Commission,as rate -making body, made findings, based on the information provided and testi- mony given by City's expert, as follows: 1) An increase of 9 (from 48 to 57) per 1,000 gallons, was warranted for municipal consumers; 2) An increase of 10 (from 48 to 58) per 1,000 gallons, was warranted for non -municipal consumers. Further action deferred to 9/29/78 at 4:30 p.m. Ord. #78-2137 adopted, increasing schedule of 9/29/78 rates for water supply service to municipalities WATER 106 (continued) Date to 57 per 1,000 gallons (application of in- creased rates shall abide the event of current litigation in courts) and to non -municipal con- sumers to 53 per 1,000 gallons; increasing minimum monthly service charges; and providing for an effective date of Oct. 1, 1978. Prior to adoption of above ord., a motion to provide for an increase in non -municipal consumers' rate to 52 per 1,000 gallons, failed of pas- sage. 9/29/78 (NOT ON AGENDA) City Atty. submitted a report 10/19/78 concerning a Third District Court of Appeal judgment dated Oct. 17, 1978, reversing the judgment of Circuit Court in favor of the WATER 107 (continued) Date City, and setting forth that this opinion did not hold that City was not entitled to the monies owed by satellite cities, but merely that only the Metro Dade Co. Water & Sewer Brd. has jurisdiction to fix water rates to be charged them. Mr. Joseph Weil, atty. for N. Bay Village, appeared and requested Commission reconsideration of Ord. No. 78-2137, adopted Sept. 29, 1978, and to delete those portions pertaining to rates for service to municipali- ties, which he alleged were in violation of the Temporary Injunction. The City Atty. stated that such action is not necessary since that ord. includes the notation that application of the increased rates shall abide the event of 10/19/78
