A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, DIRECTING THE CITY ADMINISTRATION TO
IMMEDIATELY REMOVE UNNECESSARY DIGITAL MESSAGE
BOARDS, TRAFFIC CONES, CONSTRUCTION CONES, AND
TEMPORARY BARRICADES LOCATED WITHIN THE PUBLIC
RIGHT-OF-WAY, EXCEPT WHERE SUCH DEVICES ARE REQUIRED BY
LAW OR TO DESIGNATE AN ACTIVE CONSTRUCTION ZONE;
FURTHER DIRECTING THE CITY ADMINISTRATION AND THE CITY
ATTORNEY'S OFFICE TO REVIEW APPLICABLE POLICIES, CODES,
AND PRACTICES AND TO RECOMMEND ANY NECESSARY
ORDINANCE, POLICY, OR PROCEDURAL CHANGES TO REDUCE
UNNECESSARY VISUAL CLUTTER, PRESERVE PEDESTRIAN
ACCESSIBILITY, PROTECT ADA ACCESS, AND MAINTAIN THE
AESTHETIC QUALITY AND NEIGHBORHOOD CHARACTER OF MIAMI
BEACH.
WHEREAS, the City of Miami Beach is internationally recognized for its beauty,
historic architecture, and vibrant public spaces, which contribute to its reputation as a
world -class destination; and
WHEREAS, on February 5, 2026, the Mayor and City Commission adopted
Resolution No. 2026-34096, which directed the City Administration to eliminate
superfluous digital message boards in public places; and
WHEREAS, there has been insufficient progress in the removal of unnecessary
digital message boards and other traffic control devices; and
WHEREAS, the City of Miami Beach seeks to ensure that its public rights -of -way
remain safe, navigable, and accessible for all residents and visitors, including individuals
with disabilities; and
WHEREAS, the proliferation of digital message boards, traffic cones, construction
cones, and temporary barricades —when not required by law or to designate an active
construction zone —creates unnecessary visual clutter and may impede pedestrian
mobility or ADA access; and
WHEREAS, the Mayor and City Commission wish to ensure that temporary
traffic -control devices are used only when necessary and authorized, such as pursuant
to a lawful requirement or pursuant to an approved MOT plan in connection with active
construction; and
WHEREAS, it is in the public interest to remove traffic -control devices those that
are outdated, abandoned, or otherwise unnecessary; and
WHEREAS, the Mayor and City Commission further desire that the City
Administration and City Attorney's Office review relevant policies, codes, and operational
practices and recommend any needed ordinance changes, policy improvements, or
procedural updates to minimize visual clutter, maintain high pedestrian and ADA
accessibility standards, and protect the overall aesthetic and neighborhood character of
Miami Beach.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby direct the City Administration to immediately remove unnecessary
digital message boards, traffic cones, construction cones, and temporary barricades
located within the public right-of-way, except where such devices are required by law or
to designate an active construction zone; further direct the City Administration and the
City Attorney's Office to review applicable policies, codes, and practices and to
recommend any necessary ordinance, policy, or procedural changes to reduce
unnecessary visual clutter, preserve pedestrian accessibility, protect ADA access, and
maintain the aesthetic quality and neighborhood character of Miami Beach.
