Memo advising opinion from 3rd District Court of Appeal affirming Circuit Judge's opinion that Gilbert Fein had an existing contract with City to perform architectural services for expansion of Convention Hall filed. 6/7/72 Council approved City Atty.'s recommendation that Petition for rehearing be filed and if denied, Petition for Certiorari fo Fla. Supreme Ct.be entered. 223.. Meeting Date 5/17/72 6/7/72 SUITS, AGA INST THE CITY 224 Meeting Date Attys. for Irving Ellis, lessee of Chamber of Commerce dock appeared and offered settlement. City Atty. reported City liability and extent is up to Court. Since summary of damages had not been verified by City Auditor, City Mgr. and City Atty. instructed to meet with Ellis' atty. to discuss settlement. Ray H. Pearson, Ellis' Atty. requested copies of recommendations before June 26, 1972. 6/7/72 City Mgr. & City Atty. reported on status of litigation of Florida Furniture Mart and they were instructed to meet with Fla. Furniture to negotiate a settlement and submit report prior of 6/28/72. 6/7/72 SUITS AGAINST THE CITY City Council approved recommendations for settlement of pending litigation re: lease C2e'Qa.r'66" 4 of Convention Hall Facilities by Florida Furniture Mart during the period between the two political conventions, for $30,000. 6/21/72 City Atty. advised attorneys for lessee, Irving Ellis, had rejected offer of settle- )� ment proposed by City. There being no other direction by Council, City Atty. advised that case will go to trial. 6/21/72 City Atty. reported re: Southern Dynamic Enterprises vs. City of Miami Beach (208 Meridian Condominium and Council approved his recommendation for dismissal of pro forma appeal. 6/22/72 225 Meeting Date
