thereof, recorded in Plat Book 25, Page 60 of
the Public Records of Dade County, Florida.

I HAVE EXAMINED the abstract of title covering the
above captioned property, which abstract contains the following
entries:
Entries 1 to 63 inclusive, prepared by the National
Title Insurance Company, bearing Certificate No. 38713, covering
that period of time extending from the Beginning to May 16, 1939,
at 8:00 A. M.
Entries 1 to 6 inclusive, prepared by the Miami Title
& Abstract Co., bearing Certificate No. 47650, covering that
period of time extendi~ from May 16, 1939 at 8:00 A. M. to
September 23, 1939 at 8:00 A. M. ,~

AND FROM SUCH EXAMINATION, I find that on the 16th
day of March, 1953, at 8:00 A. M., the fee simple title to the
aforesaid property was vested in:
BERNARD STERN, a single man,
by virtue of that certain warranty deed dated September 22, 1952,
made by Walter J. Migoski, Trustee, filed for record September
22, 1952, and recorded in Deed Book 3650 at Page 178 of the Public
Records of Dade County, Florida.
SUBJECT, HOWEVER, to the following liens, defects,

impairments and requirements.
1. Mortgage given by Lester Stepner and Sara Jane
Stepner, his wife, to Dade Federal Savings and Loan Association
of Miami, Florida, dated August 27, 1945, and recorded on August
27, 1945 in Mortgage Book 1585 at Page 404 of the Public Records
of Dade County, Florida, and securing an indebtedness in the sum
of $10,000.
2. Mortgage given by Bernard Stern and Janet Stern,
his wife, to Lester Stepner and Sara Jane Stepner, his wife,
dated August 24, 1951, and filed for record on August 27, 1951,
in Mortgage Book 2538 at Page 164 of the Public Records of Dade
County, Florida, and securing an indebtedness in the sum of
$25,000. ,
3. Walter J. Migoski, Trustee, of 6351 Biscayne
Boulevard, Miami, Dade County, Florida, conveyed the property .._._
without the joinder of his wife, to Bernard Stern, a single man.
A warranty deed should be obtained from Walter J. Migoski, Trustee,
joined by his wife Lorraine C. Migoski, to perfect title in
Bernard Stern, a single mm.
4. Reservation by the Trustees of the Internal
Improvement Fund of the State of Florida, of an undivided three-
fourths (3/4) interest in all phosphate, mineral, and metals
that may be in or under the above-described lands and an un-
divided one-half (1/2) interest in all petroleum in or under the
said above-described lands, recorded in that certain quitclaim
deed dated May 8, 1930, given by the Trustees of the Internal
Improvement Fund of the State of Florida, to Normandy Beach
Properties Corporation, a Florida corporation, and filed for
record May 14, 1930, in Deed Book 1381 at Page 525 of the Public
Records of Dade County, Florida.
5. The propertr is subject to City, State, and County
taxes for the year 1953, a though ihey are not yet due and pay-
able.
6. Municipal zoning ordinances of the City of Miami
Beach, Dade County, Florida.
7. Labor performed, or material furnished, if my
has been performed or furnished, to or in connection with the
said property during the past ninety (90) days shall, even though
not now of record, constitute a lien against the property.
8. Rights of parties in possession, if any.
9. Any state of facts which an accurate survey may
disclose.
