HomeMy WebLinkAboutResolution 2026-34337RESOLUTION NO. 2026-34337 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND FINALIZE A REVOCABLE LICENSE OR TEMPORARY USE AGREEMENT BETWEEN THE CITY AND THE RHYTHM FOUNDATION, INC., FOR THE USE OF THE GROUND -FLOOR SPACE LOCATED AT 7605 COLLINS AVENUE, FOR A PERIOD OF SIX (6) MONTHS, AT A NOMINAL LICENSE FEE OF ONE DOLLAR ($1.00); AND FURTHER AUTHORIZING THE CITY MANAGER AND CITY CLERK TO EXECUTE THE AGREEMENT IN A FORM ACCEPTABLE TO THE CITY ATTORNEY. WHEREAS, the City of Miami Beach is the owner of the property located at 7605 Collins Avenue (the "Property"); and WHEREAS, the Property is currently vacant and forms part of the City's real estate portfolio in the North Beach area; and WHEREAS, The Rhythm Foundation, Inc. ("TRF") is a Florida not -for -profit 501(c)(3) arts organization that promotes international cultural exchange and community engagement through live music and related programming; and WHEREAS, TRF serves as the operator and programming partner for the Miami Beach Bandshell (the "Bandshell"), a City -owned historic venue located at 7275 Collins Avenue, and has long been recognized as a cultural anchor in North Beach, providing year-round performances, educational initiatives, and community events that advance the City's cultural arts objectives; and WHEREAS, TRF currently occupies administrative office space at 7455 Collins Avenue, a building scheduled for demolition as part of the Ocean Terrace Project, requiring all tenants to vacate the premises by July 31, 2026; and WHEREAS, the impending demolition creates an operational hardship for TRF, which requires temporary office and limited storage space to continue managing programming and organizational functions at the Bandshell without interruption; and WHEREAS, TRF has requested the City's assistance in securing temporary accommodations, and the Administration has identified the ground -floor space at the Property as an appropriate short-term solution; and WHEREAS, providing temporary space to TRF will ensure continuity of cultural programming at the Bandshell, support a valued nonprofit partner, and advance the City's commitment to fostering arts and cultural vibrancy in North Beach; and WHEREAS, the Administration recommends entering into a revocable License or temporary Use Agreement with TRF for use of the Property for a period of six (6) months, at a nominal fee of one dollar ($1.00), with TRF assuming responsibility for payment of all utilities and interior janitorial services and the City retaining responsibility for routine maintenance. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve and authorize the City Manager to negotiate and finalize a revocable License or temporary Use Agreement between the City and The Rhythm Foundation, Inc., for the use of the ground -floor space located at 7605 Collins Avenue, for a period of six (6) months, at a nominal license fee of one dollar ($1.00); and further authorize the City Manager and City Clerk to execute the Agreement in a form acceptable to the City Attorney. RECOMMENDATION The Administration recommends adopting the Resolution approving a revocable License or Temporary Use Agreement between the City of Miami Beach and The Rhythm Foundation, Inc.. authorizing a six (6) month use of the ground -floor space at 7605 Collins Avenue- BACKGROUND/HISTORY The City is the owner of the property located at 7605 Collins Avenue, which is more particularly described and depicted in Exhibit 1, attached hereto. This site is part of the City's broader real estate portfolio in the North Beach area and is currently vacant. The Rhythm Foundation, Inc. (TRF) is a Florida not for profit 501(c)(3) arts organization dedicated to promoting international cultural exchange and community engagement through live music and related programming. TRF currently serves as the operator and programming partner for the Miami Beach Bandshell, located at 7275 Collins Avenue, a City owned historic venue. Through its stewardship of the Bandshell, TRF has become a longstanding cultural anchor in North Beach, providing year round performances. educational initiatives, and community events that support the City's cultural arts objectives and enhance the vibrancy of the surrounding neighborhood. ANALYSIS TRF currently occupies an administrative office space at 7455 Collins Avenue. This building is scheduled for demolition as part of the Ocean Terrace redevelopment project. As part of the project timeline, all existing tenants must vacate the premises no later than July 31, 2026. This deadline creates a significant operational challenge for TRF, which relies on its office space to manage day to day administrative functions, coordinate programming at the Bandshell, and store essential equipment and materials. 1912 of 2591 Recognizing the importance of maintaining continuity in TRF's operations —and the organizations role as a key cultural partner, the Foundation has reached out to the City to request assistance in identifying a temporary office location. TRF's needs are modest: a functional workspace for staff and limited storage capacity sufficient to support ongoing programming and administrative activities. However, the urgency of the relocation timeline. combined with the scarcity of affordable office space in the immediate vicinity, has prompted TRF to seek municipal support. Providing temporary accommodations for TRF would help ensure uninterrupted cultural programming at the Bandshell. preserve the City's partnership with a valued nonprofit operator, and support the broader goals of cultural vitality and community engagement in North Beach. Additionally. assisting TRF during this transition aligns with the City s longstanding practice of supporting arts organizations that contribute to Miami Beach's identity as a cultural destination. The Administration proposes that the City enter into a short term license agreement or Temporary Use Agreement with The Rhythm Foundation. Inc. for a period of six (6) months revocable license agreement, at a nominal license fee of one dollar ($1.00) Under the proposed arrangement, the City would retain responsibility for all utilities and routine maintenance associated with the property, ensuring that the facility remains in safe and operable condition throughout the term As part of the license agreement or Temporary Use agreement, TRF would be required to obtain appropriate insurance meeting all municipal risk management standards. In addition, TRF would assume responsibility for janitorial services within the interior of the premises. ensuring that day- to-day upkeep of the occupied space is managed directly by the organization.
