Proposed Miami City Ballet Development Agreement (for 6/23/99 City Commission
Meeting)

As you know, the City and the Ballet are continuing to negotiate an Agreement with regard
to the parties' respective parking obligations. While it was initially contemplated that the agreement
between the parties would take the form of a Development Agreement, we have concluded that the
parking issues may be addressed in a standard agreement between the City and the Ballet.
Notwithstanding the foregoing, we had initially advertised the transaction as a Development
Agreement, and the appropriate notice (including notice to adjacent property owners) was provided.
Accordingly, at this time I would recommend that the proposed Development Agreement,
currently scheduled for a time certain on the June 23, 1999, City Commission Meeting Agenda, be
withdrawn; that an appropriate announcement be made by the Administration at the commencement
at the Meeting Agenda on that date; and that a time certain be scheduled for the July 7, 1999, City
Commission Meeting for consideration of an Agreement between the City and the Ballet.
