81-16584 Reso &J)-~I RESOLUTION NO. 81-16584 A RESOLUTION OF THE CITY COMMISSION OF MIAMI BEACH, FLORIDA AUTHORIZING THE PUBLIC ABANDONMENT OF A PORTION OF RIGHT-OF-WAY ALONG COLLINS AVENUE BY VACATING SAME. WHEREAS, the City Commission authorized the execution of a Quit-Claim deed on the 17th day of October, 1979, in order to evidence the City's vacation of the public easement over the following described property: "That portion of original Collins Avenue immediately adjacent to the West boundary of Lot 17, Block 1, of Amended Plat of Second Ocean Front Subdivision, Plat Book 28, Page 28 of the Public Records of Dade County, Florida, more particularly described as follows: Bordered on the West by the Easterly line of Collins Avenue as realigned; bordered on the East by the Easterly line of Collins Avenue as shown on Plat Book 28, Page 28; bordered on the North by the extension Westerly of the Northerly line of said Lot 17; bordered on the South by the extension Westerly of the Southerly line of said Lot 17, all as shown on the cross-hatched portion of the attached survey - sketch of said property, which survey sketch is Exhibit "A" hereto", and WHEREAS, said vacation is best accomplished by the execution of a Resolution evidencing said vacation of the public right-of-way; and WHEREAS, the above described property has been abandoned by the public; and WHEREAS, it is deemed to be in the best interest of the City of Miami Beach to authorize said public abandonment, and to vacate all rights the public may have therein for ingress and egress, SUBJECT TO the reservation of: A utility easement for existing underground utilities. Unless expressly released by the City Engineer, in written recordable form, the grantee and its successors and assigns of this vacation of this street easement shall maintain at its expense, a surface elevation over said facilities or within three (3) feet above said facilities, or such other protection for said facilities which is acceptable to the City Engineer. The grantee shall not allow to be constructed over or within three (3) feet of said facilities any structure or improvement except landscaping or sidewalks or driveways which shall be at the existing surface elevation unless the grantee shall obtain the written consent of the City Engineer in recordable form. In the event it becomes necessary to expose said water or sewer facilities, the grantee shall bear the cost of restoring the sidewalks, driveways, or landscaping. In the event relocation of said facilities becomes necessary or desirable by reason of any action or proposed action of the grantee, the grantee shall pay the actual cost of relocation of said facilities. By accepting this vacation, the grantee binds itself and consents to the conditions herein; OFFICE OF THE CITY ATTORNEY. 1700 CONVENTION CENTER DRIVE. MIAMI BEACH, FLORIDA 33139 NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City release and relieve the above described property from any and all street easement rights vested in the public for ingress and egress in and to and across thereto, subject to the abovementioned reservations and conditions.
