~UIT CLAIM DEED
THIS INDENTURE, Made this . ~ 4th

A. D. 1940, between THOMAS J. PANCOAST and KATHARINE R. PANCOAST,
his wife, of the County of Dade and State of Florida, parties of
the first part, and CITY OF MIAMI BEACH, a Municipal corporation,
of the County of Dade and State of Florida, party of the second
part;

That the said parties of the first part, for and in
consideration of the sum of Ten Dollars and other good and
valuable consideration, in pand paid by the said party of the
second part, receipt whereof is hereby acknowledged, have remised,
released and quit-claimed, and by these presents do remise, release
and quit-claim unto the said party of the second part, its
successors and assigns, forever, all the right, title, interest,
claim and demand which the said parties of the first part have in
and to the following described parcel of land, situate, lying and
being in the County of Dade, State of Florida, to-wit:

That tract or parcel of land beginning at a point
which is the southwesterly corner of Collins Avenue
and Second Street (now 26th Street); thence wester-
ly along the southerly line of said Second Street
(now 26th Street) for a distance of eighty-three
and eighty-seven one hundredths (83.87) feet to a
point; thence in a general southeasterly direction
along a circular curve deflecting to the right;
said circular curve being tangent to the said
southerly line of Second Street (now 26th Street),
having a radius of eighty (80) feet for a distance
of sixty-six (66) feet, more or less, to a point
on that line produced westerly as shown on the
Amended Map of the Ocean Front Property of the
Miami Beach ImProvement Company running south-
westerly from the said southwesterly corner of
Collins Avenue and Second Street (now 26th
Street); thence in a general northeasterly
direction along a straight line for a distance
of thirty-six (36) feet, more or less, to the
point of beginning, as said Street, Avenue, Line
and Property are shown on the Amended Map of the
Ocean Front Property of the Miami Beach ImProvement
Company, recorded in Plat Book Five (5), Pages
Seven (7) and Eight (8) of the Public Records of
Dade County, Florida.

The grantor hereby grants the right and privilege to
said City of Miami Beach to construct a concrete seawall for the
use and benefit of the grantor, approximately ten (10) feet
southerly from the second course of the above described tract,
and said grantor also hereby grants permission to the City of
Miami Beach to place fill between said above second course and
said seawall for the use and benefit of said grantor.
TO HAVE AND TO HOLD the same, together with all and
singular the appurtenances thereunto belonging or in anywise
appertaining, and all the estate, right, title, interest and claim
whatsoever of the said parties of the first part, either in law
or in 'equity, to the only proper use, benefit and behoof of the
said party of the.second part, its successors and assigns forever.
IN WITNESS WHEREOF, the said parties of the first part
have hereunto set their hands and seals the day and year first
above written.

I HEREBY CERTIFY that on this day personally appeared
before me, an officer duly authorized to administer oaths and take
acknowledgments, THrn~S J. PANCOAST and KATHP~INE R. PANCOAST, his
wife, to me well known to be the persons described in and who
executed the foregoing deed, and acknowledged before me that they
executed the same freely and voluntarily for the purposes therein
expressed.
AND I FURTHER CERTIFY that the said KATHARINE R.
PM~COAST, known to me to be the wife of the said THOMAS J. PANCOAS ,
on a separate and private examination, taken and made by and
before me, separately and apart from her said husband, did
acknowledge that she executed the foregoing deed for tIle purpose
of relinquishing, alienating and conveying all her right, title
and interest, whether dower, homestead or of separate property,
statutory or equitable, in and to the lands described therein,
and that she executed the said deed freely and voluntarily and
without any compulsion, constraint, apprehension or fear of or
from her said husband.
