Agreement 4/6/1961
THIS AGREEMENT, made and entered into this 6th
day of April, 1961, by and between GEORGE P. JACOBS and
LYDA M. JACOBS, his wife, and MIKE ACKERMAN and JOYCE ACKERMAN,
his wife, parties of the first part, hereinafter referred to
as the "Sellers" and the CITY OF MIAMI BEACH, a Florida municipal
corporation, party of the second part, hereinafter referred to
as the "City",
WIT N E SSE T H
That for and in consideration of the sum of Ten
($10.00) Dollars and other valuable consideration, in hand paid by
the "City" to the "Sellers", the receipt whereof is hereby
acknowledged by said "Sellers", and in consideration of the
mutual covenants hereinafter set forth, it is agreed between
the parties hereto as follows:
1. The "Sellers" agree to sell and the "City"
agrees to purchase, at the price and upon the terms hereinafter
set forth, that certain parcel of land situate in the City of
Miami Beach, Dade County, Florida, comprising a southerly portion
of Lots 40, 41, 42, 43 and 44 in Block 10 of OCEANSIDE SECTION
of the ISLE OF NORMANDY, according to the plat thereof, recorded
in Plat Book 25, at page 60 of the public records of Dade County,
Florida, a description of which is hereto attached, made a part
hereof, and marked Exhibit "A".
2. The purchase price for said land shall be
Seventy-five Thousand, Six Hundred and Twenty-five and 00/100
<$75, 625.00) Dollars, payable as follows: Cash at the time
of the closing of the transaction contemplated he~~y in the sum
of Twenty-two Thousand, Six Hundred Eighty-seven and 50/100
($22,687.50) Dollars and a purchase noney mortgage for the
balance of the purchase price securing the following notes: A
promissory note in the sum of Twenty-six Thousand, Four Hundred and
Sixty-eight and 75/100 ($26,468.75) Dollars, payable one year after

the date of closing of the transaction contemplated hereby~
and a promissory note in the sum of Twenty-six Thousand, Four
Hundred Sixty-eight and 75/100 ($26,468.75) Dollars payable
two years from the date of closing of the transaction contemplated
hereby, said notes to bear interest at the rate of four and one-half
(4~%) percent per annum, payable semi-annually.
3. The "Sellers" agree to furnish to the "City", within
thirty days from the date hereof, an abstract of title showing
the fee simple title to said land to be in the "Sellers It and to
be a good and marketable title and the transaction contemplated
hereby is to be closed not sooner than May 17th, 1961 nor later
than May 22nd, 1961.
4. The "Sellers" will convey the said property to the
"City" by good and sufficient warranty deed, sUbject only to
restrictions common to the neighborhood, zoning ordinances of
the City of Miami Beach, Florida, and taxes for the year 1961,
which taxes are to be pro-rated as of the date of closing of the
transaction contemplated hereby.
5. Certified municipal improvement liens are to be paid
by the "Sellers" and pending municipal improvement liens are
to be assumed by the tlCity".
IN WITNESS WHEREOF, the parties of the first part have
hereunto set their hands and seals, and the party of the second
part'has caused these presents to be signed in its name by its
duly authorized officers and its corporate seal to be hereunto
