AFTER-ACTION Meeting called to order at 1:13 p.m. After Action December 9, 2016 City of Miami Beach Special Commission Meeting Page 2 of 3 REGULAR AGENDA 1:12:06 p.m. R9 A DISCUSSION OF SIDEWALK CAFÉ GUIDELINES ON OCEAN DRIVE, SPECIFICALLY SEEKING DIRECTION WITH RESPECT TO ANY EXEMPTION FOR BUILDINGS WITH MULTIPLE RETAIL ENTRANCES ON THE GROUND FLOOR WITH RESPECT TO THE WESTWARD MIGRATION OF THE SIDEWALK CAFÉ OPERATIONS. Public Works ACTION: Discussion held. Approved by acclamation to grant the below listed business an exception from the requirement of the 10-Point Plan that sidewalk cafés must migrate their operations to the west side of Ocean Drive; a 5-foot wide pedestrian walkway must be maintained by said business. DIRECTION: Maintain the 5-foot wide pedestrian walkway, and keep operations on the east side for the following businesses: Starlite Hotel, 750 Ocean Drive; Mango’s Tropical Café, 900 Ocean Drive; Palace Bar, 1200 Ocean Drive; and, Voodoo Rooftop Lounge & Hookah, 928 Ocean Drive Jimmy L. Morales, City Manager, explained that the Administration has been working closely with the businesses on Ocean Drive, with the Ocean Drive Association and the Ocean Drive Task Force. One of the elements in the recently adopted 10-Point Plan included the removal of the “gauntlet” and having a westward migration of the sidewalk café operations towards the buildings. In the 10-Point Plan, it indicates that in situations where such a layout is not feasible, then the Planning Department could come up with alternative maps. There are three properties affected: 750 Ocean Drive, Starlite, 900 Ocean Drive, Mango’s, and 928 Voodoo, where there are also multiple retail entrances in addition to the restaurant operation; this means that when they do the restaurant migration in those buildings, due to the requirement of fire access to those different businesses, the impact, in terms of number of seats and chairs, is far more significant. He recommended that in the future, and in these instances; allow them to, while keeping the 5-foot wide pedestrian walkway, keep the operations on the east side, so they will not have a significant loss of seating. He cited an example; Mango’s would lose approximately 20 seats in the process, which is a significant impact. Rather than adding discretionary criteria that future Planning Directors could change, the City Manager suggested having certain businesses, as long as the retail configurations remain the same, and if feasible, retain their sidewalk café operations on the east side of the street as long as they maintaining the 5 foot wide pedestrian walkway. Commissioner Arriola stated that over time, the businesses that operate inside the buildings have ingresses and egresses in certain ways, and it may be required to carve out some exceptions. To his knowledge, and after extensive discussion with staff and the Ocean Drive merchants, there are the four properties that have been identified that need some type of variance from the overall 10-Point Plan, which calls to move all the sidewalk café tables to the western side of the sidewalk; these four businesses have unique building and business operation characteristics. He is in agreement with allowing it, but is concerned with the granting of other exceptions and does not want the granting of exceptions to become a habit. Vice-Mayor Malakoff clarified that the properties are Starlite, Mango’s, Palace and Voodoo. City Manager Morales stated that The Palace will be closing next summer and that was the issue of the entertainment, but these three have additional retail door entrances to businesses, in addition to the restaurant, and by moving their sidewalk operations westward, these businesses are much more adversely impacted in terms of operation.
