SUBORDINATION AGREEMENT
KNOW ALL MEN BY THESE PRESENTS: that the CITY OF MIAMI BEACH, the owner
and holder of that certain Notice of Lien recorded in Official Records Book 16752, at Page1499, of
the Public Records of Dade County n/k/a Miami-Dade County, Florida providing for a fine and lien
of$100.00 per day from February 27, 1995 through date of compliance and which Lien is a lien on
all or portion to that certain real property hereinafter described and set forth;
FOR AND CONSIDERATION of the sum ofTen Dollars ($10.00) and other good and
valuable consideration in hand paid, the receipt of which is hereby acknowledged, does hereby
declare that the lien of the above described Notice of Lien shall henceforth and forever be subject,
subordinate and inferior at all times to the lien of that certain mortgage held by GIBRALTAR
BANK, F.S.B., said mortgage and promissory note having been given or to be given by
MATTHEW L. LEIBOWITZ and DEBRA KRlEFF LEIBOWITZ, his wife, dated

the Public Records of Miami-Dade County, Florida, lying between the Southerly extension of the East and
West boundary lines of Lot 1, Block 1.
said mortgage and note being in the original principal sum of FOUR HUNDRED THIRTY
THOUSAND and NOll 00 Dollars ($430,000.00).
The undersigned hereby specifically agrees that the above-described mortgage owned and
held by GIBRALTAR BANK, F.S.B. is and shall be prior in lien and superior in right and dignity
at all times to the lien of the above-described Notice of Lien owned and held by the undersigned,
provided however that immediately upon the recording of a Satisfaction of the aforementioned
mortgage in favor of GIBRALTAR BANK, F.S.B. this Agreement shall become null and void and
of no further force and effect, and the lien of the said Notice of Lien owned and held by the
undersigned shall immediately revert to the same priority it had prior to the execution of this
Subordination Agreement{
