LIMITATIONS ON CITY BOARD MEMBERSHIPS
It has been suggested that the City adopt an ordinance limiting the
tenure of City Board members to 10 or 15 years per individual. Such
a proposal is conceptually similar to the "sunset" provisions which
now apply to many Federal and State Boards and Commissions. My Of-
fice has researched this issue, and I wish to advise you that there
is no legal or Constitutional impediment to adopting an ordinance
which imposes a time limitation on individuals serving on City
Boards or Commissions.

RESOLUTION NO.
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA GOVERNING EXPIRATION OF
TERMS OF CITY BOARD AND COMMITTEE MEMBERS.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA:
1. All persons serving on City Boards, Committees, Com-
missions or Authorities created by Resolution whose terms of office
expire after a definite term of years shall cease to hold office
days after expiration of their terms, whether or not a succes-
sor to office has been appointed by the City Commission, and persons
whose term so expires shall have neither de jure nor de facto autho-
rity to vote or take any other official action on behalf of the City.
Persons whose term expired over days prior to adoption of this
resolution shall cease to serve immediately upon adoption of this
resolution.
2. All persons serving on City Boards, Committees, Com-
missions or Authorities created by Resolution, whose terms are for a
definite term of years and until a successor is appointed (or words
to that effect), shall continue in office until reappointed or .a
successor appointed by the City Commission.
3. The City Manager shall give advance notice to the
Miami Beach City Commission, by notification in the agenda, of any
and all future vacancies.
4. All resolutions or policies to the contrary, which
permit members of Boards, Committees, Commissions and Authorities to
hold "de facto" office after expiration of their terms, are hereby
superseded and rescinded.

OF MIAMI BEACH, FLORIDA GOVERNING THE TERMS OF
OFFICE OF ALL CITY BOARD AND COMMITTEE MEMBERS.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA:
SECTION 1. TERMINATION OF OFFICE.
All persons now serving on City Boards, Committees, Commissions or
Authorities shall cease to hold office days after expiration
of the term of their office (as said term is specified in the ordi-
nance, resolution or other law creating said office) whether or not
a successor has been appointed by the City Commission, and such per-
sons shall at that time cease to exercise any rights, power or pre-
rogatives of office. Any person whose term expired over days
prior to adoption of this ordinance shall cease to hold office im-,
mediately upon adoption of this ordinance.
SECTION 2. EXCEPTIONS.
This ordinance shall not apply to persons appointed to serve for a
specified term "and until a successor is appointed" (or words to
that effect); such persons shall continue to serve until reappointed
or a successor is appointed by the City Commission.
SECTION 3. NOTIFICATION OF VACANCIES.
The City Manager shall give advance notice to the Miami Beach City
Commission, by notification in the agenda, of any and all future
vacancies.
SECTION 4. REPEAL
All contrary provisions of any Miami Beach policy, resolution or or-
dinance are hereby repealed.
SECTION 5. EFFECTIVE DATE.
The City Commission of the City of Miami Beach specifically finds
that an emergency exists with respect to the authority of persons
holding office on nearly forty City Boards, Committees, Commissions
and Authorities, in that the terms of many such offices are in doubt
due to ambiguity with respect to the de facto or de jure authority of
such persons after expiration of their terms but before their suc-
cessors are appointed. Accordingly, the City Commission adopts this
measure as an emergency ordinance to protect the safety and welfare
of the City and its interests, to take effect immediately in accor-
dance with §166.041(3)(b), Fla. Stat. (1979).

Dear Gabrielle:
In regard to your request of whether the Mayor's Ad Hoc Birthday
Jubilee Committee may become a regular committee of the City, this
office will draft either a resolution or an ordinance creating a
permanent Birthday Jubilee Committee only if a Commissioner requests
us to. However, as a point of information, you should be aware that
§2-1.3 of the Miami Beach City Code prohibits an individual from
being on more than one committee at the same time. Therefore,
should the Ad Hoc Birthday Jubilee Committee become a full fledged
committee, you would have to resign your position on the Commission
on the Status of Women in order to still remain Chairman of the
Birthday Jubilee Committee. Moreover, any member of the Ad Hoc
Birthday Committee who now sits on another board of the City would
have to resign from the other board in order to sit on the Birthday
Jubilee Committee.

Your query of Mr. Pflaiam has been referred to me.
City Ordinance 80-2238 (6) specifically states:
.... The municipal prosecutor and his designated
assistants shall have authority, to arrest and de-
tain individuals in conformity with § 25 of the
Miami Beach Charter and the Constitution of the
United States.
Section 25 referred to above, permits the police to
effect warrantless arrests for ordinance violations
committed in their presence, or to seek arrest
warrants upon affidavit. Thus, the power of the
Municipal. Prosecutor to theoretically arrest, is
limited to violations of the City Code.
As a caveat however, all municipal prosecutors should
be carefully advised of the policy reasons against the
exercise of their arrest power:
1. The State Attorney has strict policies against
Assistant State Attorneys from acting in quasi-
police capacities. These are founded upon two
considerations:
a. A conflict of interest would be created
preventing prosecution by the State Attorney,
requiring appointment of a Special Prosecutor,
where the prosecutor is a witness, indeed
the arresting officer.
b. Lack of experience in making decisions "on
the street" combined with the prosecutor's
responsibility to seek justice in a neutral
manner.
2. "-^The elements necessary to establish probable cause
for violations of the City Code are not always the
same as those existing under the concurrent Florida
Statute. In fact, several criminal sections of the
City Code are constitutionally suspect in light of
* recent court decisions, and legislation pre-empting certain
fields to the exclusivity of State or Federal governments.
3. Exposure to liability, not to mention physical harm.
Plain-clothed officers always have a back-up to assist.
It is extremely dangerous to effectuate an arrest alone.

City Ordinance 80-2238 while providing Municipal Prosecutors
with Arrest Powers does hot provide for their classification
as law enforcement officers, and further, does not permit
them to carry, possess or use firearms in the performance
of their duties.
Although State Attorneys and their Assistants ostensibly
fall under exceptions.in Chapter 790 Florida Statutes,
thereby permitting them the same privileges as police officers
with respect to firearms, municipal prosecutors are not so
exempted. See Florida Statute .790.25 .(d) . Moreover, it
should be noted, as a matter of historical interest, both
Richard Gerstein and Janet.Reno have had very strict policies
concerning the carrying of.firearms by Assistant State
Attorneys. Both require their. Assistants to adhere to the
laws as applied to ordinary citizens. Ms. Reno permits
Carrying Concealed: Firearms only when an Assistant is on
Official Business (eg. presence at a homicide scene), and
then, only if the Assistant has qualified under, police
standards at the firing range.
Therefore, Municipal Prosecutors have no more rights with
respect to weapons than does the ordinary citizen. Florida
Statutes 790.01, 790.05,790.06, and 790.25 should be
consulted for these rights and obligations. Additionally,
City Code Ordinance 81-2258 applies to actions on Miami
Beach.
