Request for the City Commission to Review a Design Review Board Decision Approving
the Construction of Additions to the East and West Sides of an Existing Apartment
Building for a Total Height of Fifteen Stories (139'-6" to the Top of the Roof and 160' to
the Highest Architectural Projection), in Order to Accommodate 68 Additional Units for

Administration Recommendation: That the City Commission uphold the decision of the
Design Review Board (DRB) wherein it approved the construction of additions to the east
and west sides of an existing apartment building for a total height of 15 stories (139'-6" to
the top of the roof and 160' to the highest architectural projection), in order to
accommodate 68 additional units for the Oliver House Condominium.

ACTION: Remanded back to Design Review Board. Motion made by Vice-Mayor
Liebman; seconded by Commissioner Kasdin; vote:7-0. Compliance with Design Review
criteria items 6,7,8 not met. Areas which needs to be studied: traffic, building orientation,
shadow, view corridor. Dean Grandin to handle.

ORDER
This matter was heard by the Miami Beach City Commission on Wednesday, November 20,
1996, on appeal from an order of the City of Miami Beach Design Review Board dated September
21, 1996. The City Commission having duly considered the matter based upon the record, which
includes staff reports and recommendations, together with argument of counsel, all of which are
incorporated herein by reference, hereby finds that the Design Review Board did not base its
decision on substantial competent evidence in respect to satisfaction of criteria 18-2.A. 6, 7, and 8
of City of Miami Beach Zoning Ordinance 89-2665 ("Zoning Ordinance").
IT IS THEREFORE ORDERED by the City Commission that the application is remanded
to the Design Review Board pursuant to Section 18-2.K. of the Zoning Ordinance to determine
whether substantial competent evidence exists to satisfy the design review criteria set forth in
Sections 18-2.A. 6, 7, and 8 of the Zoning Ordinance. The action of the Commission to remand was
approved pursuant to a 7-0 vote.
