WHEREAS, FLORENCE B. RAFKIN, a widow, on October 27,
1965, entered into an agreement with the City of Miami Beach
pertaining to the widening of Collins Avenue, involving
Lot 339, First Ocean Front Subdivision, which agreement was
thereafter amended on April 7, 1966, by extending the per-
foxmance date to December 31, 1967; and
WHEREAS, said FLORENCE B. RAFKIN has, since entering
into said agreement as amended, and on December 5, 1966,
conveyed said property to AMSONS CO., a Florida corporation;
and
W~EREAS, the said agreement, as amended, made no
provision for the grant of any easement to the City, since
at that time the City's Engineering Department saw no
necessity for procuring same in that area; and
WREREAS, the Engineering Department has now found and
determined that it is necessary for the City to acquire an
easement over the southerly five feet of Lot 339, of said
subdivision, and the southerly five feet of a parcel of land
described in said agreement, as amended, as Parcel "C"; and
WHEREAS, the City Attorney has prepared such grant of
easement, with which instrument the City Council is familiar;
and
WHEREAS, it is deemed to be to the best interest of the
City that said easement be acquired;
NOW, THEREFORE, BE IT RESOLVED BY THE C~COUNCIL OF
THE CITY OF MIAMI BEACH that SAUL Z. BENNETT be and he is
hereby authorized and directed to negotiate with AMSONS CO.
the present owner of said Lot 339, First Ocean Front Subdivision,
for the execution and delivery to the City of said grant of
easement.
