In reply to V.M.Haber's request for a legal 2/18/76
opinion on Architect Morris Lapidus' letter
to City Mgr. Feb. 4, 1976, concerning default
of carpet contractor and Mr. Lapidus' opinion
that his company is entitled to additional ser-
vices under their contract with City for all
time spent by himself and his staff in connec-
tion with this default, City Atty. advised that
he had examined Mr. Lapidus' letter as it per-
tained to his existing contract with City and,
in his opinion, claim is not well-founded; V.M.
Haber requested that City Atty. respond to Mr.
Lapidus' communication accordingly. In reply
to Councilman Dr. Wikler's question as to whether
Mr. Lapidus might be liable if City is put to

additional expense to correct acoustics and
seating problems in TOPA, Mr. Wanick said
that he would review this. 2/18/76
Mr. Arnold Leon appeared and complained about 2/18/76
acoustics in Theater. City Mgr. requested to
submit report on acoustic, seating and other
problems in Theater, as to corrective measure
being taken.

TOPA. Letters to Council No. 94-96 (corres-
pondence from Mr. Lapidus re: Theater). No.
92-96 (correspondence from Mr. Litz to Mr.
Lapidus and letter from Boner Associates to
Mr. Litz). Minutes of meeting with TOPA users
2/11/76. 1. Council directed City Mgr. to with-
hold all payments to all contractors, etc. as-
sociated with TOPA until additional report pre-
sented to Council on 3/17, as to what is to be
done, etc. to correct acoustical problems in
Theater. 2. Request made that investigation
be made into situation where City acoustics
consultant was also employed by sub contractor
who installed system as to whether conflict of
