Transmission Line. Atty. Joseph Z. Fleming,
representing RITE (Research Improves the En-
vironment, Inc.) appeared in connection with
their suit to permit the proposed pilot project
to extend the City's present ocean outfall line,
and advised City had been named as one of the
defendants in order to enable the matter to be
brought to court. He requested that City retain
Atty. Linton Lovett to examine pending proceed-
ings and to advise City regarding its duty to
proceed with Va. Key project, and whether it
would be feasible to apply to court for protection
from any sanctions against City from other 10/5/77

governmental agencies. City Atty. advised that
City had acted in compliance with law in pro-
ceeding with contracts and construction; that
remedy would be to change the laws, but would
not be found in courts. He said City has no
alternative but to continue what it is doing,
particularly in view of fact that substantial
contracts had been let and project is already
well under way; but if Council desired to ob-
tain Mr. Lovett's views, it would be empowered
to do so. Assistant County Atty. Clifford
Schulman appeared and concurred in the advice
of City Atty. with exception of City Atty's re-
ference to Mr. Lovett's possible employment.
The matter was deferred to Oct. 19, 1977 at 10/5/77
