A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPROVING THE WAIVER OF THE
CITY'S PORTION OF THE BOUCHER BROTHERS DISPLACEMENT
FEE, AS REQUIRED UNDER THE FIRST AMENDMENT TO THE
AMENDED AND RESTATED CONCESSION AGREEMENT BETWEEN
THE CITY OF MIAMI BEACH AND BOUCHER BROTHERS MIAMI
BEACH, LLC, AND BOUCHER BROTHERS MIAMI BEACH 21 & 46 ST,
LLC, FOR THE MANAGEMENT AND OPERATION OF PUBLIC
BEACHFRONT CONCESSIONS; SAID FEE WAIVER IN THE AMOUNT
OF $16,762.88 BEING REQUESTED IN CONNECTION WITH THE FIFA
WORLD CUP 2026 MIAMI HOST COMMITTEE REEFLINE EVENT
TAKING PLACE AT THE LUMMUS PARK 121" STREET BEACHFRONT.
WHEREAS, the 2026 FIFA World Cup is expected to bring significant international
attention and increased visitation to the South Florida region, providing the City of Miami
Beach with an opportunity to showcase its cultural, environmental, and tourism assets;
and
WHEREAS, the FIFA World Cup Miami Host Committee ("Host Committee") has
programmed various activations in the City of Miami Beach during the 2026 FIFA World
Cup, including events designed to promote tourism, arts, culture, and environmental
awareness; and
WHEREAS, the City's ReefLine initiative is a signature public art and
environmental restoration project intended to create an underwater sculpture park and
artificial reef offshore of Miami Beach, serving as a major cultural and eco-tourism
attraction; and
WHEREAS, the ReefLine project aligns with the City's long-standing commitment
to coastal resilience, environmental stewardship, and the integration of public art into
the urban and natural landscape; and
WHEREAS, the Host Committee has partnered with the ReefLine during the 2026
FIFA World Cup, to develop a public -facing programming on or adjacent to the
beachfront; and
WHEREAS, the staging of the aforementioned event will temporarily affect certain
beachfront concession areas operated by Boucher Brothers Miami Beach, LLC, thereby
triggering the displacement fee requirements set forth in the Concession Agreement; and
WHEREAS, waiving the City's portion of the displacement fee for this event
promotes the public interest by enabling the successful execution of the 2026 FIFA World
Cup Miami Host Committee ReefLine activation without imposing additional financial
burden on the partnering concessionaire; and
WHEREAS, the City Administration has recommended that the City waive its
portion of the displacement fee, in the amount of $16,762.88, in support of the 2026 FIFA
World Cup Miami Host Committee ReefLine event and its associated public benefits.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby approve the waiver of the City's portion of the Boucher Brothers
displacement fee, as required under the Boucher Brothers Concession Agreement, in the
amount of $16,762.88; said waiver being granted in connection with the 2026 FIFA World
Cup Miami Host Committee Reefline event occurring at the Lummus Park 121h street
beachfront.
