Attached are the historical letters authorizing the eruv around Miami Beach. Whoever thinks they may need
them, should file them (or keep a digital copy) for future reference (particularly the City Clerk). The complaint
raises some aesthetic issues with regard to the eruv; maybe we can (again?) discuss some aesthetic guidelines
with the Eruv council or others responsible. I thought this was in the works at one point (by Public Works?).
Whoever was involved, please comment or call me as to status. Thanks.

There is no violation. It is approved. I am able to discuss this issue with anyone. Please advise Code and/or staff not to

Here is some additional information on complaint XC 10001986 (Construction without Permits)
The attached pdf article from the New Times explains what the pole string construction is by the boardwalk and
who is responsible. The article says the plastic poles are attached to the boardwalk (there are plastic poles and
wooden 2 x 4 poles 12 to 15 ft tall dug into the sanddunes and attached to the boardwalk. I called Brian Flynn at
DERM and he said the sanddunes are state property (Department of Environmental Protection) and anything on
or bordering the sanddunes would have to have DEP permits including the fencing on the east side of the dunes
and especially the CMB wooden boardwalk on top of the western edge of the sanddune. There is a short plastic
pole driven into the sanddune next to the wooden 2 x 4 attached to the boadwalk. All the 2 x 4's attachments to
the boadwalk are fastened very shabbily and some go down into the sand. Then there is the problem of
insurance to protect the public that has also been overlooked. So, no construction permits and no insurance.
But don't forget when you read the attached article it will say how the construction of these poles and string is
because, they, the Jewish people, are obeying Jewish Law. Well, what about Miami Beach Law or State DEP
Law.
Also these poles with string have been erected on Ocean Terrace and then north to Haulover. From 47th Street
to 73rd street. On Ocean Drive between 1st and 15th Street. (See list of locations at end of the attached article)

In closing let me say the issue here is simply "construction without permits" and no liability insurance. Then
there is the fines for the many years of violations.
State DEP people are going to call me about the sanddune violations and I will let you what they say.
