaufman Lynn
provided the required Performance and Payment Bonds, General Liability and Builder's Risk
insurances as required by the contract and initiated the released scope of work; and
WHEREAS, the engineered shop drawings for the prefabricated modular buildings
were submitted to the State of Florida for review and authorization to manufacture, including
the railings, stairs, and roof canopy required at the entrances, and were approved; and
WHEREAS, NTP No, 1 B did not authorize Kaufman Lynn to perform any on -site
construction activities, Kaufman Lynn initiated the early purchase of long lead materials
including the playground for the Daycare Facility and electrical service items for the Fire Station
and coordinated with FPL and ATT for the relocation of utilities at the SSCC and at Flamingo
Park as required for the Daycare Facility; and
WHEREAS, on January 31, 2024, the City Commission adopted Resolution No. 2024-
32903, directing the Administration to pursue two parallel paths for the Fire Station: (1) continue
to execute the Project at the SSCC site and (2) continue to explore alternative sites for the Project;
and
WHEREAS, on February 21, 2024, the City Commission adopted Resolution No. 2024-
32927, item C7 W, directing the City Administration to study the possible relocation of the new
Fire Station project to a City -owned site located at the western boundary of Flamingo Park at
Alton Road between 11th and 12th Streets (Flamingo Park Site); and
WHEREAS, on March 13, 2024, the City Commission heard item C7 T which proposed
suspension of any expenditures towards the Fire Station project, until the City Commission
receives and evaluates recommendations on the options and viability of other suitable locations
for the Fire Station; and
WHEREAS, in March 2024, the City notified Kaufman Lynn of the suspension of all
expenditures pending direction from the City Commission regarding the location of the Fire
Station; at that time, a sub -contract was in place for the design/engineering and manufacture
of the modular buildings for the Daycare Facility, the state permit for its manufacture had been
approved, and the final shop drawings were being coordinated with the Miami Beach Building
Department; and
WHEREAS, Kaufman Lynn assisted the City with the analysis to relocate the Fire
Station to the Flamingo Park Site, including development of project scope, estimates of
construction cost and constructability, and feasibility analysis; and
WHEREAS, on May 21, 2024, the Miami -Dade County Board of County Commissioners
adopted Resolution No. R-457-24 approving the inclusion of a county -wide referendum in the
Primary Election regarding construction of Fire Station 1 at the western boundary of Flamingo
Park, on Alton Road, between 11 th and 12th Streets; and
WHEREAS, on June 26, 2024, the City Commission adopted Resolution No. 2024-
33157, directing the Administration to proceed with the relocation of the Project from the South

Shore Community Center to the Flamingo Park site provided that referendum is approved by a
majority of Miami- Dade County voters voting in the County -wide referendum and construction
of Fire Station 1 at the Flamingo Park site is approved by a majority of the City of Miami Beach
voters in the aggregate voting thereon in the referendum; and
WHEREAS, when the county -wide referendum was held on August 20, 2024, an
overwhelming majority of Miami -Dade County voters voted in favor of the measure, with 75.71 %
voting in favor and 24.29% opposed, placing the new Fire Station at the Flamingo Park site, the
results for Miami Beach precincts indicated strong support from City residents, with every Miami
Beach precinct voting in favor of the new location; and
WHEREAS, under Amendment No. 2, before the project was relocated to Flamingo Park,
the City paid Kaufman Lynn the amount of $164,103 for preconstruction services and
$1,038,360.76 from the GMP towards construction of the Fire Station and the Daycare Facility, -
and
WHEREAS, on December 11, 2024, the City Commission adopted Resolution 2024-
33412 approving Amendment No. 3 to the agreement with Kaufman Lynn to provide additional
preconstruction services required to relocate the Fire Station to the Flamingo Park Site and to
rescind the unused remaining balance of the previously approved GMP, resulting in a credit in
the amount of $24,069,881, a remaining contract amount of $194,500.38, and a total contract
amount of $1,396,964.14; and
WHEREAS, on February 2, 2025, a design kickoff meeting was conducted between the
Fire Department, WJA, and City staff to discuss programming requirements, after several
conceptual design workshops were held, WJA provided the final conceptual design on 'May 23,
2025. Cost estimates were received by WJA on June 13, 2025, and Kaufman Lynn on June 26,
2025, cost estimates aligned with the previously established construction budget, but funding
for the 911 Call Center would still be required; and
WHEREAS, on July 23, 2025, the City Commission discussed three agenda items
related to the Fire Station: C7 AF - Save Flamingo Park, sponsored by Commissioner Suarez;
C7 AG - Action Plan to Utilize Existing Location for Fire Station 1, sponsored by Commissioner
Rosen Gonzalez and co -sponsored by Commissioner Magazine; and C7 AL - Consider
Repurposing Flamingo Park Parking Lots into Green Space, sponsored by Commissioner
Bhatt. After a discussion about the Project, the City Commission adopted After -the -Fact
Resolution 2025-33839 directing staff to study alternate sites; and
WHEREAS, on December 17, 2025, the City Commission discussed several potential
locations identified for the Fire Station and adopted Resolution No. 2025-34057, from item R7 AE
sponsored by Commissioner Suarez and co -sponsored by Commissioner Magazine and Mayor
Meiner, directing the Administration to take all steps necessary to proceed with the construction
of the new Fire Station No.1 at the South Shore Community Center site, located at 833 6th St' -
and
WHEREAS, following the City Commission direction to relocate the Fire Station to the
SSCC site, City staff has been working with Kaufman Lynn to re-engage the project team and the
necessary subcontractors to resume work for the Fire Station 1 project and the corresponding
Daycare Relocation to Flamingo Park; and
WHEREAS, the design of the Daycare Facility places the proposed modular structure and
the associated playground to the north of the existing playground, to the west of the existing Lodge
building, and nestled at the south end of the Butterfly Garden area proposed as a part of the
Flamingo Park Master Plan; and

WHEREAS, Kaufman Lynn submitted a proposal in the amount of $160,000 for
preconstruction services for both Fire Station 1 and the Daycare Facility to complete review of the
approved permit drawings, bidding of both GMPs, and coordination of project schedules; and
WHEREAS, City staff received a negotiated GMP proposal for the construction of the
modular Daycare Facility in Flamingo Park in the amount of $2,830,394; and
WHEREAS, the GMP proposal submitted by Kaufman Lynn in April 2026, nearly three

WHEREAS, subsequent to a future GMP Amendment for the construction of Fire Station
1, which will include a time extension to the CMR Agreement, and following the vacation of the
SSCC, the contractor will commence construction activities at the proposed Fire Station site; and
WHEREAS, Kaufman Lynn's amount expended to date under this agreement is
$1,220,463.76, and the revised contract will include the proposed $160,000 for preconstruction
services for Fire Station 1, the Daycare Facility and $2,830,394 for the Daycare Facility GMP, and
the $144,860 for the Lodge modification; and
WHEREAS, this Amendment No. 4 results in a GMP in the amount of $4,013,614.76 and
a total contract value not -to -exceed $4,355,717.76 for Kaufman Lynn; and
WHEREAS, City staff has reviewed the negotiated proposal for the additional
preconstruction services and found it reasonable for the effort required by the CMR; and
WHEREAS, City staff has reviewed the GMP proposal and found it fair and reasonable
for the construction of the Daycare Facility and the addition of food preparation area at the
Flamingo Park Lodge.
NOW, THEREFORE, the parties hereto, and in consideration of the mutual promises,
covenants, agreements, terms, and conditions herein contained, and other good and valuable
consideration, the respect and adequacy are hereby acknowledged, do agree as follows:
1. ABOVE RECITALS
The above recitals are true and correct and are incorporated as a part of this
Amendment No. 4.
2. MODIFICATIONS
(a) The Agreement is amended as provided h e r e i n .
(b) In consideration for the services to be performed under this Amendment
No.4, the City shall pay Contractor the amount of $160,000, as provided in Schedule "A",
attached hereto.
(c) The City shall also pay the contractor the additional not -to -exceed GMP
amount of $2,830,394 for construction of the Daycare Facility and the not -to -exceed
amount of $144,860, per the revised attachments to the GMP as provided in Schedule
"B", attached hereto.
3. OTHER PROVISIONS.
All other provisions of the Agreement, as amended, are unchanged and shall remain in
full force and effect.
4. RATIFICATION.
The City and Contractor ratify the terms of the Agreement, as amended by this
Amendment No. 4.

Preconstruction Services - Descriptions
Task I — Day Care GMP
Upon receipt of the 90% Construction Documents, the Construction Manager (CM) will
attend a Project Team progress/status meeting to confirm design maturity, procurement
strategy, bid package structure, and GMP assumptions. The Project Executive and/or
Project Manager will participate in all scheduled design progress meetings through GMP
submission.
Within forty-two (42) calendar days of receiving the 90% Construction Documents, the
CM will:
Prepare and maintain a detailed GMP cost model, including scope narrative,
clarifications, assumptions, unit rates/allowances (as applicable), and contingency
recommendations.
• Develop a prequalified bidder list by trade, issue Invitations to Bid, and finalize
bid package scopes aligned with the procurement plan.
• Manage bidder outreach, issue/track addenda as required, and coordinate bid
logistics in support of a complete and competitive bid receipt.
The CM will assemble and submit a GMP Book to the Project Team, including
comprehensive bid tabulation and leveling to validate bid completeness, scope coverage,
and conformance with the Contract Documents. The CM will package GMP proposals by
scope of work, identifying:
• Recommended subcontractor(s) and qualifications,
• Leveling summaries and scope inclusions/exclusions,
• Final pricing by trade/package and supporting documentation.
The CM will support Project Team coordination by participating in required stakeholder,
community, and department meetings and by issuing preconstruction follow-up items
and related services necessary to finalize the GMP.
Compensation: This Task shall be billed upon submission of the GMP deliverable in a
lump sum amount of $72,500.

SCHEDULE A
Task II — Fire Station GMP

clarifications, assumptions, unit rates/allowances (as applicable), and contingency
recommendations.
Develop a prequalified bidder list by trade, issue Invitations to Bid, and finalize
bid package scopes aligned with the procurement plan.

Contractor's Assumptions and Qualifications
This Assumptions and Qualifications document serves to expand and/or clarify the Agreement/Contract
Documents and is the basis of the GMP.
DOCUMENTS:
1. The Contract Drawings and Documents as listed below may conflict with other documents, and as
such, this GMP is based on the Contract Drawings and Documents superseding all other
documents, as modified through this Assumption and Qualification document which governs per
the Contract.
2. This GMP Proposal is based on of the referenced Exhibits and Documents as follows:
a. GMP Cost Summary
b. Allowances (In this document)
c. Assumptions and Qualifications (This document)
d. Document Log
e. Construction Schedule
3. Plan/Drawing Revit Model and CAD Files shall be provided by the Owner as required for use by
Contractor.
4. The Owner shall provide and pay for all drawing modifications (all contract documents) as
required to include all items as outlined within this Assumptions and Qualifications Document and
other Exhibits, immediately upon the execution of the Contract and at no cost to the contractor.
Contractor has not included any time in the Construction Schedule or any time related costs
associated with these modifications. Updated Documents shall be issued and all items modified
shall be clouded.
5. Revisions to the Contract Document will not be annotated on Shop drawings or submittals without
first appearing on the Contract Documents, clouded as modified.
SCHEDULE, DURATIONS & TIME:
1. This GMP includes a schedule exhibit with commencement beginning once all required permits
are obtained and provided to Contractor, Notice to Proceed is issued by Owner and received by
Contractor, proof of financing has been provided to Contractor, proof of Owner's insurance

policies have been provided to Contractor, and all approvals by Authorities Having Jurisdiction
have been issued. Any delay due to work associated with any contractor not in privity with
Kaufman Lynn (i.e.: FPL, owner vendors, AT&T) shall be grounds for a change order increasing
time and general conditions.
2. It is anticipated that work will be performed during normal business hours (8:00 AM to 6:00 PM)
Monday through Friday and, at the discretion and request of the contractor and subject to City
approval, 10am-4pm on Saturdays.
3. It is assumed that this project will have a NTP and issuance of the Master Building Permit as shown
on the schedule Exhibit. Any delay in this start will accrue General Conditions to reserve the key
personnel for the project. The cost to be paid by Ownership to Contractor will be at the stated
daily GC rate in the contract, up until the receipt by Contractor of the NTP, all required permits,
and approvals by Authorities Having Jurisdiction.
4. It is assumed that this project will have NTP and the Master Building Permit on as shown on the
schedule Exhibit. Any delay in this start will require Contractor to re -negotiate budget with Owner
due to the continued escalation in the industry across all trades and the trades inability to hold
pricing.
INSURANCES & BONDING:
Kaufman Lynn reserves the right to use a subcontractor default insurance program or individual
subcontractor bonds.
PAYMENTS, DEPOSITS & RETAINAGE:
1. Deposits for specific trades and bi-weekly payments may be required prior to start of work in
order to provide materials and shops drawings. Kaufman Lynn will bill in advance and accordingly
for these trades and Owner agrees to pay these deposits.
2. Certain trades/subcontractors/vendors may require special and/or early retainage
releases/reductions — including but not limited to: demo, concrete, lumber/framing, elevator, &
windows.
3. To the extent any delays are caused by the imposition of tariffs or taxes on any material imports
including, without limitation, steel and aluminum, any trade wars, or other government action,
such delays shall be deemed compensable delays extending the Contract Time and increasing the
Contract Sum at the Daily Rate of General Conditions Cost.
4. Contractor has agreed to provide a conditional, pre -award discount to December Project
Management Services by including only one (1) week of December PM cost within the current
Budget, and deferring approximately three (3) additional weeks of performed PM effort for
incorporation into the Phase 2 Fire Station structure If Phase 2 is awarded to Contractor. If Phase
2 is not awarded to Contractor, the conditional discount shall be deemed withdrawn and the
deferred performed effort will be reconciled under this Agreement via an appropriate change
order such that Contractor is fully compensated for the additional 3 weeks.

PERMITTING, SPECIAL INSPECTIONS, TESTING, CAPACITY FEES & IMPACT FEES:
Owner shall provide water vacuum test procedure on windows /sliding glass doors / storefront as
required.

2. Regarding temporary and permanent power, temporary or construction power will be the
responsibility of Contractor in its entirety. Regarding permanent power and consumption: Owner
will provide permanent FPL services to the project ("hot" transformers) prior to the date indicated
in the construction schedule. Contractor will be responsible for installation of the secondary
building power feeds and receipt of the temp -for -test inspections. Upon completion of the temp -
for -test inspections, Contractor has included 4 business days in the construction schedule for
receipt and install of the permanent meters from FPL/Owner. Once the permanent meter(s) have
been installed by FPL for the project, which cost and installation is an Owner responsibility,
Contractor will no longer be responsible to pay for consumption.
3. Materials and testing (concrete breaks, density, etc.) shall be conducted by the Owner
DESIGN & CONSULTING:
1. Contractor to provide only existing tested Notices Of Acceptance (NOAs) for Project. Contractor
does NOT own any testing of any NOA's new or existing. It is assumed ALL NOA's required for
Project are existing and in place prior to starting of the Project.
SITE:
1. Industry standard temporary construction chain link fencing with a gate and lock will be used to
secure the site. Includes the Miami Beach vinyl design.
2. Parking for trades to be provided by Owner. Contractor has advised that off site parking will be
required. Contractor to be provided a Compensable Delay in the event Owner does not provide
parking as required due to loss of production labor interest due to lack of ability to get workers to
jobsite. It is assumed that Owner will secure and provide additional off site parking for a minimum
of 15 spaces at adjacent properties within walking distance.
3. Contractor assumes that there are no restricted air rights for adjacent properties with regard to
crane booms.
CONTRACTOR EXCLUDES:
The following items are excluded by Contractor, and shall be provided by the Owner:
1. Contractor excludes building permits fees, BDA Permit fee, Occupancy Permit fees, Impact fees,
Permanent / Temporary Connection fees, Right of Way and lane closure fees and Utility Fees, FPL,
Teco & Assessments.
2. Contractor excludes FPL transformers, Primary Conduits material (install included), wire, and
Deposits.
3. Contractor excludes Main Service Water Meters, Fees and Deposits
4. Contractor excludes Cable TV/Phone equipment and cable or phone wire from service point to
communication room(s) and cable or phone wire from communication room(s) to unit.
5. Contractor excludes any and all Electrical duct banks and service routing / fees.
6. Contractor excludes deposits for temporary/permanent electric Meters.
7. Contractor excludes any time related cost due to delays caused by utility providers.
8. Contractor excludes removal, relocations, and main line installations to building(s) point, including
fiber optics, gas (including meter), power, phone, cable, etc. These shall be provided by the
appropriate service provider.

9. Contractor excludes utility costs and associated fees for all utility usage charges after Certificate
of Occupancy.
10. Contractor excludes resident and/or owner FF&E trash removal services to the buildings after CO
is achieved.
11. Contractor excludes errors and omissions and professional design insurance
12. Contractor excludes Owner Direct Purchase (ODP) administration and tax savings, all sales tax is
included.
13. Contractor excludes Fire Alarm Monitoring Service, Elevator Service agreement, Pool, Gas service
agreement and any other additional service agreement Costs which could be required for
Certificate of Occupancy.
14. Contractor excludes cost relating to Radon Mitigation either passive or active.
1S. Contractor excludes Owner/Architect office space and/or trailer space beyond what Contractor
assumed.
16. Contractor excludes full time on -site A/E and Structural engineering representative.
17. Contractor excludes vibration monitoring and/or any damages associated due to vibration to
adjacent properties as a result of construction — Vibration Monitoring shall be provided by Owner.
Owner to provide Contractor a copy of Vibration Monitoring report(s) within 10 days from
Engineer's publish date.
18. Contractor excludes envelope consultant
19. Contractor excludes mock-ups, mock-up rooms/units that will not be incorporated into the finish
product.
20. Contractor excludes owner FF&E and associated storage, management and special provisions
beyond Contract work.
21. Contractor excludes Material Testing Cost, Threshold or Special Inspectors cost, Private Provider
cost and management of these services and any and all re -inspection associated cost. These
services shall be performed and completed as required by Contracts Baseline Schedule inclusive
of sequencing of building phases.
22. Contractor excludes enhanced commissioning and/or Special Testing Engineering Services.
23. Contractor excludes any and all AHJ and Private Provider overtime inspection costs as required to
maintain scheduled activities.
24. Contractor excludes removal, disposal, remediation, and premiums associated with unforeseen
or unsuitable soil conditions, hazardous materials, subsurface structures or other materials
requiring a controlled removal/disposal and all time related Contractor cost.
2S. Contractor excludes asbestos inspections, reporting documentation, remediation, and "All Clean"
Certifications.
26. Contractor excludes road closure fees and permitting and/or maintenance of traffic beyond civil
scope as required.
27. Contractor excludes any impact to cost and / or schedule due to AHJ requirements not consistent
with the Contract Documents. Any design fees and / or re -design fees and associated costs.
Including but not limited to, time associated with design fees and / or redesign fees and
construction costs, including Contractor time related cost. This includes any and all cost and / or
time associated with additional requirements set forth by AHJ that are required to obtain phased
permitting approval.
