Agreement 3/8/51 THIS AGREEMENT, Made and entered into this ~t4 day of March, A. D. 1951, by and between ABRAHAM HALPERIN, a single man, MEYER }~LPERIN and BEATRICE HALPERIN, his wife, Parties of the First Part, hereinafter referred to as the "Sellersn and CITY OF MIAMI BEACH, a municipal corporation of Florida, Party of the Second Part, hereinafter referred to as the "purchaser", WIT N E SSE T H : For and consideration of the sum of One ($1.00) Dollar, heretofore paid to the Sellers by the Purchaser, receipt of which is hereby acknowledged, and in consideration of t he covenants hereinafter set forth, the parties hereto agree as follows: 1. The Sellers will sell and convey and the Purchaser will purchase that certain parcel of land situate, lying and being in Miami Beach, Dade County, Florida, described as follows, to-wit: Lots Eight (8), Nine (9) and Thirteen (13), Block Fifty-seven (57), FISHER'S FIR ST SUB- DIVISION OF ALTON BEACH, according to the plat thereof recorded in Plat Book 2, Page 77, of the Public Records of Dade County, Florida. 2. The Sellers will convey the said land to the Purchaser by good and sufficient warranty deed, free and clear of all encum- brances except restrictions and limitations of record common to the neighborhood; zoning ordinances of the City of Miami Beach, Florida; pending City of Miami Beach liens; taxes for the year 1951 which are to be pro-rated as of the date of closing the transaction con- templated by this agreement. 3. The Purchaser agrees to pay to the Sellers as the full purchase price for said land, the sum of One Hundred Eighty-four Thousand Five Hundred and Twenty-five and nO/100 ($184,525.00) Dollars cash at the time of closing the transaction contemplated hereby. -1- OFFICE OF CITY ATTORNEY - CITY HALL - MIAMI BEACH 39, FLORIDA 4. The transaction contemplated hereby shall be closed within Forty-five (45) days from the date of this agreement. 5. The Sellers will, within twenty (20) days from the date hereof, furnish to the Purchaser an abstract of title showing Sellers' title to be good and marketable. 6. This agreement shall be binding upon both parties, the Sellers and the Purchaser, their suecessors and assigns. IN WITNESS WHEREOF, the Sellers have hereunto set their hands and seals, and the Purchaser has caused these presents to be signed in its name, by its duly authorized officers, and its corporate seal to be affixed, attested by the City Clerk of Miami Beach, Florida, as of the day and year first above written.
