complained that over 200 nonregulated pvt. vehicles
are involved in soliciting in MB area to take

He requested that City take action to prevent
and/or prosecute such solicitation. Ord. 81-2284,
restricting comm. soliciting within City, adopted
as emergency meas., to expire 2/1/82. In reply
to Mayor Ciment's ques. as to whether City could
impose a fine on someone providing such transportation,
C. Att. advised that City had recently lost its
suit in 3rd Dist. Ct. of Appeal, opposing Co.
takeover of taxicab ind. reg., & that City is
involved in 3 suits regarding ques. of whether it
can control non -taxicab transportation vehicles
within City. Mr. Smoley advised that his client
has joined City in suit against St. & Att. Genl.
