A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, SUPPORTING SENATE BILL
1590 THAT PROVIDES A MINIMUM OF THE LESSER OF 7.6% OR
$50 MILLION ANNUALLY FOR PROJECTS THAT PRESERVE AND
REPAIR THE STATE'S BEACHES, AND ENCOURAGING THE
FLORIDA HOUSE OF REPRESENTATIVES TO MODEL
GOMP,A.NION HOUSE BILL 1213 AFTER SENATE BILL 1590.
WHEREAS, Senate Bill 1590, as proposed with two Committee Substitutes
(CS/CS/SB 1590), is pending in the 2017 Florida Legislative Session; and
WHEREAS, CS/CS/SB 1590 was introduced by Senator Jack Latvala (R-
Cleanuater) and was co-introduced by Senators Travis Hutson (R-Palm Coast), Debbie
Mayfield (R-Melbourne), Linda Stewart (D-Orlando), and Dorothy L. Hukill (R-Port
Orange); and
WHEREAS, CS/CS/SB 1590 revises the criteria to be considered by the Florida
Department of Environmental Protection (DEP) in determining and assigning annual
funding priorities for beach managernent and erosion control projects; revises the list of
projects that are included as inlet management projects; revises the ranking criteria to
be used by DEP to establish certain funding priorities for certain inlet-caused beach
erosion projects; revises requirements for the comprehensive long-term management
plan; and provides for annualfunding, in a minimum amount of the lesser of 7.6 percent
or $50 million from the Land Acquisition Trust Fund to be used for projects that preserve
and repair State beaches; and
WHEREAS, companion House Bill 1213, pending with two committee
substitutes, has been filed in the Florida House of Representatives (CS/CS/HB 1213) by
Representatives Kathleen M. Peters (R-St. Petersburg) and George R. Moraitis (R-Fort
Lauderdale), which is co-sponsored by Representative Bilt Hager (R-Boca Raton); and
WHEREAS, both CS/CSiSB 1590 and CS/GS/HB 1213 revise and update the
criteria considered by Florida DEP in the ranking of beach projects; however, CSICS/HB
1213 does not provide annualfunding for beach renourishment projects; and
WHEREAS, the protection and restoration of beaches and shores is vital to the
economy of the Ciiy of Miami Beach, and to the entire State of Florida, which depend on
p* n"i,itv and appeal of these natural resources that attract millions of visitors and fuel
our prosperity and growth; and
WHEREA$, the Mayor and the City Commission of the City of Miami Beach
support CSICSISB 1Sg0 ani encourage the Florida House of Representatives to model
csrcs/HB 1213 afier cslcslsB 15-90 with regard to annual funding provisions for
projects that preserve and repair the State's beaches'

NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CIry
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA,, that the Mayor and City
Commission hereby support Senate Bill '1590, that provides a minimum of the lesser of
7.6% or $50 million annually for projects that preserve and repair the State's beaches,
and encourage the Florida House of Representatives to model companion House Bill
1213 after Senate Bill 1590.

WHEREAS, Reagan Pace was appointed to the City of Miami Beach Planning
Board by the City Commission on January 14, 2015 under the general business
category, and she was reappointed in that category on December '14, 2016; and
WHEREAS, pursuant to Section 118-53(c) of the City Code, no person except a
resident of the Gity, who has resided in the City for at least one year, shall be eligible for
appointment to the Planning Board; and
WHEREAS, Ms. Pace has over 2 years of service and experience as a member
on the Planning Board; however, she will be moving to a new residence which is outside
of the City and she will no longer be a City resident; and
WHEREAS, pursuant to Section 118-53 of the City Code, the City Commission
may waive the residency requirements for Planning Board membership by a 5l7h vote
in the event a person not meeting these requirements is available to serve on the
Planning Board and is exceptionatly qualified by training andlor experience; and
WHEREAS, Ms. Pace is exceptionally qualified due to her training and
experience and she should continue to serve on the Planning Board.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF Mnml BEACH, FLORIDA, that the Mayor and City
Commission hereby waive, by Sffth vote, the residency requirement for Reagan Paee so
that she may continue to serue on the Planning Board in accordance with Section 1 18-
53(d) of the City Code.

Resolution No. 2015-29234, and authorized the City Manager to negotiate an agreement with
$avino & Miller Sesign Etudio, P.A. {"Consultant'), for Architectural and Engineering Design
Services for the Future Gommunity Park (Former Par 3) Project, pursuant to Request for
Qualifications No. 2015-240-KB (the .Project"); and
WHEREA$, on May 19, 2016, following the conclusion of negotiations, the City and the
Consultant executed an agreement for the Project (the'Agreement'); and
WHEREAS, Section 10.3 of the Agreement provides that "in addition to the City's right to
terminate for cause, the City through the City Manager, may also terminate this Agreement,
upon foufieen (14) days prior written notice to Consultant, for convenience, without cause, and
without penalty, when (in its sole discretion) it deems such termination to be in the best interest
of the City;" and
WHEREAS, in accordance with the Agreement's tenns, the City Commission desires to
lerminate the Agreement wilh the Consultant for its convenience, and deems such termination
to be in the best interest of the City"
NOU[, T]|EREFORE, BE tT DULY RE$OLVED BY THE triAYOR AND CITY
COMMISSION OF THE CITY OF [tlllAMl BEACll, FLORIDA, that the Mayor and City
Commission hereby approve the termination for convenience of the Agreement between the
City of Miami Beach, Florida and $avino & Miller Design Studio, P.A., dated May 19, 2016, for
Architectural and Engineering Design Services for the Future Community Park (Former Par 3)
Project; and authoriae the City Manager to exercise lhe City's right to termination for
convenience, in accordance with Section 10.3 of the Agreement.

On April 21,2017, The Miami Herald published an article entitled "Seagrass keeps dying in
Biscayne Bay. ls it getting too sick to recover?" The article discussed how the urban end of
Biscayne Bay, vrhich managed to survive decades of causeway and jet skis and dredging,
where acres of seagrass grew in waterthat remained clear despite allthe pumping and dumping
from its coastal neighbors, is sick. Since 2012, more than half the meadow has died, causing
alarm to those who monitor the situation. The article lists as an unknown factor for some
scientist as to cause of the die-off the increased pumping of untreated stormwater from Miami
Beach.
