A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, DIRECTING THE CITY ADMINISTRATION
TO CONDUCT, OR CONTRACT TO HAVE CONDUCTED, A PHASE 2
TRAFFIC STUDY EVALUATION OF ALL REMAINING SCHOOLS WITHIN
THE CITY LIMITS, PURSUANT TO FLA. STAT. § 316.008(9), TO
DETERMINE IF ANY ADDITIONAL SCHOOL ZONES CONSTITUTE A
HEIGHTENED SAFETY RISK THAT WARRANT ADDITIONAL TRAFFIC
ENFORCEMENT MEASURES SUCH AS THE POTENTIAL INSTALLATION
OF SPEED DETECTION SYSTEMS.
WHEREAS, a speeding vehicle in a school zone presents a real hazard not only to the
general public's health and safety (including the driver of the vehicle), but also specifically to
children who are arriving at or departing from school; and
WHEREAS, Fla. Stat., § 316.008(9) authorizes municipalities to install, or contract with a
vendor to install, speed detection systems ("SDS Systems") to enforce school zone speed limits
for violations in excess of 10 miles over the posted speed limit during certain school days and
times; and
WHEREAS, prior to installing and utilizing SDS Systems to enforce eligible school zone
speeding violations, municipalities are required to first determine whether each school zone
constitutes a heightened safety risk that warrants additional traffic enforcement measures, based
upon traffic data or other evidence, prior to the installation and operation of an SDS System in
any school zone; and
WHEREAS, the City previously contracted with The Corradino Group to conduct and
complete a Phase 1 speed evaluation study(of seventeen (17)school zones spread across eight
(8)different schools in the City) relating to the potential implementation of SDS Systems in those
school zones; and
WHEREAS, on April 3, 2024, the Mayor and City Commission adopted Ordinance No.
2024-4613, which authorized the placement, installation, and operation of SDS Systems in six(6)
school zones spread across five (5) different schools in the City and created procedures for the
issuance of notices of violation for school zone speeding violations; and
WHEREAS,the enforcement of speed limits in school zones with law enforcement officers
(as opposed to speed detection cameras) can be difficult due to staffing issues as well as during
the time in which a law enforcement officer stops and cites a speeding driver, other motorists can
commit speeding violations and escape the issuance of a citation; and
WHEREAS, the City Commission finds it to be in the best interest of the public health,
safety, and welfare of the residents of the City of Miami Beach to conduct a Phase 2 traffic study
evaluation of all remaining schools within the City limits, pursuant to Fla. Stat. 316.008(9), to
determine if any other school zones constitute a heightened safety risk that warrant additional
traffic enforcement measures such as speed detection systems
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, hereby direct the City
Administration to conduct, or contract to have conducted, a Phase 2 traffic study evaluation of all
remaining schools within the City limits, pursuant to Fla. Stat. § 316.008(9), to determine if any
additional school zones constitute a heightened safety risk that warrant additional traffic
enforcement measures such as the potential installation of speed detection systems.
