However, S. Bell representative Walker stated
that an agreement is negotiated, they take the
position that there is no franchise and there-
fore, they owe the City no monies. City Mgr.
and City Atty. directed to forthwith meet with
S. Bell representatives and to begin negotiations.
Administration was authorized to seek the assist-
ance of a special counsel, expert in field of
franchises, if required. Administration to sub-
mit a progress report prior to Nov. 15, 1978

granting a telephone franchise to a Telephone

City Mgr. reported outcome of initial discus- 11/15/78
sion with S. Bell to the effect that 1) Company

will pay to City $50,000; 2) City will release
restraint on permits; 3) City and Telephone Co.
will begin meaningful discussion regarding
franchise operations in City. Acceptance of
$50,000 being a good faith demonstration on part
of Telephone Co., without prejudice to either
party in conduct of negotiations. A motion was
made by Commissioner Malek to accept recommen-
dations and was duly seconded; however, after
comments by Mayor, Commissioner Malek expressed
the wish to withdraw his motion. Additional
discussion ensued, with result that Commission
voted to allow him to withdraw his motion.
