This Amendment No.1 ("Amendment)to the Agreement (the "Agreement")dated August 1,2024,
by and between the City of Miami Beach,Florida,a municipal corporation organized and existing
under the laws of the State of Florida,having its principal place of business at 1700 Convention
Center Drive,Miami Beach,Florida 33139 ("City"),and Young Musicians Unite Inc.,a Florida Not
For Profit Corporation,having its principal place of business 1260 NW 29 Street #103,Miami
Beach,FL 33143,is entered into this day of 12/5/2024 1 9:57 A0fEffective Date"):
RECITALS:
WHEREAS,on August 1,2024,the City and Young Musicians Unite Inc.executed
the Agreement to provide After-School Enrichment services to Miami Beach Fienberg
Fisher K-8 and Biscayne Beach Elementary School ("CMB Program Schools"),as set forth
in Exhibits "A"through of the Agreement;and
WHEREAS,in consideration of the Services to be provided pursuant to the
Agreement,the City and CMB Program Schools would like to expand programming into
Miami Beach Fienberg Fisher K-8 and Miami Beach Nautilus Middle to provide additional
programming;and
WHEREAS,on May 15,2024 the Mayor and Commission passed Resolution No.
2024-33017 to amend Resolution No.2023-32686 to increase Afterschool Enrichment
funding at Miami Beach Fienberg Fisher and Miami Beach Nautilus Middle School to
implement a Miami Beach Music Program ("Rock Ensemble")in the amount of $25,000
for both schools;and amend Resolution No.2022-32064 to increase grant funding by
$20,000 for the Miami Beach Senior High School Rock Ensemble Afterschool Enrichment
program;and
WHEREAS,on September 26,2024,the Mayor and Commission reviewed and
passed the annual budget,approving the funding for this educational enhancement for FY
2025 and each year thereafter pending funding approval annually.
NOW THEREFORE,in consideration of the mutual promises and conditions
contained herein,and other good and valuable consideration,the sufficiency of which is
hereby acknowledged,the City and Young Musicians Unite Inc.hereby agree to amend
the Agreement as follows:

The above recitals are true and correct and are incorporated as part or this
Amendment.

The Agreement is hereby modified (deleted items struck through and inserted
items underlined)as follows:
(a)The first full paragraph of ARTICLE II (GENERAL CONDITIONS),Section
3.(Project Description)is deleted in its entirety and replaced with the
following:
Project Description:The City has provided funding to Grantee to develop and
manage the Rock Ensemble (the "Program")at Miami Beach Fienberg Fisher
K-8,Miami Beach Nautilus Middle School,and Miami Beach Senior High
School,as described in the Project Description set forth in Composite Exhibit
1,incorporated herein by reference and attached hereto (the "Project").The
Grantee may only use the Grant for the purposes that are specifically described
in the Project Description,attached hereto as Composite Exhibit 1.All
expenditures will be subject to the terms of this Agreement and,as specified
in the Grant Project Budget attached hereto as Exhibit 2.Line item changes to
said Grant Project Budget shall not exceed ten percent (10%)per category per
school,and shall.in no event,exceed the total amount of $100,000,with the
$70,000 allocated for the three school sites below pursuant to Resolution
number 2024-33017:
•$25,000 allocated for Miami Beach Fienberg Fisher K-8
•$25,000 allocated for Miami Beach Nautilus Middle School
•$20,000 allocated for Miami Beach Sr.
Amendments to the Grant Project Budget in Exhibit 2 shall not be permitted
without the prior written consent of the City Manager or Contract Administrator.
Said requests shall be made in writing,detailing,and justifying the need for
such changes.
Funding per Resolution 2024-33017 may only be utilized during the periods
indicated below:
•Miami Beach Sr.High:2024-2025 School Year (October 1,2024 -June
5,2025),and the start of the 2025-2026 School Year (August 1,2025
-September 30,2025)
•Fienberg Fisher K-8 Center.2024-2025 School Year (October 1,2024
-June 5,2025),and the start of the 2025-2026 School Year (August 1,
2025 -September 30,2025)
•Miami Beach Nautilus Middle:.2024-2025 School Year (October 1,
2024 -June 5,2025),and the start of the 2025-2026 School Year
(August 1,2025 -September 30,2025)
Prior to Grantee using any funds starting in August of each school year,
Grantee shall submit the Affiliating Agreement between Grantee and M-
DCPS clearing identifying Grantee's authorization to provide the programs
at the public schools contemplated under this Agreement.

Program Description
THE FOLLOWING YOUNG MUSICAN UNITE STAFF WILL OVERSEE MIAMI BEACH Sr.

1.Director (2017-Current)-Sammy Gonzalez
CEO of Young Musicians Unite,Inc.Owner of Miami Music Productions,Co-Founder of the
Wynwood School of Music,and Director of The Rock Ensemble
One of Miami's most established musicians and educators in the Miami music scene,Sammy
Gonzalez played his first guitar concert at ten years old and grew to become an accomplished
classical guitarist and bassist for Jacobs Ladder,a nationally recognized rock band.
As a musician,Sammy has played nearly 1000+concerts,gone on 15 U.S.tours,and landed
spots at SXSW music festival,Van's Warped Tour,and national Film Festivals.He owns and
operates The Bull Productions Recording Studio in Miami,where he produces,records,and
mixes artists from all genres and backgrounds.As first chair in the Miami Beach Classical Guitar
Quintet,Sammy toured the U.S.and Japan,winning awards at both regional and national
levels.
Sammy is the President/CEO and founder of the non-profit Young Musicians Unite.Under the
leadership of Sammy,Young Musicians Unite believes that every student in Miami-Dade
deserves access to music education regardless of their socio-economic background.The
organization currently services over 3,500 students across 35 schools and has educated over
11,100 students since 2013.
Sammy is a founder at the Wynwood School of Music,an after-school and weekend music
program in the heart of Miami's art district.Giving students the opportunity to participate in
private and ensemble lessons throughout the week.Sammy also serves as the Director of the
Miami Beach Senior High School Rock Ensemble.The Rock Ensemble,founded by the late
Doug Burris in 1972,is the first school-based ensemble of its kind in our nation's history.The
student led musical group is a culmination of musicians,stage crew,and a sound engineering
team.The Rock Ensemble comes together to play classic and modern rock and lends
vocational experience to its students through engaging them in professional environments at a
young age.Many professional musicians and sound engineers have passed through the ranks
of the Rock Ensemble over its SO-year run.
As an educator,Sammy has been teaching since 2004.His students have gone on to excel in
schools such as New World School of the Arts,Harvard,NYU,Georgetown,Cornell,Vanderbilt,
and Penn State.At Miami Beach Senior High School (MBSH),Sammy participated in All State
for guitar,jazz band,and orchestra all four years.received straight superiors at solos &
ensembles,and was the schools Silver Knight Music nominee.

•Chooses the first five songs for the ensemble,audition dates,and oversees the audition

2.Assistant Director -Michael McNamee
Machael McNamee serves as Assistant Director and was an alumnus of the program Miami
Beach Senior High School Rock Ensemble under the late Doug Burris.Mac is a professional
sound engineer and has worked in many recording studios,movie sets,and produces his own
artists.He is also a guitarist and vocalist for The Macsters.
Michael's Responsibilities:
•Michael is a Miami Beach Senior High School Employee.As an employee of MBSH he
acts as the Club Sponsor for the Miami Beach Rock Ensemble.
•All field trip forms and approvals go through Michael and he submits them for approval to
the school's activities director and Principal.
•Michael is responsible for training the student sound engineers.
•Michael serves as the main chaperone for our field trips
•Michael serves as the main sound engineer for most of our performances and oversees
the students setting up and breaking down all equipment.
3.AJ Hill -Artistic Director
AJ Hill was part of the first class of the Miami Beach Rock Ensemble In 1972.AJ Hill is a world-
renowned saxophone player and vocalist for the Spam All Star's.AJ is considered one the most
sought-after live musicians in Miami.
AJ's Responsibilities:
•Oversees the structure of every practice
•Manages students'during practice
•AJ is our lead vocal coach and works with the vocalists in vocal group settings and as a
full band.
•AJ creates harmonies/parts for vocalists.AJ also records these parts on his own and
sends the files to the vocalists separately so they can learn their unique parts.
4.Young Musicians Unite Team:
Program Director -Oversees all programs across YMU's 29 schools
Regional Director -Oversee the Miami Beach and central Miami school day to day activities.
Production Assistant -Prepares for shows and the coordination of all performance equipment
Operations Support -Oversees all intricate details and day to day logistics for YMU's 29 schools
and 114 classrooms.
Performance Stagehands -Support staff for performances.Set up and breakdown.
Performance Chaperons -Oversee students.Are L2 cleared and are responsible for them the
whole time.

Afterschool Rock Ensemble Program Overview
(Miami Beach Fienberg Fisher K-8 and Miami Beach Nautilus Middle}
The Rock Ensemble program offers students a dynamic opportunity to explore music through hands-
on learning and live performance.In a collaborative environment,students will hone their musical
skills and creativity,guided by experienced music and vocal directors.This program is designed for
both beginners and experienced musicians,giving everyone a chance to contribute,learn,and
perform.
How It Works
•Weekly Rehearsals:Students will meet after school for rehearsals,practicing as a band
under the guidance of our Music Director and Vocal Director.
•Instrumental and Vocal Focus:Rehearsals will focus on developing both instrumental and
vocal skills.Students can play a variety of instruments such as guitar,bass,drums,and
keyboards,while vocalists will work on harmonies,both as soloists and in groups.
•Song Selection:The ensemble will collaboratively choose a mix of rock classics and
modem hits,allowing everyone to participate in the selection process.
•Collaboration and Creativity:Students will work together as a band,contributing to song
arrangements and exploring musical dynamics,timing,and stage presence.

The Organization agrees it shall provide supervision and security for all students participating in their program
and/or who are under the Organization's care throughout the duration of the program.The Organization agrees
the School Board has no responsibility for supervision or care for students throughout the duration of the
program.
As applicable,Organization shall obtain a signed Waiver,Release &Hold Harmless COVID-19 and Voluntary
Third-Party Extracurricular Activities Summer and School Year,attached hereto and incorporated herein,from
all participants.
If Organization provides services on Campus,Organization shall complete a Facilities Usage Agreem ent,
available at http://financialaffairs dadeschools.neu#!/full Width/1667 and provide a copy of the executed
Facilities Usage Agreement to the school site principal prior to beginning performance.
If Organization provides childcare services,including but not limited to before and after-schoo l childcare,
Organization shall complete the Department of Children and Families (DCF)licensing questionnaire,available
at https://www.myflfamilies.com/service-p rograms/child-care/child-care-licens ure.shtml,and provide the
school site principal with a copy of DCF's response notifying the Organization of its need (or exemption)for a
DCF childcare license prior to beginning performance.
CANCELLATION
Thus agreem ent may be term inated by either party by giving thirty (30)days written notice to the other party
In the event that a danger to student health,safety or welfare exists,at the sole discretion of the School Board,
this contractual agreement will be terminated immediately
INDEMNIFICATION
To the fullest extent permitted by law,the Organization shall indemnify,hold harmless,and defend the School
Board,and its employees ("Indemnitees")from and against all claims,liabilities,damages,and losses,arising
out of,resulting from or incidental to Organization's performance under this Agreement or to the extent caused
by negligence,recklessness,or intentional wrongful conduct of the Organization or other persons employed or
utilized by the Organization in the performance of this Agreem ent.In the event of a third-party claim,the
Organization agrees,at its own expense,and upon written request by the School Board,to defend any suit,
action or demand brought against the School Board on any claim or demand arising out of,resulting from,or
incidental to Organization's performance under this Agreement.The remedy provided to the Indemnitees by
this indemnification shall be in addition to and not in lieu of any other remedy available under the Agreement
or otherwise.This indemnification obligation shall not be diminished or limited in any way by any insurance
maintained pursuant to the Agreement otherwise available to the Organization.The provisions of this Section
are intended to require the Organization to furnish the greatest amount of indemnification allowed under Florida
law.To the extent any indemnification requirement contained in this Agreement is deemed to be in violation
of any law,that provision shall be deemed modified so that the Organization shall be required to furnish the
grea test level of indemnification to the Indemnitees as was intendcd by the parties hereto.Failure to honor a
request by the School Board for complete indemnification constitutes a material breach of this Agreement and
may result in immediate termination of not only this Agreement,but any and all other Agreements that the

parties may have together,at the sole option of the School Board.If the Organization is a state agency or
subdivision as defined in section 768.28,Florida Statutes,nothing herein shall be construed to extend the
Organization's liability beyond that provided in section 768.28,Florida Statutes.
GOVERNING LAW &VENUE
This agreement shall be construed in accordance with the laws of the State of Florida.Any dispute with respect
to this agreement is subject to the laws of Florida,venue in Miami-Dade County.Each party shall be
responsible for its own attorney's fees and costs incurred as a result of any action or proceeding under this
agreement.
REGULATIONS &ORDINANCES
The Organization shall comply with all applicable laws,ordinances,codes,policies,rules and regulations of
the United States Center for Discasec Control and Prevention,School Board,Federal,State,and Local
governments for performance of any services under this Agreement.The Organization shall be fully and
completely responsible for ensuring full and complete compliance with all Center for Disease Control,Federal,
State,and Local regulations regarding the novel coronavirus known as COVID-19 and related conditions as
may be amended from time to time.
FORCE MA.JEURE
If,as a result of an act of force majcure,including without limitation,an act of God,war,internal unrest and
upheaval,hurricane or natural disaster,hurricane warning or hurricane watch issued by the US National
Weather Service,tropical storm watch or tropical storm warning issued by the US National Weather Service,
riot,labor dispute,strike,threat thereof,intervention of a government agency or instrumentality,pandemic,
epidemic,public health emergency,local,state or national emergency declarations,or other occurrence beyond
the reasonable control of either Party,either School Board or Organization is hindered in performing its
obligations hereunder or is thereby rendered unable to perform its obligation hereunder,then,in such cvent,
that Party shall have the right,upon notifying the other of the occurrence of force majeure as herein defined,
to suspend or postpone performance of the activity until the event of the force majeure has passed.In the event
that either Party is unable to perform for a period in excess of six (6)months at any time after the
commencement date of this Agreement,the other Party may,at its option terminate the Agreement.In the case
that conditions improve and warrant the resumption of activities and deployment of services,School Board
and Organization would have at least one (d)month to coordinate the resumption of activities per this
Agreement andior will collaborate together to prepare a contingency plan to ensure continuity of services.
CONFIDENTIALITY OF STUDENT RECORDS
Organization understands and agrees that it is subject to all School Board policies relating to the confidentiality
of student information.Organization acknowledges and agrees to comply with the Family Educational Rights
and Privacy Act ("FERPA")and all state and federal laws relating to the confidentiality of student records.
ACCESS T O RECORDS/FLORIDA'S PUBLIC RECORDS LAWS
Organization understands the broad nature of these laws and agrees to comply with Florida's Public Records
Laws and laws relating to records retention.The Organization shall keep and maintain public records required
by the School Board to perform the service.The Organization shall keep records to show its compliance with
program requirements.Organizations and subcontractors must make available,upon request of the School
Board,a Federal grantor agency,the Comptroller General of the United States,or any of their duly authorized
representatives,any books,documents,papers,and records of the Organization which are directly pertinent to
this specific Agreement for the purpose of making audit,examination,excerpts,and transcriptions.Upon
request from the School Board's custodian of public records,provide the School Board with a copy of the

requested records or allow the records to be inspcctcd or copied within a reasonable time at a cost that does not
excee d the cost provided in this chapter or as otherwise provided by law.Organization shall ensure that public
records that are exempt or confidential and exempt from public records disclosure requirements are not
disclosed except as authorized by law for the duration of the contract term and following completion of the
contract if the Organization does not transfer the records to the public agency.The Organization shall retain all
reco rds for five (5)years after final payment is made or received and all pending matters are completed pursuant
to Title 34,Sec tions 80.36(b)(I).Upon completion of the contract,transfer,at no cost,to the School Board all
public reco rd s in po ss es sion of th e O rg aniza tion or kee p and m aintain public reco rds required by the School
Board to per form the serv ice.If the O rga niza tion trans fe rs all public re co rd s to the School Board upo n
co m pletion of the co ntract,the Organiza tion shall des tro y any du plicate public reco rds th at are exem pt or
confiden tia l and exem pt fro m public re co rd s disclosure req uire m ents.If the Orga niza tion keeps and maintains
public rec ords upo n co m plet ion of the contra ct ,the Organization shall meet all applicable requirements for
ret aining public records.All records stored electronically must be provided to the School Board,upon request
from the School Board's custodian of public records,in a format that is compatible with the information
technology systems of the School Board.

BACKGROUND SCREENING
In accordance with the requirements of $1012.465,$1012.32 and $1012.467,Florida Statutes,and School
Board Policies 8475,I121.01,3121.01 and 4121.01 as amend ed from time to time Organization agrees that
Organization and all of its employees who provide or may provide serv ices under this Contract will complete
criminal history check s,and all background screening requirements,including level 2 screening requirements
as outlined in the above-referenced statutes and School Board Policies prior to providing services to The School
Board of Miami-Dade County.
Additionally,Organization agrees that each of its employees,representatives,agents,subcontractors or
suppliers who is permitted access on school grounds when students are present,who has direct contact with
students must mcct level 2 screening requirements as described in the above-referenced statutes and School
Board Policies.
A Non-Instructional Contractor who is exempt from the screening requirements set forth in $1012.465,
$1012.468 or $1012.467,Florida Statutes,is subject to a search of his or her name or other identifying
information against the registration information regarding sexual predators and sexual offenders maintained by
the Department of Law Enforcem ent under $943.043 and the national sex offender public registry maintained
by the United States Department of Justice.
Further,upon obtaining clearance by School Board,Organization shall obtain a Florida Public Schools
Contractor badge,which shall be worn by the individual at all times while on School Board property when
students arc present.

Organization agrees to bear any and all costs associated with acquiring the required background screening --
including any costs associated with fingerprinting and obtaining the required photo identification Florida Public
Schools Contractor badge.Organization agrees to require all its affected employccs to sign a statement,as a
condition of employment with Organization in relation to performance under this Agreement,agreeing that the
employee will abide by the heretofore described background screening requirements,and also agreeing that the
employee will notify the Organization/Employer of any arrest(s)or conviction(s)of any offense enumerated in
School Board Policies 8475,1121.0I,3121.01 and 4121.01 within 48 hours of its occurrence.Organization
agrees to provide the School Board with a list of all its employees who have completed background screening
as required by the above-referenced statutes and who meet the statutory requirements contained therein.
Organization agrees that it has an ongoing duty to maintain and update these lists as new employees are hired
and in the event that any previously screened employee fails to meet the statutory standards.Organization
further agrees to notify the School Board immediately upon becoming aware that one of its employees who
was previously certified as completing the background check and meeting the statutory standards is
subsequently arrested or convicted of any disqualifying offense.Failure by Organization to notify the School
Board of such arrest or conviction within 48 hours of being put on notice and within five (S)business days of
the occurrence of qualifying arrest or conviction,shall constitute grounds for immediate termination of this
Agreement.
Parties further agree that failure by Organization to perform any of the duties described in this section shall
constitute a material breach of the Agreement entitling the School Board to terminate this Agreement
immediately with no further responsibility to make payment or perform any other duties under this Agreement.
INSURANCE
If the Affiliating Agreement is for Educational Services at On-Campus Locations,prior to commencing the
services under this agreement,the Organization shall obtain and maintain without interruption Commercial
General Liability Insurance with limits of no less than $300,000 per occurrence.If the Organization provides
transportation services of students under this agreement,the Organization shall obtain and maintain without
interruption Automobile Liability Insurance with limits of no less than $300,000 combined single limit."The
School Board of Miami-Dade County,Florida"shall be shown as certificate holder and additional insured with
regard to the liability insurance.As evidence of the insurance coverage,the Organization shall furnish a fully
completed certificate of insurance signed by an authorized representative of the insurance company providing
such coverage.The evidence of insurance shall provide that the Board be given no less than thirty (30)days
written notice prior to cancellation.The Notice of Cancellation shall be by Endorsement in the policies.Until
such time as the insurance is no longer required to be maintained by the Organization,the Organization shall
provide the Board with renewal or replacement evidence of the insurance no less than thirty (30)days before
the expiration or termination of the insurance for which previous evidence of insurance has been provided.If
the Organization is a state agency or subdivision as defined by section 768.28,Florida Statutes,the
Organization shall furnish,upon request,written verification of the liability protection in accordance with
section 768.28,Florida Statutes.If the Organization retains Student Data Organization shall maintain Cyber
Liability insurance with limits of not less than $I,000,000 for each wrongful act,and Liability for security or
privacy breaches,including loss or unauthorized access to the Board's data;Costs associated with a privacy
breach,including consumer notification,customer support/crises management,and costs of providing credit
monitoring services;Expenses related to regulatory compliance,government investigations,fines,fees

Florida statutes establish the Florida Workers'Compensation Insurance Guaranty Association Act.
On behalf of the Florida Workers'Compensation Insurance Guaranty Association (Association),we are required to bill
and collect a surcharge for all workers compensation and employers liability insurance policies as prescribed by order
of the Florida Office of Insurance Regulation.

FLORIDA TERRORISM RISK INSURANCE PROGRAM REAUTHORIZATION
ACT ENDORSEMENT
This endorsement addresses requirements of the Terrorism Risk Insurance Act of 2002 as amended by the
Terrorism Risk Insurance Program Reauthorization At of 2019.
Definitions
The definitions provided in this endorsement are based on and have the same meaning as the definitions in the
Act.It words or phrases not defined in this endorsement are defined in the Act,the definitlons in the Act will apply.
1."At"means the Terrorism Risk Insurance At of 2002,which took effect on November 26,2002.and any
amendments,including any amendments resulting from the Terrorism Risk Insurance Program
Reauthorization Act of 2019.
2."Act of Terrorism means any act that is certified by the Secretary of the Treasury,in consultation with the
Secretary of Homeland Security,and the Attorney General of the United States as meeting all of the
following requirements:
a.The act is an act of terrorism.
b.The at ls violent or dangerous to human lite,property,or infrastructure.
•The act resulted in damage within the United States,or outside of the United States in the case of the
premises of United States missions or certain air carriers or vessels.
d.The act has been committed by an individual or individuals as part of an effort to coerce the civilian
population of the United States or to influence the poly or affect the conduct ot the United States
Govemment by coercion.
3."Insured Loss"means any loss resulting from an act ot terrorism (including an act of war,in the case of
workers compensation)that is covered by primary or excess property and casualty insurance issued by
an insurer if the loss occurs in the United States or at the premises of United States missions or to certainaircarriersorvessels.
4."Insurer Deductible"means,lcr the paricd beginning on January 1,2021,and ending on December 31,
2027,an amount equal to 20%of our direct earned premiums,during the immediately preceding calendar
year.
Lum ltatlon ot Llablllty
The At may limit our liability to you under this policy.If aggregate Insured Losses exceed $100,000,000,000 in a
calendar year and if we have met our Insurer Deductible,we may not be liable for the paymen t of any portion of
the amount of Insured Losses that exceeds $100,000,000,000;and for aggregate Insured Losses up to
$100,000,000,000,we may only have to pay a pro rata share of such Insured Losses as determined by the
Secretary of the Treasury.
Policyholder Disclosure Notice
1.insured Losses would be partially reimbursed by the United States Government.It the aggregate industry
Insured Losses occurring in any calendar year exceed $200,000,000,the United States Government
would pay 80%of our Insured Losses that exceed our insurer Deductible.
2.Notwithstanding item 1 above,the United States Government may not have to make any payment under
the Act for any portion of Insured Losses that exceed $100,000,000,000.

WHEREAS,the Science,Technology,Engineering,and Mathematics ("STEM")to Science,
Technology,Engineering,Arts,and Mathematics ("STEAM")movement has been taking root
over the past several years and is surging forward as a positive model of action to truly meet the
needs of a 21st-century economy;and
WHEREAS,on July 23,2021,the Mayor and City Commission adopted Resolution No.
2021-31776 extending the current agreement with the Bass for an additional year through
September 30,2023,in the total sum not to exceed $372,000 annually,for an initial term of one
(1)year,with two (2)one-year renewal terms,at the option of the City,and subject to funding
appropriation and approval by the.City Commission during the budgetary process for each fiscal
year;and
WHEREAS,at the April 19,2024,Finance and Economic Resiliency Committee Meeting,
members unanimously supported the extension of the STEAM Plus program to begin in
September of each school year beginning in the 2024-25 school year within the existing budget
of $372,000;and
WHEREAS,over the past several years,the City of Miami Beach has expanded free
afterschool enrichment programs at Miami Beach Fienberg Fisher K-8,Biscayne Beach
Elementary,and Miami Beach Senior High Schoof to support various components of the Miami
Beach Education Compact;and

WHEREAS,on March 14,2022 the Mayor and Cities Commission adopted Resolution No.
2022-32064 to provide funding for the Miami Beach Rock Ensemble afterschool program at Miami
Beach Senior High School,through a grant to Young Musicians Unite,Inc.for the 2021-22 school
year and each year thereafter,in an amount not to exceed $30,000;and
WHEREAS,at the April 19,2024,Finance and Economic Resiliency Committee meeting,
members unanimously supported the expansion of the City's afterschool enrichment program to
provide a music program (Rock Ensemble)In an amount of $25,000 each for Miami Beach
Fienberg Fisher K-8 and Miami Beach Nautilus Middle School and to increase the grant amount
for the Miami Beach Rock Ensemble at Miami Beach Senior High School by an additional $20,000
for the 2024-2025 school year and each year thereafter,subject to funding approval during the
City's annual budgeting process.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH,FLORIDA,that the Mayor and City Commission hereby approve
and authorize the City Manager to execute the recommendation of the Finance and Economic
Resiliency Committee,made at its April 19,2024 meeting,to amend the following Resolutions;
amend Resolution No.2023-32686 to increase Afterschool Enrichment funding at Miami Bea ch
Fienberg Fisher and Miami Beach Nautilus Middle School to implement a Miami Beach Music
Program (Rock Ensemble)in the amount of $25,000 for both schools;amend Resolution No.

RECOMMENDATION
Accept the recommendation of the Finance and Economic Resiliency Committee at its April 19,2024 meeting to allocate unused
funding for the STEAM Pus program from FY 2024 for school year 2023-2024 to fund STEAM PIus activities in school year 2024-
2025 exclusively for the months of August and September of 2024.STEAM Plus funding allocation is sufficient to fund recurring
activities aligned to the fiscal year going forward.
Prioritize funding during the FY 2025 budget process to expand the Miami Beach Rock Ensemble Afterschool Enrichment
programming to Miami Beach Nautilus Middle School and Miami Beach Fienberg Fisher K-8 Center and increase funding for the
Miami Beach Rock Ensemble afterschool enrichment by $20,000 beginning in school year 2024-25.Programming must be
available to public,private and charter school students.Total requested additional amount for the Miami Beach Rock Ensemble
afterschool enrichment not to exceed $70,000.
BACKGROU ND/HISTORY
This item was referred for a discussion at the February 21,2024 Commission Meeting by Commissioner Tanya K.Bhatt,to
implement programming to be included in the 2025 budget planning process (Attachment A).
STEAM PIus
ln January 2008,the City of Miami Beach entered an Education Compact with Miami-Dade County Public Schools to enhance
learning opportunities for youth.The Compact reflects the des ire of the Miami Beach community to support excellence in the City's
public schools and currently addresses and supports the following priority areas:Teacher Recruitment/Retention;Communication;Parental Involvement/Family Support;Youth and Community Engagement;Health and Well-Being;Student Achievement;Safety;
and Technology.
On April 15,2015,the Mayor and the City Commission adopted Resolution No.2015-28997,which directed the Administration to
expand the Compact to address the following areas:Early Leaming;Extracurricular!Choice Offerings;and Afterschool
Programming.
On January 16,2019,the Mayor and the City Commission adopted Resolution No.2019-30690,authorizing the City Manager and
City Clerk to execute a grant agreement with the Friends of the Bass Museum,Inc.for the implementation of a Science,
Technology,Engineering,Arts,and Mathematics (STEAM)Plus program with Miami Beach public schools and local cultural
institutions.The program is referred to as a STEAM Plus initiative and is intended to inspire students to engage and prepare in
science,technology,engineering,arts,and mathematics to work with cultural anchors to infuse theatre,visual arts,dance,and
music in traditional class offerings.
The below table provides information on the utilization of the STEAM Plus program at an annual budget of $372,000 since
inception:

Aftersch ool Enrichment
Over the past several years,the City of Miami Beach has expanded free afterschool enrichment programs at Miami Beach
Fienberg Fisher K-8,Biscayne Beach Elementary,and Miami Beach Senior High School to support various components of the
Miami Beach Education Compact.The City of Miami Beach offers the Miami Beach Rock Ensemble as a free afterschool
enrichment at Miami Beach Sr.High School.
Resolution No.2021-31537 authorized the City to accept donations from Young Musicians Unite Inc.in support of the City of
Miami Beach's afterschool enrichment Rock Ensemble program at Miami Beach Senior High School.
Resolution 2022-32064 authorized a grant to Young Musicians Unite,Inc.in an amount not to exceed $30,000 to support the Miami
Beach Sr.High School Rock Ensemble afterschool program for the 2021-22 school year and subsequent school years.
ANALYSIS
STEAM Plus
The STEAM Plus program continues to expand and provide enrichment to Miami Beach youth.The following Miami Beach public
schools are participating in the STEAM PIus program:

The Office of Education and Performance Initiatives reached out to our public school partners to gauge interest in a programming
start date of September each school year.School site administrator feedback received indicated an overwhelming interest in
program alignment to the school year calendar with an earlier start date than previously programmed by the initiative managers,
Friends of the Bass Inc.As such,the current agreement will be amended to allow for a start date of September each school year
utilizing the existing budget of $372,000.
Afterschool Enrichment
The Office of Education and Performance Initiatives inquired as to interest in a Miami Beach Rock Ensemble as an afterschool
enrichment at Miami Beach Fienberg Fisher K-8 and Miami Beach Nautilus Middle School.School site administration indicated an
interest in a free Miami Beach Rock Ensemble afterschool enrichment as par of the existing free afterschool program currently
underway.
Current funding for the City's free afterschool enrichment at Miami Beach Fienberg Fisher K-8 and Miami Beach Nautilus Middle
schools do not include funding for a Miami Beach Rock Ensemble afterschool enrichment class.

Biscayn e Beach Elementary also offers free afterschool enrichment through the City at an annual cost of $30,000 per school year.
The Office of Education and Performance Initiatives and the Procurement Department issued a Request for Information (RFI)for
after-school enrichment instruction that ls STEAM (Science,Technology,Engineering,Arts and Math)driven.The intent of the RFI
was to Identify additional potential after-school enrichment program providers.The deadline to submit information was April 8,
2024.A copy of the RFI request and responses is provided (Attachment C).

Our Partnership
Young Musicians Unite is thankful for the generous support of the City of Miami Beach.Over the
last 6 years,YMU has impacted over 2,500 students in four Miami Beach schools through the
City's STEAM+Arts Programs,has successfully implemented over 90 youth concerts for Miami
Beach residents and has partnered with the city to run and redevelop the Miami Beach Senior
High Rock Ensemble.As you may know,the Rock Ensemble was founded by the late Doug
Burris in 1972 and was the first school rock ensemble in American history.
My name is Sammy Gonzalez and I am the CEO/Founder of Young Musicians Unite,founder of
the Wynwood School of Music,and current Director of the Miami Beach Rock Ensemble.I
personally attended North Beach Elementary,Nautilus Middle School and Miami Beach Senior
High School.At Miami Beach Senior High School,I was a member of the Rock Ensemble,The
Classical Guitar Ensemble,and was a Silver Knight Nominee for the school.Doug Burris was
like a father to me and over the last 3.5 years I have been focused on revitalizing the Rock
Ensemble,increasing its relevance to the students and our community.Over the years,we have
been successful in partnering and performing with The City of Miami Beach,The North Beach
Bandshell,The Bass Museum and New World Symphony.

REQUESTS;
1)STEAM
a)Young Musicians Unite has been working with the City of Miami Beach on the
STEAM+program for the past 6 years,2018-current.
b)Our programs are located at Nautilus Middle School,North Beach Elementary,
Fienberg Fisher K-8,and Miami Beach Senior High School
c)An issue with the program is that funding doesn't kick in until November,which
provides issues with the schools and students not having a teacher for August,
September,and October.North Beach Elementary,Nautilus Middle School,
Feinberg Fisher,and Miami Beach Senior High School have a 30 year history of
strong guitar teachers and programs.Currently the only guitar teacher is at North
Beach Elementary and the rest of the schools depend on Young Musicians Unite
to come in through STEAM+funding to provide programming.
i)Students at Miami Beach High School and Feinberg had to wait until
November before they were able to actually use their guitars in their class
due to the funding starting late into the semester.
ii)Due to this issue,the teacher at Nautilus decided to cut the 200 student
guitar program for the first time in 30 years.He wants the program to
retum but needs the program to start when school starts.
d)Our budget for this 23/24 school year is $72,000 with 515,1.5 hour classes this
school year.
i)If we were able to start programming on the first day of school our budget
would have been $91,904 tor 704,1.5 hour classes.So for an extra
$19,904 we would be able to give students the consistency in their
programming they deserve and also add in an extra 189 classes of music
across Miami Beach schools.
e)We recommend that funding goes from November to October 31st to account for
the budget terms.
2)The Miami Beach Rock Ensemble •We are looking for an increase in funding due
to an increase in surveys and inflation.Funding currently stands at $30,000 per
year and our budget is $129,517 per year.
a)The Rock Ensemble,founded by the late Doug Burris in 1972,is the first school
based ensemble of its kind in our nation's history.The student-led musical group
is a combination of musicians,stage crew and a sound engineering team.The
Rock Ensemble comes together to play classic and modern rock and lends
vocational experience to its students through engaging them in professional
environments at a young age.Many professional musicians and sound engineers
have passed through the ranks of the Rock Ensemble over its 52 year run.I'm
proud to note the achievement and success of the groupand our partnership

1.Introduction.The City of Miami Beach develops and implements free after-school enrichment
programming for students in grades 2 through 12 at local schools in Miami Beach with limited access to
STEAM (Science,Technology,Engineering,Arts,and Mathematics)activities.Programming is offered after
school onsite at partner schools.This program is a zero-cost program for all participating families.
2.Purpo se.The Education Initiatives team is issuing this Request of Information (RFI)for after-school
enrichment instruction that is STEAM (Science,Technology,Engineering,Arts and Math)driven.The intent
of the RF!is to identify after-school enrichment programs and understand the educational initiatives
available to Miami Beach students.Firms that believe they possess the processes,experience,and
capacity to provide such programs are invited to submit information in accordance with Section 3 for the
City's consideration.
Through this RFI,_the City is_not seeking and_yyil]not consider specific proposals or offers for after-
school _enrichment services.Following responses to this RFI,the City may schedule mutually
agreeable meetingswith the respondent(s)to clarify any questions that either the City or the
respondent(s)may have.
3.Questions.Any questions concerning this RFI shall be submitted in writing to Livia Barcelos at
liyiabarcelos@miamibeachfl_goy.All responses to questions/clarifications will be sent,in the form of an
addendum,to all parties downloading the RFI.
4.Submitta l Form at.Responses should be organized as follows and include the information requested.
a.Respondent Information.Submit detailed information regarding the respondent and its team,
including but not limited to organization name,years in business/operation,principals,
headquarters,and local office details,and the primary contact for any matters relating to the RFI,
including name,position,and contact information.
b.Previous Experience.Submit detailed information regarding the respondent's previous
experience providing after-school educational programs.Include details and dates of service,the
name of the client,and the name and contact information of the client's representative.
c.Regulatory Approvals.Submit detailed information demonstrating that applicable agencies
authorized the respondent to work with children.Include all applicable licenses and permits.If
the respondent has not previously received regulatory approvals,submit a supporting
documented plan that addresses the regulatory requirements for using the respondent's product,
equipment,or processes within the local Jurisdiction.

The purpose of this Amendment to the original grant agreement is to expand programming which will provide free music
education from Young Musicians Unite to students after school for school year 2024-25.YMU develops and manages the
Miami Beach Senior High School Rock Ensemble,and will not expand to Miami Beach Fienberg Fisher K-8 and Miami Beach
Nautilus Middle School.On January 13,2021,the Mayor and City Commission adopted Resolution No.2021-31537,
authorizing the City to accept donations for performances by the City's Rock Ensemble afterschool in order to support the
needs of the Program.On March 9,2022,the Mayor and City Commission adopted Resolution No.,2022-32064,providing
funding to the Program through a grant to Young Musicians Unite,Inc.for the school year 2021-22,in an amount not to
exceed $30,000,and authorizing the City Manager and City Clerk to execute a grant agreement with YMU retroactive to the
beginning of 2021-2021 school year,and further authorizing funding for subsequent school years,in an amount not to
exceed $30,000.On May 4,2022 Resolution 2022-32139 was adopted approving and authorizing YMU to accept donations
In support of the program.On July 26,2023 Resolution No.2023-32688 was passed consolidating all Afterschool Enrichment
resolutions and further authorizing funding for subsequent school years,in an amount not to exceed $30,000.0n May 15,
