ORDINANCE NO.: 2005-3478 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, REPEALING DIVISION 24, ENTITLED "CONVENTION CENTER CAPITAL PROJECTS OVERSIGHT COMMITTEE", OF ARTICLE III, ENTITLED "AGENCIES BOARDS AND COMMITTEES", OF CHAPTER 2, ENTITLED "ADMINISTRATION", OF THE MIAMI BEACH CITY CODE IN ORDER TO DISSOLVE THE CONVENTION CENTER CAPITAL PROJECTS OVERSIGHT COMMITTEE; PROVIDING FOR SEVERABILITY, REPEALER, CODIFICATION, AND AN EFFECTIVE DATE. WHEREAS, in 1999, the Miami Beach City Commission pursuant to Ordinance No. 99- 3206 created the "Convention Center Capital Projects Oversight Committee"; and WHEREAS, at the time of its formation, the Convention Center Capital Projects Oversight Committee ("CCCPOC") was charged with the oversight of $35 million in capital project funds received by the City in the 1996 Inter-Local Agreement with Miami-Dade County; and WHEREAS, the CCCPOC has played a vital role in the stewardship of those funds and has contributed to the many upgrades that have been made to the Miami Beach Convention Center and The Jackie Gleason Theater of the Performing Arts, including the re-roofing of the venues, a complete reconstruction of the telecommunications and data distribution infrastructure for the Convention Center, improvements to the restrooms, carpeting and other systems that have helped maintain the Convention Center as a viable meeting designation both nationally and internationally; and WHEREAS, the commitment of the funding for the Convention Center has been completed and the associated projects are near completion, it has become evident that the need for the CCCPOC has reached its end and that the oversight of the committee is no longer required and the members of said committee should be allowed to contribute their talents in more vital and needed oversight functions within the City of Miami Beach. NOW, THEREFORE, BE IT DULY ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA as follows: SECTION 1. Repeal of Division 24 of Chapter 2. Article III of the Miami Beach City Code. That Division 24, entitled "Convention Center Capital Projects Oversight Committee," of Chapter 2, Article III, of the Miami Beach City Code, reading as follows, shall be repealed in its entirety: CHAPTER 2. ADMINISTRATION * * * ARTICLE III. Agencies, Boards, and Committees * * * DIVISION 24. COl'NENTION CENTER CAPIT}..L PROJECTS OVERSIGHT COMMITTEE See. 2 190.81. Created. There is hereby created and established the capital projects o'fersight committee. Powers, duties, composition and attendance requirements of the committee are set out specifically in this division. The sl:lpporting department of the committee is the office of the city manager. See. 2 190.82. Purpose. The capital projects oversight committee shall serve in an ad'lisory capacity to the city commission and the city administration with regard to capital projects in conjUflction with the Miami Beach Convention Center and The Jackie Gleason Theater oftke Performing Arts. 2 " See. 2 190.83. Composition. (a) Composition. The capital projects o'lersight committee shall consist of seven '/oting members to be direct appointments by the mayor and city commissioners. The city commission may appoint, by a majority Yote, nOIlYoting, ex officio members to assist the committee in fulfilling its defined purposes. (b) Qualifications. The city affiliation req1:lirement for membership shall be fulfilled in either of the following ways: (1) f.n indiyidual has been a resident of the city for a mininmm of six months. (2) An indiyidual ean demonstrate oymership/interest for a minimum of six months in a business established in the city for a minimum of six months. Exception to subsections (b)(I) and (b)(2) aboye, shall be permitted if the committee req1:lires the membership of an indi'/idual with a specific position, lrnowledge, e-xperience or expertise not a'/ailable in another indiyidual who may comply 'Nith the terms of subseetions (b)(I) and/or (b )(2) above. Each member shall be of outstanding TCf'utation of integrity, responsibility and commitment to serving the community. Before assuming the duties of the office, each voting member on the eommittee shall take the prescribed oath of office. Members of the committee shall serve 'Nithout compensation. (c) Appointment and tcrm of mcmbers; filling '.'acaneics. The members of the committee shall be direct appointees by the mayor and city eommissioners. The initial appointment of members shall be for a term beginning on the date of their appointment and ending at the conc11:lsion of the existing members' terms. .^...ll members shall be subseq1:lently appointed for a term of two years and such terms shall rnn on a staggered basis. No 1\'10 members shall be connected or haye any finaneial ties with the same business entity. Vacancies shall be filed for 3 the unexpired period in the same manner as the original appointment for whieh the yacancy exists. Members shall serve until the expiration of their terms or until successors are appointed. Nonyoting, ex officio members shall be appointed by a majority vote of the eity eOII1f1'lission. Nonvoting, ex officio members may be appointed f-or a term not to exceed the term of the committee members. (d) ReHu=Plfll of members. (1) By wyte of eemmissiol'l. The voti-ng mcmeers shall serve at the pleasure of the eity commission. }.ny member of the committee may be remoyed from office by a four slY:enths yote of the city commission. The committee shall haye the following pO\vers, purposes and duties: (1) To serve in an ad,..isory capaeity to the city commissiofl and the eity administration \vith regard to capital projects in eonjuuetion with the Miami Beach Couyentiofl Center and The Jackie Gleason Theater of the Performing Arts. (2) To perform sueh other duties as may from time to time be assigned to it by resolution of the eity commission. SECTION 2. SEVERABILITY. If any section, subsection, clause, or provision of this Ordinance is held invalid, the remainder shall not be affected by such invalidity. SECTION 3. REPEALER. 11 ordinances or parts of ordinances in conflict herewith are hereby repealed. 4 SECTION 4. CODIFICATION. Codification of this Ordinance in the City Code of Ordinances is hereby authorized and directed. SECTION 5. EFFECTIVE DATE. This Ordinance shall take effect on the 26th day of March ,2005. At the time of its formation, the CCCPOC was charged with oversight of the $35 million capital projects fund received by the City in the 1996 Interlocal Agreement with Miami-Dade County. To that end, we feel that we have played a vital role in the stewardship of those funds and their contribution to the many upgrades that have been done to the Miami Beach Convention Center and Jackie Gleason Theater. Re-roofing of the venues, a complete reconstruction of the telecommunications and data distribution infrastructure, and improvements to the restrooms, carpeting, and other systems have helped maintain the facility as a viable meeting destination, both nationally and internationally. However, as the commitment of the funding has been completed, and the associated projects near completion, it has become evident that the need for this committee has reached its end. With the current annual capital outlays available for the venues, the oversight of a dedicated committee is no longer required. Therefore, as Chairman and members of the CCCPOC we respectfully request that the Convention Center Capital Projects Oversight Committee be sunsetted, and that we be allowed to contribute their talents in other more vital and requisite oversight functions within our great city.
