Mrs. Maryon Freifelder, President of Parkview 3/21/79
Island Home Owner's Assoc., appeared and re-
quested that Commission obtain information from
knowledgeable agencies as to conditions on is-
land affecting health, safety, and welfare, and
that only persons with appropriate expertise be
appointed to Planning Commission and other City
boards. City Atty. advised of March 29, 1979
court hearing re: Parkview Island and invited
Mrs. Freifelder to appear as a witness for City.

(ADD ON) Dade County Circuit Court order re: 4/4/79
Petition for Write of Mandamus, Parkview Island
Apartments, Ltd., v. C.M.B., issued April 3,
1979. City Atty. submitted copies of Write of
Mandamus ordering issuance of building permit,
and following review of alternatives open to
City, recommended that an appeal not be taken
so that the permit may issue per court order.
He further advised that atty. for owner,
Mr. Jason Berkman, had made a verbal commitment
to him that they are willing to waive any damages,
including atty's fees and court costs, if the
permit is issued. Mrs. Maryon Freifelder, Presi-
dent of Parkview Island Home Owners' Assoc., ap-
peared, alleged that City employees had withheld

information she had been requesting, and asked
that an investigation be made of the cause of
recent auto accidents on the Island, as well as
the condition of bridge and other health, safety,
and welfare aspects of the Island, before issuing
the permit. The Public Utilities Director stated
that all information specifically requested by
Mrs. Freifelder had been provided, and rendered
an oral report on pending plans to replace bridge.
A motion to instruct City Atty. to file an appeal
on Peremptory Writ of Mandamus, failed of passage.
City Atty. advised that to totally protect City
in future, a better procedure would be to impose
building moratorium by ord. Later in meeting, he
advised that an ord. would be prepared for 4/4/79
