party
of the first part, hereinafter referred to as the "Owner ", and
the CITY OF MIAMI BEACH, a Florida Municipal corporation,
party of the second part, hereinafter referred to as the "City",
WIT N E SSE T H :
That for and in consideration of the mutual
covenants hereinafter set forth, the parties hereto agree
as follows;
1. The "Owner" will sell and convey and the
"City" will purchase that certain parcel of land situate,
lying and being in the City of Miami Beach, County of Dade,
State of Florida, described as follows, to wit:
The westerly three (3) feet of
Lot Two (2), Block Seven-A (7A), of
AMENDED GOLF COURSE SUBDIVISION,
according to the Plat thereof, recorded
in Plat Book 6, at page 26, of the
Public Records of Dade County, Florida.
2. The "Owner" will, within twenty (20) days
from the date hereof, furnish to the "City" an abstract of
title showing the "Owner's" title to be good and marketable.
3. The "Owner" will convey the said land to
the "City" by good and sufficient warranty deed, free and clear
of all encumbrances, except restrictions of record, zoning
ordinances of the City of Miami Beach, Florida, such municipal
improvement liens as may be pending but not certified at the
time of the closing of the transaction contemplated hereby,
and taxes for the year 1956.
4. The "City" agrees to pay to the "Owner "as the
full purchase price of said land the sum of Two Hundred Ninety-
Five Dollars ($295.00) cash, and agrees to transplant at its

own cost and expense all existing shrubbery situate upon the
parcel of land which is hereby agreed to be sold and conveyed
in accordance with the directions and instructions of the "Owner"
5. The "City" agrees that no municipal improvement
liens will be claimed or assessed for any portion of the cost
of constructing a sidewalk and pavement upon the land to be
acquired~ or the lighting thereof.
6. The transaction contemplated hereby shall be
closed not later than the 2nd day of
July
, 1956.
7. This agreement shall be binding upon each of
the parties hereto, their successors~ assigns and heirs.
IN WITNESS WHEREOF, the "Owner" has
hereto
executed and delivered this agreement~ and the "City" has
caused its corporate seal to be affixed, and these presents
to be executed by its duly authorized officers and attested
to by its City Clerk, all as of the day and year first above
written.
