Parkin'~~- City Manager SOUTH POINTE PARK -- ACCEPTANCE OF THE AMENDED DEED TO ALLOW SPECIALTY RI~FrAURANT CORPORATION TO CONSTRUCT "CRAWDADDY'S RESTAURANT" BACKGROUND: The Federal Government deeded approximately 16.5 acres of Surplus Government Property, located adjacent to Government Cut in 1980 for park purposes. The City was required to submit a schematic plan for the park development prior to the property being turned over to the City. Part of that plan showed a restaurant for the use by the park patrons. The original Deed did not address the restaurant because the City did not have a concessionaire at that time. On October 3~ 1984, the City Commission accepted the proposal submitted by Specialty Restaurant Corporation for the construction and operation of a "Crawdaddy's Restaurant" in South Pointe Park; subject to receiving approval from the Federal Government. On January 28~ 1985, the City Administration received permission from the United States Department of the Interior for Specialty Restaurant Corporation to construct a "Crawdaddy's Restaurant" in the park. On February 6~ 1985, the City Commission approved the Sublease Agreement with Specialty Restaurant Corporation for the "Crawdaddy's Restaurant"; subject to the Federal Government approval of the Sublease. The Federal Government has approved the Sublease Agreement with Specialty Restaurant Corporation. In order to construct the "Crawdaddy's Restaurant" within South Pointe Park, the Deed to the park must now be amended to allow the restaurant use of the property. The United States Department of the Interior, National Park Service, has prepared an Amended Deed to the park for the acceptance by the City Commission (copy attached). The City Attorney reviewed the Amended Deed and has approved it as to form and content. ADMINISTRATION RECOMMENDATION: The City Administration recommends that the City Commission approve the attached Resolution authorizing the City Manager to execute the Amended Deed to South Pointe Park to allow the construction of Specialty Restaurant's "Crawdaddy's Restaurant".
