Councilman Magnes questioned the City Atty.
as to effect of County Atty's Simon's opinion
that Metro has sole authority as to zoning
in cities and the unincorporated areas.
City Atty. advised that should Metro enact
an ordinance based on his opinion there would
be litigation.

tion of Council action rezoning Shalom
Nursing Home property.
Re: right of apartment house owners to open
restaurants in their buildings; advertise same
to public as accessory uses, Councilman Magnes
stated Court of Appeals has now spelled out
rights of three types of structures in M.B;
that City Mgr. was aware of them; thatthere
has been a lack of enforcement, particularly
as to advertising of these uses. He requested
City Mgr. make every effort to see that statutes
are enforced in the future.
