SPECIAL WARRANTY DEED
THIS SPECIAL WARRANTY DEED made and executed the 17th day
of December, A.D., 1982 by THE MIAMI BEACH REDEVELOPMENT
AGENCY, a public agency existing under the laws of the State
of Florida with its permanent post office address at 1212
Fifth Street, Miami Beach, Florida 33139, hereinafter called
the grantor, and THE CITY OF MIAMI BEACH, a Municipal corpora-
tion existing under the laws of the State of Florida and
having its principal place of business at 1700 Convention
Center Drive, Miami Beach, Florida 33119, hereinafter called

(Wherever used herein the terms "grantor" and
"grantee" include all the parties to this
instrument their successors and assigns.)
WITNESSETH: That the grantor, for and in consideration
of the sum of TEN and 00/100 DOLLARS ($10.00) and other valu-
able considerations, receipt whereof is hereby acknowledged,
by those presents does grant, bargain, sell, alien, remise,
release, convey and confirm unto the grantee, all that land
situate in Dade County, Florida, generally bounded by Alton
Road on the East, Biscayne Bay on the West, Fifth Street on
the North and Government Cut on the South, more particularly
described as follows:
Lots 1 through 14 inclusive; and Lots 21 through 42
inclusive, in Block 111, of OCEAN BEACH, FLORIDA,
ADDITION NO.3, according to the Plat thereof, record-
ed in Plat Book 2, Page 81, of the Public Records of
Dade County, Florida.
ALSO
Lots 43, 44, 45, 46, 47, 48A, 49B and 50C of DADE
COUNTY PROPERTY, according to the Plat thereof,
recorded in Plat Book 14, Page 70, of the Public
Records of Dade County, Florida

Township 54 South, Range 42 East, known as Tract A
or the Smith Company Bay Front Tract, more particu-
larly described as follows, to-wit:
Bounded on the north by the northern line of said
Section 10; bounded on the east by the east line of
Jefferson Avenue extended; bounded on the south by a
line parallel to and distant 132.0' south of the
northern line of said Section 10, and bounded on the
west by Biscayne Bay.
SUBJECT TO:
1. An easement for existing public utili ties as
shown in Attachment "A" which is incorporated herein by refer-
ence until the same are relocated by the Miami Beach Redevelop-
ment Agency.
2. The establishment of easements sufficient in
size, location and number to permit convenient ingress and
egress from the Public Marina to the public streets as deter-
mined by the Miami Beach Redevelopment Agency; provided,
however, that the same shall not unreasonably interfere with
construction on the property, and the use and enjoyment of the
property.
3. Retention in public ownership of a parcel gener-
ally described in Attachment B and more particularly situated
within Lots 21 through 29, of Block Ill, OCEAN BEACH, FLORIDA,
ADDITION NO.3, according to the plat thereof, recorded in
Plat Book 2, of Page 81 of the Public Records of Dade County,
Florida. Said parcel being adequate in size and location to
accommodate construction and operation of public marina facil-
ities including but not limited to dry boat storage facilities,
bait and tackle shops, boat launching area, and other public
marine facilities as specified by the Redevelopment Agency.
TOGETHER with all the tenements, hereditaments thereto
belonging or in anywise appertaining.
TO HAVE AND TO HOLD, the same in fee simple forever.
AND the grantor hereby covenants with said grantee that
it is lawfully seized of said land in fee simple; that it has
good right and lawful authority to sell and convey said land;
that it hereby fully warrants the title to said land" and will
defend the same against the lawful claims of all, persons
claiming by, through or under the said grantor.
