WARRANTY

THIS INDENTURE, Made this ~ day Of~t' 19~ between
PAUL SMITH CONSTRUCTION COMPANY, a corporation organized and exist-
ing under the laws of the State of Florida, Party of the First
Part, and THE CITY OF MIAMI BEACH, FLORIDA, a municipal corporation
existing under the laws of the State of Florida, and located in
the County of Dade and State of Florida and lawfully authorized
to transact business in the State of Florida, Party of the Second
Part,
WITNESSETH
That the said Party of the First Part, for and in
consideration of the sum of Ten Dollars <$10.00) and other good
and valuable considerations to it in hand pa,id by the said Party
of the Second Part, the receipt whereof is hereby acknowledged,
does grant, bargain and sell to the said Party of the Second Part,
its successors and assigns forever, the following described land,
situate, lying, and being in the County of Dade and State of
Florida, to wit:
Lot 8, which was reserved for Coast Guard purposes
by the President of the United States by Proclama-
tion No. 1589, of March 11, 1921, containing 21
acres more or less, and which constitutes a part of
orginal Lot 6, Section 2, Township 53 South, Range
42 East, Tallahassee Meridian, Florida, excepting
that portion of Lot 8 granted to the City of Miami
Beach, Florida, by the United States by quitclaim
deed dated June 16, 1937, recorded in Book 1821 of
Deeds at page 461 of. the land records of Dade County,
Florida, but including the reversion in said portion
reserved to the United States by such deed.
And the said :Party of the First Part does hereby warrant the title
to said land, and will defend the same against the lawful claims
of all persons claiming by, through or under Party of the First
Part.

The Grantor herein specifioally reserves unto itself,
its successors and assigns, a purchase money lien upon said pro-
perty for the balance of the purohase prioe thereof and this
conveyance is made subject to the said purchase money lien in the
sum of One Hundred Seventy-Five Thousand Dollars ($1?5,OOO.00)
payable to Grantor by Grantee herein at the rate of Twenty Thousand
Dollars ($20,OOO.OO) per year for eight years and Fifteen Thousand
Dollars ($15,OOO.OO) at the end of the ninth year, together with
interest upon eaCh of said payments at the rate of four peroent
(4%) per annum. This lien for the balance of said purchase price
shall remain in full force and effeot regardless of any mortgages
said
or other evidenoes of/indebtedness which may be executed by the
purchaser and whioh may be accepted by the Grantor, nor shall the
acceptanoe thereof be construed as any waiver of said lien.
IN WITNESS WHEREOF, the said Party of the First Part
has caused these presents to be signed in its name by its proper
officers, and its oorporate seal to be affixed, attested by its
Assistant Secretary, the day and year above written.
