Agreement 2/16/1953 AGREEMENT THIS AGREEMENT made and entered into thisl6th day o~ February , A. D. 1953, by and between POLLY DAVIS, a widow, party of the first part, hereina~ter re~erred to as the Owner, and the CITY OF MIAMI BEACH, a Florida Municipal Corpor- ation, party of the second part, hereina~ter referred to as the CITY. WITNESSETH: That for and in consideration of the mutual covenants hereinafter set forth, the parties agree as follows: 1. The Owner will sell and convey and the City will purchase that certain parcel of land situate, lying and being in the City of Miami Beach, County of Dade, State of , Florida, des- cribed as follows, to-wit: Southerly Twenty-Five Feet (25') of Lots Twelve (12), Thirteen (13), Fourteen (14), Fifteen (15), Sixteen (16) Seventeen (17), Eighteen (18). Nineteen (19}, Twenty (20), and T,wenty-one (21) of Block Ten llO) of OCEAN SIDE SECTION, ISLE OF NORMANDY, according to the plat thereof recorded in Plat Book 25L page 60 of the Public Records of Dade County, ~'lorida. 2. The Owner will, within twenty:(20) days ~rom the date hereof, furnish to the City, an abstract of title showing the Owner's title to be good and marketable. 3. The Owner will convey the said land to the City by good and sufficient warranty deed, ~ree and clear of all en- cumbrances except restrictions of record, zoning ordinances of the City o~ Miami Beach, Florida, such municipal improvement liens as ma y be pending but not certified at the time of the closing of the transaction contemplated hereby and taxes for the year 1953. 4. The warranty deed is to provide that title shall WEINSTEI N,WEINSTEIN & WEINSTEIN, ATTORNEYS AT LAW, 420 LINCOLN ROAD. MIAMI BEACH, FLORIDA immediately be re-vested in the Owner, her heirs, successors, or assigns if the City shall cease to use said land for the off-street parking of automobiles, and shall abandon the said land for such use. 5. The City agrees to pay to the Owner as the full' purchase price of said land the sum of Three Thousand Five Hun- dred Dollars ($3500) cash at the time of closing the transaction contemplated hereby. 6. The City agrees that no municipal improvement liens will be claimed or assessed for any portion of the cost of con- structing a sidewalk and pavement upon the lands to be acquired or the liehting thereof. 7. The transaction contemplated hereby shall be closed not earlier than March 31, 1953, and not later than April 6, 1953. 8. This agreement shall be binding upon each of the parties hereto, their heirs, successors and assigns.
